FINANCIAL STATEMENT: This bill will allow new Federal transportation
funding for California. Staff has applied for this
funding for the Dublin Boulevard Widening, two traffic
signals on Village Parkway, a cross-town
bike/pedestrian path, and a traffic signal at Sierra
Lane within the Dougherty Road Widening (Dublin
Boulevard to SPRR Right-of-Way) project.
DESCRIPTION: The new Federal 6-year ISTEA program has been passed
by the Federal legislature. Enabling legislation must be passed at the State level
in order for this program to be implemented in California. Senator Quentin Kopp has
introduced SB 1435 which will serve as the enabling legislation. The League of
California Cities, as well as various other local agencies, has helped to put this
bill together.
There is a side issue in this bill which has to do with the role that the California
Transportation Commission (CTC) will have in the process; however, Staff is
recommending that the City Council support the bill without getting into the CTC
debate.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
SUPPORTING SENATE BILL 1435
FEDERAL INTERMODAL SURFACE TRANSPORTATION
EFFICIENCY ACT (ISTEA)
WHEREAS, the new six-year Federal Highway/Transit Act has now become
law; and
WHEREAS, these Federal monies will again fund needed State and
Interstate highway work as well as transit facilities and major City and County
transportation projects once the Act has been implemented; and
WHEREAS, the Bay Area Congestion Management Agencies, Cities, Counties,
and Transit Operators have been working cooperatively with the League of California ,
Cities, CSAC, and the California Transit Association to develop a consensus bill to
implement the new Federal Intermodal Surface Transportation Efficiency Act (ISTEA)
legislation; and
WHEREAS, State Senator Quentin Kopp has introduced Senate Bill 1435
which will implement the new ISTEA legislation statewide;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Dublin does hereby support Senate Bill 1435 and directs the Mayor to send a letter
to Senator Quentin Kopp in support of Senate Bill 1435.

RE: SB 1435 (Kopp) Implementation of ISTEA
As most of you know;. we have been working cooperatively with the League,
CSAC and the California Transit Association to develop a consensus bill
to implement the new federal ISTEA legislation. That consensus bill ,
SB 1435 (Kopp) , is suppdr.ted by MTC and all of the above entities.. The
bill passed the Serrate (29-2) and passed the Assembly Transportation
Committee (15-0) .
Upon passage of SB 1435, MTC will be able to allocate flexible .ISTEA
funds. We have received applications from throughout the Bay Area and
will adopt a TIP before September 30, 1992 programming these funds. If
ISTEA fails to pass, delivery of these funds will be delayed and possibly
prevented.
Caltrans has been instructed by the Gove'rnor' s office to .seek specific
amendments related to the role of the CTC and the Administration in the
state plan, the CTC role in HSOPP and the CTC' s role in adopting TSM
guidelines. They are lobbying local government interests to support
their position. We do not believe it appropriate to get involved in this
debate between the legislature and adminisration;. and would urge you to
merely express the urgency behind the passage of SB 1435.
Attached please find a sample letter which urges support for the bill and
resolution of the outstanding issues. We urge you to send it to Senator
Kopp, to Assembly Ways and Means Committee Chair John Vasconcellos, and
to the Governor.

SUBJECT: Senate Bill 1435
Dear Senator Kopp:
The City Council of the City of Dublin supports your bill SB 1435, which implements
the Federal ISTEA legislation. Passage of Senate Bill 1435 is essential this year,
both in order to resolve inconsistencies between State Law and the new Federal Law
and to prevent the delay of projects ready for construction with these funds.
We would also like to note that the ISTEA law provides for approval of the State
plan by the Governor. We believe that SB 1435 should reflect this requirement,
along with ensuring legislative oversight of policy matters, but the plan should be
primarily based upon regional plans with the State plan serving in a coordinating
role. Oversight of the HSOPP program by the CTC has in the past served as a forum
for the regional agencies to raise concerns with the Caltrans program.
Again, we would like to stress that we feel that enactment of SB 1435 is urgent and
essential. We hope that the legislature and the administration can resolve their
differences so that funds can be put to work.
