SUBJECT: Written Communication: Counter Measure to Referendum of
Western Dublin General and Specific Plan

RECOMMENDATION: qkAReceive Presentation by Eden Development Group and
provide Staff with appropriate direction.
FINANCIAL STATEMENT: If the Referendum qualifies for the ballot and the
City Council calls a special election, there may
be an incremental cost of placing a counter 4
measure on the ballot. This cost is undetermined
at this time.
DESCRIPTION: The City has received a request from the Eden
Development Group to consider placing a counter measure to the Referendum
of the Western Dublin General and Specific Plans on the ballot for a
special election, if the Referendum qualifies.
Eden Development Group has suggested that a ballot measure be developed
which would address and resolve those concerns identified by the proponents
of the pending referendum.
Eden Development Group would like to discuss this proposal in more depth
with the Council at the City Council of September 14, 1992.

Counter Measure to Referendum of
West Dublin General and Specific Flans
Dear Mayor and Council Members:
Throughout the public process, our goal has been to
fashion a development project that would not only secure the
support of the City Council, but would be the kind of
development in which the entire City could take great pride.
Therefore, we cannot ignore what we believe to be
legitimate concerns raised by the proponents of the pending
referendum. In short, we suggest that a proposal by the
Council which addresses and resolves these concerns should be
placed on the ballot with the referendum.
In this way, the voter will not simply be placed in
the reactive role of approving or disapproving the prior
actions of the City. Instead, they will be given the proactive
role of ensuring that specific preservation policies and
development restrictions are not only established, but given
the power of law. The measure would aaurantee that no
construction or development could take place unless and until
concerns such as water availability, open space preservation,
public trails accessibiltiy, ridge line protection., traffic
mitigation, financial liability, public service adequacy and
the like are resolved.

We are hopeful that you find this suggestion worthy of
Council and voter consideration. We will be present at the
"public comments" portion of your meeting of September 14, 1992
to further address this proposal.
