HomeMy WebLinkAbout6.1 Calmet Appeal y 1D--6D CITY OF DUBLIN AGENDA STATEMENT MEETING DATE: February 28, 1983 SUBJECT Request to temporarily suspend the appeal of Calmet, Inc. , Tentative Map, Tract 5047 EXHIBITS ATTACHED Letter from Calmet, Inc. , dated February 18 , 1983 RECOMMENDATION Consider request. pr FINANCIAL STATEMENT: None DESCRIPTION • On July 12 , 1982 , the City Council considered an appeal of Tentative Map, Tract 5047, proposed by Calmet, Inc. The project involves 145 condominium units near the interesection of San Ramon Road and Dublin Boulevard, behind the Iceland skating facility. Appeals to the Tentative Map were filed by the developer and by area residents. The City Council continued the matter and directed Staff to try to resolve the issues. Staff has been concentrating on the traffic issue. Calmet, Inc. , has requested the City Council to temporarily suspend any action on the appeal for 150 days . The reason for the suspension is to allow consideration of a different application on the site. The developer has indicated a desire to apply for a Planned Development for apartment units . Calmet, Inc. , further requests that the appeal of the Tentative Map be reinstated at no additional cost if 1) the City Council denies the new application, or 2 ) 150 days lapse, whichever comes first. TIMING CONSIDERATION For a Planned Development or other amendment to the Zoning Ordinance, the processing time would be as follows: a) With a Negative Declaration, a minimum of 2 to 4 months from time of complete application to City Council hearing. b) With an Environmental Impact Report, a minimum of 3 to 6 months from time of complete application to City Council hearing. The total number of calendar days involved would depend on when the completed application is submitted, the complexity of the project, the type of environmental document required, the issues raised during the project review, and the number and length of Planning Commission and City Council hearings . The 150 day time limit requested by the developer could be tight. At the end of 150 days, the City may or may not have completed the processing of the new application. The developer has indicated a strong desire to stay with the 150 day time limit. COPIES TO: / ITEM NO. / . Box 2340 Dublin, Ca 94568 Dear Members of the City Council; On July 12, 1982, our application for a renewal of the Tentative Map #5047 for 145 Condominium Units on 13.4 acres was appealed by the neighboring landowners and the Council has referred the application to Staff with directions to confer with us and the appellants in order to resolve their differences. There was also the recommendation that a traffic study should be completed on San Ramon Rd and the intersection of Dublin Blvd. and Donlon Way before a final decision can be made. I hereby request that the City Council defer action and temporarily suspend the Tentative Map appeal for 150 days. The reason for this request is we have a Developer who is interested in putting a Planned Unit Development of apartment units on that property and we will be making that application as soon as we receive notice that your Council has approved the temporary suspension of the Tentative Map. We feel that apartments will better serve Dublin's housing needs because our marketing survey showed there were no vacancies and every apartment house had a waiting list with several people seeking apartments every day. Dublin has hundreds of businesses that employ middle and moderate income people that must have housing. The impact of major businesses coming into this area will only aggrevate the situation. We hope you will support the need for affordable rental housing and will help expedite the processing of this new (PUD) application so it can be approved by the 150 days. It is our understanding, that if the (PUD1 application is not approved as submitted that the present Tentative Map will be reinstated to its present status and the suspension, if granted, will be with that condition, namely without prejudice to our right (without additional fees) to reinstate our presently pending application. Such reinstatement would automatically occur either upon the expiration of 150 days or a negative decision by the City Council on the above contemplated second planning application for the parcel, whichever occurs first.
