Thompson, Public Works Director EXHIBITS ATTACHED: Resolution directing Staff to prepare the Engineer's Annual Report for Landscaping and Lighting Maintenance Assessment District 83-2. RECOMMENDATION: Adopt resolution FINANCIAL STATEMENT: The cost to prepare the Engineer's Report is approximately $700. This amount is budgeted in the Engineering and Public Works Operating Budgets and is paid by the Assessment District. DESCRIPTION: As part of the review and approval of the 150-unit single-family . Dublin Hills Estates development and the Amador Lakes development, certain landscaping maintenance was made a condition of approval. This maintenance assessment district provides the funds for this work. The District's boundaries include all of Tract 4719. The District maintains all of the Stagecoach Road landscaping and the "interior slope" landscaping within Tract 4719. In 1989, the City Council deleted Stagecoach Park from this assessment district, and the City now bears the cost of maintaining this small park. This resolution authorizes the City Engineer to begin preparation of the required Engineer's Report for the Assessment District for FY 1997-98. The procedure for establishing annual maintenance assessments requires that the City Council first authorize preparation of the report. The preliminary report is then brought back to the City Council for approval later in the year. Following the City Council's approval of the report, a public hearing will be scheduled as required. At the February 4th meeting, the City Council received a report regarding the requirements of Proposition 218, and it was determined that this landscape maintenance assessment would be frozen for the 1997-98 fiscal year. Staff recommends that the City Council adopt the resolution. COPIES TO: ITEM NO. 140 g:\assessdist\83-2\agstl RESOLUTION NO. -97 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN DIRECTING PREPARATION OF ANNUAL REPORT FOR LANDSCAPING AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT 83-2 WHEREAS, on January 23, 1984, by its Resolution No. 11-84, this City Council initiated proceedings, and by Resolution No. 10-84, ordered the formation of City of Dublin Landscaping and Lighting Maintenance Assessment District No. 83-2, ("the District") pursuant to the provisions of the Landscaping and Lighting Act of 1972 (commencing at Section 22500 of the California Streets and Highways Code) (hereinafter, "the Act"); and WHEREAS, Sections 22620 et seq of the Act provide for the levy of annual assessments after formation of the District; and WHEREAS, within said District, the existing and proposed improvements and any substantial changes proposed to be made to the existing improvements are generally described on Exhibit A attached hereto and hereby made a part hereof; NOW, THEREFORE, BE IT RESOLVED that the Dublin City Council does hereby designate the Dublin City Engineer as Engineer for purposes of preparing and filing with the Clerk a written report in accordance with Section 22565 et seq of the Act; said Engineer is hereby directed to apportion said assessments in accordance to the benefits received from said improvements by the lots, pieces and parcels of land within the District, and said Engineer is hereby directed to accomplish such preparation and filing forthwith. PASSED, APPROVED AND ADOPTED this 4th day of March, 1997 AYES: NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk g:lassessdist183-21resol f` 8 EXHIBIT A SCOPE OF WORK The scope of work shall be the maintenance of landscaping and irrigation within the road right-of-way and within a public easement along Stagecoach Road between the limits of Amador Valley Boulevard and the northerly City Limit. Further, the scope of work shall include the maintenance of the slopes and landscaping and irrigation of the slopes within a public easement for those slope areas to the rear of Lots 80 through 86 and 37 through 48, all within Tract 4719.
