DESCRIPTION: On Thursday, January 28, 1993, while driving from one inspection to another it was noted the house at 6880 Portage Road was in the process of having the roof replaced. The existing wood shakes were being replaced with composition shingles. This requires stripping off the old shakes and installing plywood sheathing over the existing spaced boards. Then the roof covering is installed over the plywood. No one was on the job at that time so a Stop Work Notice was left at the site. (Exhibit 1). The notice indicated that the roof covering had to be removed so that the nailing of the plywood could be inspected. At that time, the plywood sheathing installation was substantially complete and a portion of the new roof covering was installed. ---------------------------------------------------------------------- ITEM NO. ~.1 COPIES TO: CITY CLERK FILE, . . On Friday, January 29, 1993, a permit was issued. At that time Mr. Kidder was given a copy of a sketch (Exhibit 8) showing requirements for installing plywood over existing spaced boards. He was also advised to remove the roof covering, install the plywood per the sketch and arrange for an inspection before proceeding any further. This advise was ignored and on Monday, February 1, 1993, it was noted that the work had been completed without any inspections. On Tuesday, February 2, 1993, a Warning Notice was issued requesting compliance within 10 days (Exhibit 2). On Thursday, February 4, 1993 the Building Official related the concerns of the Building Inspection Department to Mr. Kidder by telephone. The issues are: 1) The plywood was covered without inspection and it needs to be inspected. It cannot be inspected without removal of a portion of the roof. 2) When the long edges of the plywood falls in the space between the boards support is required. In that telephone conversation, Mr. Kidder suggested a possible solution would be to have an engineer analyze the condition and demonstrate that the plywood edges need not be supported. The Building Official advised Mr. Kidder that any analysis would be subject to his approval and that sufficient plywood would have to be exposed to verify the adequacy of the nailing. Table 25-0 of the code requires the plywood to be nailed with 8 penny nails at 6" on center at edges and 12" at intermediate supports. On March 11, 1993, the Building Official responded to Mr. Kidder's March 2, 1993 letter (Exhibit 3 & 4). The Building Official indicated removal of approximately 10% of the roof would be acceptable and indicated that 10% insufficient or improperly driven nails would be acceptable. On April 29, 1993, arrangements were made to inspect a 10% sample of the roof to check the nailing. This was to be done at 7 locations. Plywood was exposed at one location and the nail spacing and installation was found to be deficient. Mr. Kidder decided not to continue to expose the plywood at the other locations. On June 8, 1993 Mr. Kidder submitted a request for this hearing (Exhibit 5) along with calculations prepared by Marie C. Goodman P.E. (Exhibit 6). Apparently the request is to approve the roof as is. The calculations have numerous errors as indicated in the Building Official's critique of the calculations (Exhibit 7) and do not address the lack of support of the long edge of the plywood. In addition, they attempt to justify the reduction of nail spacing by showing that the plywood roof provides greater resistance to lateral forces from wind or earthquake than the supporting walls. Exhibit 7 points out .... . . the errors in those calculations. The calculations are based on an assumed nail spacing that has not been verified by inspection and ignore the requirements for wind uplift. Mr. Kidder has indicated that he feels that the Building Department sketch (Exhibit 8) showing how to install plywood over spaced boards does not meet code and therefore, the roof should be approved as is. His engineer has incorrectly advised him that there is insufficient nail penetration where the plywood is nailed to the rafters. Mr. Kidder's engineer is correct in that where the ends of the plywood sheets do not fall on a rafter the penetration is only 3/4" into the boards and the boards are not "framing members." Section 7.28.140 Dublin Municipal Code (Exhibit 9) authorizes the Building Official to approve alternate material and methods of construction. The Building Official has determined that the method shown in Exhibit 8 is equivalent to that required by the code because there are 5 more nails in the plywood in this configuration. Although some have reduced values because of reduced penetration, the additional 5 nails result in a total of 3% higher total nail strength. The reason for approval of this alternate is to minimize cutting of plywood sheets so as to fit existing rafter spacing. This results in a savings of both labor and material and achieves the equivalent of what the code requires. Recently the Building Department required removal of roof covering and renailing of the roof sheathing in a similar circumstance at another location. In summary, the plywood nailing was not inspected. Uncovering the plywood at one location revealed insufficient nailing and the long edges of the plywood may not be supported. The deflection of the unsupported edge of the plywood can cause the underlayment to tear. Insufficient nails can cause the roof to fail due