DESCRIPTION: The City Council, at its April 26, 1993, meeting, directed
Staff to review the need for charging the Celebrity's Restaurant a traffic impact
fee for adding outdoor seating to their restaurant.
Celebrity's now has tables for inside dining which seat 40 people. The proposal is
to add 12 outdoor tables to seat a maximum of 48 more people.
The City Attorney has reviewed the new proposal, as well as the previous 1987 and
1988 rezoning applications and the City/Enea lawsuit settlement agreement. The City
Attorney concludes that it is questionable whether a traffic impact fee can be
required for this conditional use permit.
It appears that the traffic generated by the expanded use is consistent with the
traffic anticipated in the previous 1987 and 1988 rezoning applications and
subsequent settlement. Therefore, Staff will not be recommending the imposition of
a traffic impact fee as part of the Conditional Use Permit submittal to the Planning
Commission.
