FINANCIAL STATEMENT: /~;~'5/ The total of the appraised values and subsequent offers for the five parcels is $1,853,934 (assuming a partial take of the Nohr property.) DESCRIPTION: The City's Five-Year Capital Improvement Program identifies a project to acquire property and construct the easterly extension of Dublin Boulevard from Dougherty Road to the Southern Pacific Railroad Right-of-Way. The Dublin Boulevard Extension alignment was approved by the City Council on April 25, 1988, after certification of the Negative Declaration for the project. Traffic engineering concerns were considered when the plan line for the Extension was adopted in 1988, and the alignment adopted contemplates acquisitions that involve the least public injury and the greatest public good. The three alternatives considered at the public hearings on the plan line adoption each required the acquisition of the Valley Boat House. The Extension of Dublin Boulevard is necessary to provide an arterial thoroughfare to the eastern Dublin area that will accommodate traffic that will be generated from the planned development of that area. The Extension will also serve the East Dublin BART Station. Five properties need to be acquired through purchase, either in total or in part, in order to accomplish construction of the road. The owners of the five properties have received notification of this hearing by certified mail. Appraisals have been conducted on the five properties, and the City Attorney's office has submitted offers to the property owners based on these appraisals. The five properties that are the subject of the Resolution of Necessity are: 1> 3> 4) 5) Ail of the Boat House property. The northerly 1/3 of the Curtiss Dodge (Nohr) site. A small northerly portion of the Dolan Lumber site. The very northerly portion of the Miracle Auto Paint parcel. The area needed through the Southern Pacific right-of-way for the total I10-foot width of Dublin Boulevard. One other parcel is proposed to be acquired through an assessment district over Tract 5900 (John Moore parcel), and another parcbl is proposed to be acquired through dedication as a condition of approval for the Standard Oil service station project. ........................................................... --tf'l 7 ITEM NO. ~ COPIES TO' Property Owners (7) While agreements may be reached with the property owners prior to the City's planned construction schedule (beginning in the spring of 1992), Staff recommends adoption of the Resolution of Public Interest and Necessity so that this option will be available should it become necessary. This action will allow the City Attorney to proceed to obtain possession of the right-of-way through the court so that construction may proceed while negotiations continue. a:(dbx)~agenda~phnecess - 2 RESOLUTION NO. - 91 A RESOLUTION OF THE CITY OF DUBLIN A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN LAND AND DIRECTING THE FILING OF EMINENT DOMAIN PROCEEDINGS Dublin Boulevard Extension Project Assessor's Parcel Nos. 941-550-10-6; 941-550-10-11; 941-550-12-7; 941-550-13-2; and 941-550-22-3 IT IS RESOLVED by the City of Dublin, California, as follows: WHEREAS, it is desirable and necessary for the City of Dublin to acquire certain real property, particularly described in Exhibit "A", attached hereto and made a part hereof by reference, in order to construct the extension of Dublin Boulevard from Dougherty Road to the Southern Pacific Railroad corridor; WHEREAS, the City of Dublin is vested with the power of eminent domain to acquire real property by virtue of Article 1, Section 19, of the Constitution of the State of California, and Sections 1240.050, 1240.110, 1240.120, 1240.125, 1240.150, 1240.240, 1240.410 and 1240.610 of the Code of Civil Procedure of the State of California; and WHEREAS, pursuant to the provisions of Section 1245.235 of the Code of civil Procedure of the State of California, notice 114\reso[\acqu~$~.ehs October 28, 1991 has been duly given to all persons whose property is to be acquired by eminent domain and whose names and addresses appear on the last Alameda County equalized assessment roll, all of whom have been given a reasonable opportunity to appear and be heard before the City of Dublin on the following matters: (a) Whether the public interest and necessity require the Project; (b) Whether the Project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; and (c) Whether the property sought to be acquired is necessary for the Project; WHEREAS, pursuant to the provisions of Section 7267.2 of the Government Code of the State of California, the City of Dublin has made offers to the owner or owners of record to acquire the subject property for just compensation; WHEREAS, a Negative Declaration has been prepared for the adoption of the plan line for the Dublin Boulevard extension from Dougherty Road to the Southern Pacific Railroad corridor and a Negative Declaration has been prepared for the construction of the roadway extension; and public notice has been given in the form provided by law, and members of the public have been given an opportunity for public review and comment; 114\reso[\acquisi.ehs October 28, 1991 NOW, THEREFORE, IT IS FOUND, DETERMINED, AND ORDERED as follows: 1. The public interest and necessity require the Project which is the extension of Dublin Boulevard from Dougherty Road to the Southern Pacific Railroad corridor. 2. The Project is planned and located in the manner which will be most compatible with the greatest public good and the least private injury. 3. The real property described in Exhibit "A" hereto is necessary for the Project. 4. The offers required by Section 7267.2 of the Government Code of the State of California have been made to the owner or owners of record of the real property described in Exhibit "A". 5. On April 11, 1988, the City Council of the City of Dublin by Resolution No. 53-88, adopted a Negative Declaration for the adoption of the plan line of Dublin Boulevard to the Southern Pacific Railroad corridor, pursuant to the California Environmental Quality Act. The Notice of Determination for the Negative Declaration was filed with the Alameda County Clerk on May 26, 1988. On October 29, 1990, the City Council of the City of Dublin by Resolution No. 134-90, adopted a Negative Declaration for the construction of the roadway extension from Dougherty Road to the Southern Pacific Railroad Corridor, pursuant to the California Environmental Quality Act. The Notice 114\reso[\acquisi.ehs October 28, 1991 of Determination for the Negative Declaration was filed with the Alameda County Clerk on November 15, 1990. 6. The City Attorney of the City of Dublin or her duly authorized designee be, and she is hereby, authorized and directed to institute and conduct to conclusion an action in eminent domain for the acquisition of the estates and interests aforesaid and to take such action as she may deem advisable or necessary in connection therewith; 7. An order for prejudgment possession may be obtained in said action and a warrant issued to the State Treasury Condemnation Fund, in the amount determined by the Court to be so deposited, as a condition to the right of immediate possession.