to wind uplift. Therefore, the Building Official recommends that this request be denied. V!ok Teugher Building Official City of Dublin Dear Mr. Taugher, Your department has filed a complaint with the State Contractors Board concerning the property at 6880 Portage Road. I have requested several times from your department the interpretation of the lCBO that would support your use of table 25-S-1 Uniform Building Code for re-roofing. I have not received documentation or a willingness from your department to send me documentation. When I obtained the building permit Mr. White asked me if the plywood had been backed according to table 25-S-1. I told him that it had not and that other municipalities and counties that I have had inspections from did not require it( Danville. Concord. Martinez, Oakland, Alameda, Piedmont San Jose and the County of Contra Costa ). Mr. White informed me that all of the plywood would need to be removed. I asked if he was sure this is what the city would require. He went into the back and I presume spoke with you. Mr. White then told me that regardless of how I backed the plywood it would have to be done or the roof would not pass inspection. I scheduled for an inspection the following work day (Monday). My roofer had evidentlY put more material on the roof that Friday. Mr. White called my wife at her work twice to tell her the roof would need to be removed and called my secretary numerous times. I have requested of you that I would no longer have to interact with Mr. White. because of his actions and belligerent behavior toward me. r feel that your department is harassing me and making my task of running a small business more difficult. It is my hope that we can resolve this matter with out having to involve the city manager or legal counsel. I pointed out to you in our first telephone conversation, on or about, February 4, 1993, that the City has a responsibility to inspect the work that you performed while replacing the roof at 6880 Portage Road, Dublin. Specifically, we need to inspect the nailing of the new plywood sheathing. I do not know any way of doing so without removing the roof covering. The second issue is that the long edges of the plywood sheets need to be supported at 24" on center where these edges fall between the spaced sheathing boards. You indicate that this is not required by some communities. On the other hand Dublin, Livermore, Union city, El Cerrito and Albany are a few of the communities that do require the support. Section 104 Uniform Building Code provides that additions, alterations or repairs may be made to existing buildings provided that the addition, alteration, or repair conforms to that required for new structures. Table 25-5-1 requires the face grain of the plywood to be perpendicular to the supports and indicates the maximum span between supports. Item 5 of the table indicates that the maximum span for plywood having a span rating of "24/0" is 24" and Item 6 of the table indicates that the plywood with a span rating of "32/16" may have maximum span for blocked edges 32" and 28" for unblocked edges. The span rating is stamped on the plywood and an inspection will determine which item of the table applies. Where the long edge of the plywood falls between the sheathing boards the face grain is not perpendicUlar to the support. Therefore, based on Table 25-5-1 supports must be provided for the plywood in the space between boards. These supports may be spaced at 24" or 28" on center depending on the span rating of the plywood used. I explained to you that where the long edge is not supported this could be corrected by slipping a block of one by material between the rafter and the plywood from the attic side rather than removing the plywood. Your engineer needs to know the thickness, and span rating of the plywood and the maximum space between the sheathing boards. In order to put this problem in perspective, a stop Work Order was issued on January 28, 1993, because work was started without a building permit. That notice included a notation that roof covering was to be removed in order to inspect the nailing. It did not include a detailed description of how much to be removed since this is normally left to the discretion of the inspector. On January 29, 1993, you obtained a building permit and you were appraised of the concern for supporting the long edge of the plywood, and were given a copy of the enclosed handout showing an acceptable way of installing the plywood. On February 1, 1993, the roof covering had been essentially completed without an inspection. You were then given a warning Notice indicating that you are to remove the roof covering for an inspection and to support the long edges of the plywood. Again, a detailed description of the removal was not given as indicated above. Compliance was indicated to be done in ten (10) days. The phone calls were an attempt to determine when you planned to correct the situation, but you never returned the calls. since you did not respond, complaints were filed with the contractors state License Board and the Better Business Bureau. with regard to the phone, we have two numbers; 689-2341 and 838-7027. Which number do you prefer that we use? As I said before the only way I know to inspect the plywood nailing is to remove sufficient roof covering, at random locations, to show that the plywood is properly nailed. In our