J--- (Nielsen) - Consent to as County Roads Adopt Resolution Consenting to the Establishment of City Streets as County Roads and Direct City Clerk to forward certified copies of Resolution to Alameda County Public Works None DESCRIPTION : Tracts 5072, 5073 and 5074 are to be approvd by the City Council on October 28, 1985 and will also go before the County Board of Supervisors for approval. Portions of all three tracts are presently in both the City of Dublin and the unincorporated portion of Alameda County. It is to the advantage of both the County and the City that a single agency contract with the developer for all of the street improvements with each of these tracts. The Streets & Highways Code allows the County to declare any highway contained wholly or in part within a City, to be a County Highway for the purpose of construction, maintenance, improvement or repair if the City consents. With the attached Resolution, Dublin consents to the following streets being declared County Roads for the purpose of construction: Homestead Court, Saddleback Drive, Rolling Hills Drive, Rock Springs Drive, Village View Court, Timber Ridge Drive and Hollow Tree Court. This action simplifies the process by not requiring both jurisdictions to enter into separate agreements and require separate bonds and fees. Dublin Engineering Staff will inspect the improvements and will accept the inspection fees for this purpose. When portions of these tracts are annexed to the City and the improvements accepted, the streets will become City streets. ---------------------------------------------------------------------------- ITEM NO. '-lIP COPIES TO: RESOLUTION NO. - 85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN -------------------------------------- CONSENTING TO ESTABLISHMENT OF CITY STREETS AS COUNTY ROADS TRACTS 5072, 5073 & 5074 WHEREAS, Tracts 5072, 5073 and 5074 are partially in the unincorporated area of Alameda County and partially within the City of Dublin. It is to the advantage of both Alameda County and the City of Dublin that a single agency contract with the developer of Tracts 5072, 5073 and 5074 for all of the street improvements; and WHEREAS, Section 1700 of the Streets & Highways Code of the State of California provides that the Board of Supervisors of a County may declare any highway lying wholly or in part within a City, to be a County Highway for the purpose of construction, maintenance, improvement or repair; and WHEREAS, Section 1701 of the Streets & Highways Code requires consent of the City Council for such declaration to become effective. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby resolve as follows: That this City Council does hereby consent to the establishment of Homestead Court as shown on the Final Map of Tract 5072 within the City of Dublin; and Rolling Hills Drive, Rock Springs Drive and Saddleback Drive shown on the Final Map of Tract 5073 within the City of Dublin; and Rock Springs Drive, Village View Court, Timber Ridge Drive and Hollow Tree Court shown on the Final Map of Tract 5074 within the City of Dublin, as County Highways for the purpose of the construction of street improvements by the developers of Tracts 5072, 5073 and 5074; and BE IT FURTHER RESOLVED that the City Clerk be, and is hereby directed to forward two certified copies of this Resolution to the Department of Public Works of Alameda County.
