(Report Prepared By: Jeri Ram, Associate Planne' RECOMMENDATION: Receive Report FINANCIAL STATEMENT: No financial impact DESCRIPTION: A report on the status of a work program to implement the City Council direction relating to compliance with City Regulations regarding Temporary Promotional Signs (Banners,Pennants and Decorative Flags) Summary: Fifty-six percent of the businesses (west of and including the Village Parkway area) identified in the survey in September as having illegal temporary promotional signs have now complied with City regulations. Background: The City Council at their meeting of August 13, 1996, directed staff to begin proactively, enforcing the City's Sign Ordinance regulations regarding Temporary Promotional Signs (Banners, Pennants and Decorative Flags) in a sensitive manner. Staff developed a work program that included as its overall goal: "Reduce the number of illegal Temporary Promotional Signs (Banners, Pennants, and Decorative Flags) in the City of Dublin, in a sensitive manner that encourages voluntary compliance and promotes a positive relationship with the business community." On September 9, 1996, staff took a photo inventory of the commercial and industrial areas of the City to document the number of businesses with illegal temporary promotional signs (those without valid permits). At that time, 104 businesses were documented as non-complying. On October 15, 1996, staff presented a staff report to the City Council with an outline of the work program for the "Banner Compliance Program." As of that date, staff had completed the photo inventory, designed and distributed special handouts, and met with the press and the Chamber of Commerce. January, 1997, Update: The City has been divided into six geographic areas and on a staggered basis beginning in October, 1996, the following process has been followed by staff: 1. Send businesses not in compliance an educational letter; 2. Personally visit the business if the educational letter does not result in compliance; 3. Send a warning letter if the educational letter and personal visit does not result in compliance; 4. Send a warning notice if the warning letter does not result in compliance; and 5. Issue a citation if items 1 through 4 are not successful. The City was broken down into the following geographic areas: • Area One: Generally along San Ramon Rd. • Area Two: Generally north of Dublin Blvd. from San Ramon Rd. to I-680. • Area Three: Generally south of Dublin Blvd. from San Ramon Rd. to I-680. • Area Four: Generally along Village Parkway. • Area Five: Generally north of Dublin Blvd. east of Village Parkway to Dougherty Rd. and Sierra Ln. • Area Six: Generally along the Dublin Ct. area and north and south of Dublin Blvd. along Dougherty Rd. The compliance program was undertaken on a staggered schedule, we are still in the early process with Areas 5 and 6. For example, businesses in the last area of the City, Area 6,just received the educational letter(the first step in the process)the first week of January, 1997. Therefore, the success in those areas is difficult to report on at this point in the process. In Areas 1 through 4 we have a 64 percent success rate. It is anticipated that as time goes on, we will have a similar success rate in all Areas of the City. See the chart below. Area 1 13 11 2 Area 32 _ 21 Area 3 10 4 . 6 . Driving down San Ramon Road (Area 1), one can see the difference. Before the program there were 13 businesses with illegal banner signs, now there are 2. Also, along Village Parkway (Area 4), an area that was identified as a major problem,the incidence of illegal banner signs is way down. Out of the 21 businesses identified as having illegal banner signs, only 8 remain. Staff continues to have problems along Dublin Boulevard. However, it is anticipated that many of the problems were related to holiday advertising. By February,these areas should be greatly reduced. Staff will complete the compliance portion of the Program in the next two months. At that time we will report- to the City Council on the success of the entire program. G:\codecomp\banners\ccsr2 2
