O1f0s BUILDING INSPECTION DEPARTMENT March 23, 1982 Mr. George Gaekle City Manager City of Dublin 6500 Dublin Blvd. , Suite 218 Dublin, CA 94560 7360 SAN RAMON RD. , DUBLIN - OWNER, JOHN NICHANDROS On January 8, 1981 a hearing was held in connection with the abatement of several additions and structures built without permits at the subject address. An Order of Abatement was issued specifying that the additions and structures be constructed to comply with building and fire codes by a specified time. If the additions and structures were not brought up to code, then they were to be removed. The order further provided that if the owner did not remove the buildings, this office I, was authorized to remove the additions and structures. The time for compliance has long since expired. This office is desirous of proceeding with the abatement. Since this property is now located in the City of Dublin, it is believed that this matter should be reviewed by your City Attorney before pro- ceeding. It will be necessary to determine whether the order to abate was not invalidated by the incorporation. If the order is valid, the question as to how to proceed should be guided by advice from your City Attorney. Finally, the City Council should be at a minimum apprised of any pending action. The problem of construction without a permit was compounded by the proposed frontage road on the west side of San Ramon Rd. Mr. Nichandros was unwilling to meet several requirements of the Road Department in connection with the proposed frontage road. It may be that the city will develop different plans in connection with the proposed frontage road. It is suggested that it may be appropriate to meet with you and visit the site so :'c that you may become more familiar with the problem. I am enclosing a copy of the :: abatement order and a December 24, 1980 memo that briefly describes the problem. TAUGHER IILDING OFFICIAL 2 2 _ • ORDER OF ABATEMENT DATE AND TIME OF PUBLIC HEARING: This hearing was originally held at 9 a.m. , on Friday, December 19, 1980 and continued at the request of Mr_ Phillip J. Maddux, Attorney for the Owner, Mr. John Nichandros, to 9 a.m. , Thursday, January 8, 1981. HEARING OFFICER: H. A. Flertzheim, Jr. PREMISES TO BE ABATED: 7360 San Ramon Road, Dublin, CA 94566 Book 941, Block 40, Parcel 2-3 (Assessor's Reference No. ) CONDITIONS WHICH CONSTITUTE A PUBLIC NUISANCE: As stated in the Notice of Public Hearing to Consider Abatement of Nuisance and Minutes of Public Hearing, the conditions creating the nuisance are: 1. Addition (approx. 19 ' x 60' ) attached at rear of building, built without obtaining a permit. (8 violations) 2. Addition (approx. 17' x 90 ' ) on south side of building. (9 violations) 3. Shed, storage (approx. 16' x 30' ) , built without obtaining a permit. (7 violations) 4. Shed, storage (approx. 8 ' x 12 ' ) . (4 violations) 5. Rack, storage (approx. 16' x 24' ) , built without obtaining a permit. (3 violations) The above substandard conditions shall be abated by measures as enumerated below. COMMENCEMENT OF ABATEMENT: 1. 15 days from the date of this Order, construction shall begin on two fire corridors with 1-hour sheetrock fire walls, leading from the main store though the side and rear storage areas, exiting to the outside. 2. 60 days for submittal of plans for bringing all structures up to building and fire codes. 3. 30 days for start of construction after plans are approved; but not longer than a total of 120 days, total. Construction shall be com- pleted within 180 days from the date of this Order. COMPLETION OF ABATEMENT: In the event abatement has not commenced within 120 days, the structures will be abated, and/or if the Owner has decided it is infeasible to bring the structures up to code, they shall be abated. The Building Official is authorized to proceed with the abatement of the nuisance and charge the costs to the Owner, in the event this Order is not complied with.
