FINANCIAL STATEMENT: Original claim submitted by Richard Leon Duncan, et al., was in excess of $7.6 million. DESCRIPTION On July 9, 1984, the City Council denied a claim for wrongful death submitted by Mr. Leon Duncan, et al . The claim has been forwarded to the insurance carrier, Continental Insurance Company. Mr . Brian J . Morris of the firm of Alton M. Chambliss is the attorney representing the City subject to the terms and provisions of the City' s insurance policy . Mr. Morris has filed a cross complaint in the matter which names among others Pacific Gas and Electric Company as a cross- , defendent . In essence this action will allow the courts to determine whether the cross-defendents are obligated to assume any fault or legal responsibility for any liabilities , damages , or judgements resulting from this claim. Pacific Gas and Electric has in turn filed a claim against the City of Dublin.
