Adopt resolution approving amendment to agreement RECOMMENDATION: FINANCIAL STATEMENT: The higher service levels approved by the City Council will add $47,070 to MCE's total estimate for Fiscal Year 1995-96. Sufficient funding has been included in the 1995-96 Adopted Budget. DESCRIPTION: On June 27th, the City Council approved an amendment to the City's agreement with MCE Corporation for Maintenance Services which incorporated the work program for the current service level for Fiscal Year 1995-96. Subsequently, on June 28th, the City Council adopted the 1995-96 Budget with higher service leVels which affected several of MCE's work categories as shown below: Budget Line Item 3020 Street Maintenance - Eastern Dublin 3040 Street Tree Maintenance - Eastern Dublin 3050 Street Landscape Maintenance, HSL I - Eastern Dublin Street Landscape Maintenance HSL II - Dougherty Road Berm Wildflowers Street Landscape Maintenance HSL III Replacement Plant Material 8013 Dublin Cemetery - Additional Tree Trimming 8020 Park Maintenance - Fountain Maintenance Total: Higher Service Level Cost (MCE Portion Only) $14,370 $650 $4,890 $2,300 $6,460 $3,OOO $15,400 $47,07O ITEM NO. ~~_ Copies to: Steven Loweree, MCE I GITY CLERK The higher service levels identified for Street Maintenance, Street Tree Maintenance, and Street Landscape Maintenance are related to improvements to be constructed in eastern Dublin. These improvements are primarily associated with the Homart development. In addition, two higher service levels were approved for the Street Landscape Maintenance budget. These were for wildflower seeding on the east side of Dougherty l~oad and for replacement of missing shrubs and an additional turf aeration. The higher service level for the Dublin Cemetery involves increased contract tree trimming £or 10 older trees. The tree trimming was recommended because of'the age of'the trees and their proximity to buildings and the creek. The higher service level in Park Maintenance represents the cost of maintenance associated with operating the two fountains at the Civic Center and the entry fountain at Shannon Park for tour hours per day, five days per week. RESOLUTION NO. -95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AMENDMENT TO AGREEMENT WITH MCE CORPORATION FOR PUBLIC WORKS MAJNTENANCE SERVICES WHEREAS, on June 14, 1993, the City Council approved an agreement with MCE Corporation for Public Works Maintenance Services; and . WHEREAS, said agreement provided a detailed scope of work and labor rates for Fiscal Year 1993-94; and WHEREAS, on December 13, 1993, June 21, 1994, August 22, 1994, and June 27, 1995, the City Council reviewed and approved amendments to the agreement; and WHEREAS, as part of the budget approval process for 1995-96, the City Council approved a higher level of service which affects MCE's Schedule of Work; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve the amendment to the agreement with MCE Corporation attached hereto as "Exhibit A," with an effective date of July 1, 1995. . BE IT FURTHER RESOLVED that the Mayor is authorized to execute the amendment. PASSED, APPROVED, AND ADOPTED this 8th day of August, 1995. WHEREAS, on June 14, 1993, the City of Dublin (hereinafter referred to as "CITY" and MCE Corporation (hereinafter referred to as "CONTRACTOR") entered into an agreement to provide Public Works Maintenance Services to CITY (hereinafter referred to as "AGREEMENT); and WHEREAS, on December 13, 1993, June 21, 1994, August 22, 1994, and June 27, 1995, the City Council approved amendments to Exhibit "B" of said Agreement, which provides for a specific schedule of work, including activities and rates to be charged; and WHEREAS, during the budget approval process for 1995-96, the City Council approved higher levels of service that affect the Schedule of Work for MCE Corporation; , NOW, THEREFORE, the parties hereto agree as follows: Section 1. Exhibit B, "Payment Schedule," of the Agreement shall be amended by replacing Attachment 1 in the current Agreement with Attachment 1 of this Amendment, said Attachment 1 being identified as "Exhibit B - Attachment 1 - Schedule of Work . . . Fiscal Year 1995-96 - August 8, 1995." . Section 2. Said revision in Exhibit B "Payment Schedule" shall be effective as of July 1, 1995.
