Sufficient funds are budgeted in the Street Maintenance Operating Budget for this purpose. DESCRIPTION: This is the second reading of a proposed ordinance that was introduced at the July 11 th City Council meeting. Sections 22357 and 40803 of the California Vehicle Code (CVC) require a local authority to determine and post speed limits on the basis of an engineering and traffic survey. Speed limit enforcement by means of radar or other electronic devices cannot be used in court for streets with adopted speed limits that are not justified by an engineering and traffic survey (except certain streets such as residential streets with a width of 40 feet or less). The CVC further states that said determination and declaration of the speed limit shall be accomplished by adoption of an ordinance. To date, speed limits have not been set for the new extension of Dublin Boulevard east of Dougherty Road. In accordance with the CVC requirement, TJKM conducted radar speed surveys on segments of Dublin Boulevard from Dougherty Road to the Southern Pacific Railroad (SPRR) Right-of-Way, on Scarlett Drive, and on Scarlett Court. The speed survey process involves using three criteria to determine the speed limit. The first criterion is using radar to measure the speed of a sample of traffic using the road. The "85th percentile" or "critical" speed is the speed at or below which 85 % of the vehicles are traveling. The second criterion is the design and geometrics of the road, such as curvature, sight distance, and intersecting driveways or cross streets. The third criterion is the number of accidents and safety of the road due to vehicle speed. Following are the results of the speed surveys and the recommended speed limits for each roadway segment. Dublin Boulevard From Dougherty Road to the Southern Pacific Right-of-Way: 85th percentile speed: , 44 mph Recommended speed limit: 35 mph The 35 mph speed limit is recommended due to the curvature of the roadway and to establish consistency with Dublin Boulevard west of Dougherty Road. Recommended speed limit: 35 mph. Based on the 85th percentile speed, the narrowness of the road, the shortness of this segment (1200') and a desire for consistent speed zoning in the area, a 35 mph speed limit is recommended. Scarlett Court (Resurveyed because of changes to the flow pattern.) 85th percentile speed: 39 mph. Recommended speed limit: 35 mph. This is a change from the current, adopted speed limit of 30 mph. The recommended 35 mph speed limit supports the 85th percentile speed of 39 mph, and there are no roadway characteristics that would warrant a lower speed limit. No reported speed-related accidents have occurred on any of these street segments. Speed limits for Dublin Boulevard east of the Southern Pacific Railroad right-of-way and for Hacienda Drive will be set once the improvements and roadway dedication have been accepted by Dublin from Pleasanton. Staff recommends that the City Council conduct a public hearing, deliberate, waive the reading, and adopt the ordinance establishing speed limits for Dublin Boulevard from Dougherty Road to the Southern Pacific Railroad Right-of-Way, for Scarlett Drive, and for Scarlett Court. a: (9495) ~july la gstspd Page 2 ORDINANCE NO. -94 AN ORDINANCE OF THE CITY OF DUBLIN ESTABLISHING SPEED LIMITS FOR DUBLIN BOULEVARD FROM DOUGHERTY ROAD TO THE SOUTHERN PACIFIC RAILROAD RIGHT-OF-WAY, FOR SCARLETT DRIVE, AND FOR SCARLETT COURT The City Council of the City of Dublin does ordain as follows: Section 1: In accordance with California Vehicle Code Section 22357 and Dublin Municipal Code Section 6.04.340, the following speed limits are established: Dublin Boulevard from Dougherty Road to the Southern Pacific Railroad Right-of-Way: 35 miles per hour. Scarlett Drive: 35 miles per hour. Scarlett Court: 35 miles per hour. Section 2: Traffic Code. The above speed limits shall be added to Chapter 6.60 of the City of Dublin Section 3: This ordinance shall become effective 30 days after its final passage and adoption by the City Council. The City Clerk of the City of Dublin shall cause this ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California.