phone conversation of March 8, 1993, you asked that I clarify what "remove sufficient roof covering at random locations means." I estimate the roof has about 22 squares. Therefore, I think removal of the 10% of the covering should be adequate. The City will accept exposing seven (7) 4 x 8 sheets of plywood, in the presence of the Building Inspector, which is 224 square feet. One sheet should be exposed on the east, south and west side of the rear hip roof wing of the house. One sheet should be exposed on the rear of the main roof and two on the front of the main roof. Three sheets should be near the eaves and the remainder may be near the ridge. Ideally, there should be 33 or more nails per sheet. If more than 4 nails or 10% of the nails on any sheet are not properly installed, an additional sheet shall be exposed. An additional sheet shall be exposed for each sheet failing to pass. On the other hand, if less than 4 or 10% of the nails are not properly installed on each sheet the work will be accepted. Also, if any plywood is damaged by careless workmanship the plywood shall be replaced. . . Michael Kidder March 11, 1993 Page 3 I have explained how the code applies to re-roofing. Sheet V-l The minimum penetration for 8 penny (8d) nails is 1~" not 1~1I per Table 25-G. The actual thickness of 1 inch nominal boards is 3/4" therefore, the actual penetration of an 8d nail into the supporting rafter is 1~ inch and meets code. Sheet V-2 The calculations are based on the assumption that the nail spacing for the roof is 8" on center. This needs to be verified by inspection of at least 10% of the plywood. The allowable shear values for the existing stucco walls 15 180 l#/ft not 75 as shown in the calculations. The interior walls which have gypsum board on both sides are capable of 200 #/ft for wind loads not 100 plf. Therefore, the conclusion the roof is stronger than the walls is not correct and does not justify reducing plywood nail spacing to some unknown value. Furthermore, these calculations do not take into account wind uplift which is far more critical than lateral loads. Sheet D-l The calculations rating of 32/16. to be verified by rating of 24/0. assume the plywood thickness is 19/32 and has a span The thickness and span rating of the plywood needs inspection. It is probably ~ inch thick with a span Sheet D-2 The analysis calculates the deflection of the plywood spanning the space between the boards. The space is shown to be 8~" in section A-A, but calculations are based on 6". The actual space must be determined by inspection. The calculations use the wrong moment ,:f inertia and modulus of elasticity. The fOllowing are the correct values for the assumed plywood grade and the probable plywood grade: Moment of Inertia Modulus of Elasticity .209 Correct Value For Assumed Grade of Plywood .01 Value For Probable Grade of PlyWood .004 Values Used 1,800,000 1,500,000 1,000,000 The correct values will result in a larger deflection. The provisions of this chapter are not intended to prevent the use of any material or method of construction not specifically prescribed by this chapter; provided, any such alternate has been approved by the Building Official. B. The Building Official may approve any such alternate provided he finds that the proposed design is satisfactory, and that the material, method, or work offered is. for the purpose intended, at least the equivalent of that prescribed in this chapter in quality, strength, effectiveness, fire resistance, dura. bility, dimensional stability, and safety. The details of any action granting approval of an alternate shall be recorded and entered into the files of the city. C. The Building Official may require that sufficient evidence or proof be submit~ ted to substantiate any claims that may be made regarding its use. (Ord. 21-89 ~ 11.1 0) 7.28.150 Modifications. Whenever there are practical difficulties involved in carrying out the provisions of this chapter, the Building Official may grant modifications for individual cases, provided he shall first find that a special individual reason makes the strict letter of this chapter impractical and that the modification is in confonnity with the intent and purpose of this chapter and that such modification does not lessen any fire protection requirements or any degree of structural integrity. RESOLUTION NO. - 93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING A VARIANCE SO AS TO WAIVE THE INSPECTION OF THE NAILING OF THE PLYWOOD ROOF SHEATHING AT 6880 PORTAGE ROAD WHEREAS, Michael Kidder, Kidder Roofing, 1455 Grove Way Concord, CA 94518 has requested a variance to permit the installation of a new roof covering at 6880 Portage Road, Dublin without inspection of the nailing of the plywood; and WHEREAS, the City Council of the city of Dublin did hold a pUblic hearing on this matter on June 14, 1993; and WHEREAS, the city Council does find that the granting of the variance is ,consistent with the intent of the code and will not lessen the protection to the people or property within the city because an engineering analysis indicates that the assumed nail spacing is adequate. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin city council does hereby approve said variance subject to the condition that written approval of the owner of 6880 Portage Road accepting the roof without inspection be submitted to the Building Department.
