HomeMy WebLinkAbout4.04 ROW DublinBlvd-Hacienda e e CITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date: July 25, 1995 SUBJECT: Resolution of Intention to establish a right- of-way line for Dublin Boulevard from the eastern BART access drive to Hacienda Drive REPORT PREPARED BY: ~ Lee Thompson, City Engineer Dennis Carrington, Senior Planner EXHIBITS ATTACHED: Exhibit A: Resolution of Intention to establish the right-of-way line RECOMMENDATION: ~ !:r ~ Adopt Resolution of Intention to establish the right-of-way line FINANCIAL STATEMENT: Costs to construct the roadway will be borne by the County of Alameda DESCRIPTION: The proposed right-of-way is a portion of Dublin Boulevard as shown on the General Plan and the East Dublin Specific Plan. The construction of this portion of Dublin Boulevard is necessary to connect the developed area of the City of Dublin with the approved Eastern Dublin Specific Plan. The establishment of this right-of-way is required for the construction of this portion of Dublin Boulevard and is governed by Chapter 7.68 of the Dublin Municipal Code. The location of the right-of-way is as shown on a map showing the right-of-way study area (Attachment 2 of Exhibit A) and more specifically in the legal description (Attachment 1 of Exhibit A). The area which makes up the right-of-way line is presently vacant and i~ owned by Alameda County and the U.S. Army. Alameda County will dedicate the portion of the Dublin Boulevard right-of-way east of Arnold Road. Alameda County will be able to construct the road west of Arnold Road (through Camp Parks) by a right of entry agreement with the U.S. Army. It is estimated that the costs for design and improvement of the road will be approximately $5.5 million. The proposed project would consist of a roadway with a minimum right-of-way of one hundred and forty-two (142) feet and a maximum right- of-way of one hundred and forty-eight (148) feet. The minimum paved section would be eighty-eight (88) feet and the maximum paved section would be one hundred thirteen (113) feet. The roadway would have six (6) lanes with additional left and right turn lanes as needed. The roadway and right-of-way would run from the eastern BART access drive to Hacienda Drive. The site area consists of relatively flat land lying north of the Eastern Dublin BART station. This roadway would be able to accommodate approximately 50,000 average daily trips. The proposed project will not have a significant effect on the environment. Recommendation On July 3, 1995, the Planning Commission reviewed the report and recommendation of the City Engineer regarding this proposal. Based on information presented in the report, the Planning Commission and the City Engineer believe that the proposed right-of-way line is appropriate and recommend that the City Council adopt a Resolution of Intention to establish the right-of-way line as shown on Attachments 1, 2, and 3, of Exhibit A. Furthermore, as shown in Exhibit A, it is recommended that the City Council, pursuant to sections 7.68.080 through 7.68.100, call a public hearing on August 8, 1995, to hear any protests or objections to the establishment of the proposed right-of-way. G:PA95-018/CCAGSTMT e e RESOLUTION NO. - 95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ADOPTING A RESOLUTION OF INTENTION TO ESTABLISH A RIGHT-OF-WAY LINE FOR DUBLIN BOULEVARD FROM THE EASTERN BART ACCESS DRIVE TO HACIENDA DRIVE RECITALS The City Council of the City of Dublin does resolve as follows: The Council has received a report and recommendation from the Planning Commission recommending the establishment of a right-of-way line for Dublin Boulevard from the eastern BART access drive to Hacienda Drive. It is the intention of the City Council to establish a right-of-way line for the abovesaid road. Pursuant to the provisions of Sections 7.68.080 through 7.68.100 of the Dublin Municipal Code, the City Council hereby calls a public hearing on August 8, 1995, at 7:00 p.m. in the City Council Chambers, 100 Civic Plaza, Dublin, California, to hear protests and objections to the establishment of the proposed right-of-way line hereinafter set forth: Dublin Boulevard from the eastern BART access drive to Hacienda Drive All that certain real property situated in the City of Dublin, County of Alameda, State of California, described on Attachment 1. A copy of this Resolution shall be posted in accordance with Section 7.68.070 of the Dublin Municipal Code at least ten (10) days before the date of the hearing. Any person having any interest in any land as described above upon which said right-of-way lines are proposed to be established may file a written objection with the City Clerk at any time no later than the hour set for hearing objections.
