Thompson, Public Works Director) EXHIBITS ATTACHED: 1) Resolution 2) Map .~~ Adopt Resolution RECOMMENDATION: FINANCIAL STATEMENT: None. DESCRIPTION: As a condition for further development on 7601 Amador Valley Blvd., the City of Dublin requested that the developer, Rainbow Investment, abandon 10 feet of Public Utility Easement (PUE) which lies 5 feet on either side of the land dividing lots 1 and 2, Block 2, Tract 2161 (See map Exhibit 2). Staff has contacted the various utility companies and found that no utilities were ever installed in the PUE, and none of the utility companies requested future use of it. Said PUE is no longer required for public purposes in that the easement has not been used for the purpose for which it was offered for dedication for more than five consecutive years. It should be noted that the building which is occupied by Erik's Deli, The Imprint Works, and other businesses has already been constructed on the easement. Staff recommends that City Council adopt the resolution abandoning this Public utility Easement. --------------------- --------- ITEM NO. M- COPIES TO: Robert Glockner JLW G7o-iO RESOLUTION 00. -91 A RESOLUTION OF 'lliE CITY CQUæIL OF THE CITY OF DUBLIN S~y VÞCATINS A PUBLIC UTILITY EASEMENT BE IT RESOL\ÆD AS FOLLOWS: Section 1. This resolution is enacted pursuant to the provision of Streets and Highways Code 8330 et seq., Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code. -- Section 2. A public utility easement located within the City of Dublin, Alameda County, California is unnecessary for present or prospective public use, being that public utility easement described as follows: A strip of land 10 feet in width lying 5 feet on each side of the land dividing lots 1 and 2 in Block 2, as said lot and Block are shown on the map of Tract 2162 filed August 23, 1960 in Book 42 of Maps, Page 50, in the Office of the County Recorder of Alameda County. Section 3. Said public utility easement is no longer required for public purposes in that (1) the easement has been superceded by relocation and there are no other public facilities located within the easement and (2) the easement has not been used for the purpose for which it was offered for dedication for five consecutive years immediately preceding the date hereof. Section 4. A copy of this resolution shall be recorded with the County Recorder pursuant to Streets and Highways Code 8336. Following recordation, the public utility easement described in Section 2 hereof shall no longer constitute a public utility easement. Section 5. No public utility facilities are in place and in use which would be affected by the vacation of said public service easement. PASSED, APPROVED AND ADOP'IED this _th day of , 1991.
