RECOMMENDATION
Deny the claim and refer the matter to the Insurance
Carrier
FINANCIAL STATEMENT: Estimated cost of damage - $19,000
D~SCRIPTION : Valley Crest Landscape, Inc., allegedly damaged a
~ific Bell telephone cable at the intersection of Dublin Boulevard and
~zllage Parkway. Valley Crest is the contractor handling the median
landscaping on Village Parkway, Dublin Boulevard and Amador Valley
Boulevard.
It appears that the contract with Valley Crest Landscape, Inc., provides
indemnification for the City. Staff has provided the insurance broker with
a copy of the contract and the certificate of insurance. Pacific Bell
estimates the cost of repair at $19,000.
Staff recommends that the City Council deny the claim and direct SLaff to
notify the City's Insurance Broker.

Circumstances Causing Claim:
Your contractor, Valley Crest Landscaping, damaged our
buried 1800 pair cable with a backhoe. The backhoe was
operated by Jose Grellana and was under the supervision
of Ernest Diaz. The damage caused the cable to be
replaced. Our facilities were clearly and accurately
located and marked
Description and Itemization of Damage:
The replacing and splicing of a DSMC-1500 cable
related conduit.
