Home My WebLink About4.7 Accept Improve Map 4008 q10-,50 CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: December 9, 1985 SUBJECT: Acceptance of Work - Parcel Map 4008 • (Winning Action Investments ) EXHIBITS ATTACHED: Resolution; Location Maps RECOMMENDATION: Adopt resolution to: ( 1 ) accept the work completed in Parcel Map 4008 , subject to street lights and street tree work being completed, and ( 2 ) authorize Staff to accept a maintenance bond in the amount of $43 , 112 . 50 , plus an additional performance bond of $11 , 000 for street trees and street lights . FINANCIAL STATEMENT: No immediate maintenance costs other than street sweeping and street light energy bills when installed. DESCRIPTION: All work in connection with the subject tract has been completed in accordance with the terms of the subdivision contract, except for street trees and street lights, and acceptance of the work is now in order . Pertinent information concerning the tract is as follows: a ) Subdivider : Winning Action Investments b) Tract. location : Dougherty Road at Houston Place c) Tract size: 3 commercial lots d) Resolution approving Parcel Map: 126-84 e ) City streets affected: Dougherty Road and Houston Place At the time the City and the subdivider- executed the contract for the Tract improvements, the subdivider was required to post a performance bond in the amount of $172 , 450 . 00 to provide the necessary security for the performance of the work involved. As the work is now completed, the performance security requirement can be reduced, in accordance with the authority contained in Section 66499 . 7 of the Government Code, to an amount necessary to guarantee maintenance of the work for a one-year period following acceptance of the work . The subdivider has requested to provide a bond in the amount of $43 , 112 . 50 , which is 250 of the original bond required, and which is sufficient to cover the one-year maintenance guarantee period. He would post an additional bond in the amount of $11 ,000 to cover improvements which cannot be completed at this time . The street improvements have been completed for some time; however , the street trees have been allowed to be incorporated into the landscaping plans for the project . The landscaping plans have not been totally reviewed at this time. Also, the P . G. and E. lines have not been placed to the rear lot pending approval of those plans, thus holding up installation of two street lights . --------------------------------------------------------------------------- ITEM- NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN FOR THE ACCEPTANCE OF IMPROVEMENTS PARCEL MAP 4008 WHEREAS, the owner-subdivider of the aforesaid tract previously entered into a contract with the City of Dublin to improve said tract in accordance with plans and specifications on file with the City Engineer of the City of Dublin, said tract identified as follows: a) Subdivider : Winning Action Investments b) Tract Location: Dougherty Road at Houston Place c) Tract Size: 3 commercial lots d) Resolution approving Final Map: 126-84 e) City streets affected: Dougherty Rd. and Houston Place; and WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of the City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract , the subdivider is required to guarantee the improvements and to maintain the completed work for a period of one year following acceptance of the work by the said City of Dublin; and WHEREAS, as the tract work is now completed, the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499 . 7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period; NOW, THEREFORE, BE IT 'RESOLVED that 1 ) The improvements are completed within the said tract and they are hereby approved and accepted subject to the aforesaid one-year guarantee except the two street lights and six street trees ; 2 ) The aforesaid original performance bond security requirement may be reduced from the amount of $172, 450 to a revised security requirement in the amount of $43 , 112 . 50 , and this replacement bond in the said amount may be accepted by the City Engineer as security for the aforesaid one-year guarantee period; and 3 ) The said original performance bond in the amount of $172 , 450 posted in connection with the work involved in the construction of the said tract may be released when the $43 ,112 . 50 bond and a performance bond of $11 , 000 . 00 are filed with the City of Dublin.
