Thomas Resolution establishing surplus property Location Map Adopt resolution establishing surplus property and authorize Staff to begin process for sale of excess right-of-way FINANCIAL STATEMENT: None at this time. A proposed purchase price will be submitted to the City Council for approval at a later date. DESCRIPTION: Steven P. Thomas, of Thomas Properties, representing the owner of the old "76" station site at the northwest comer of Dublin Boulevard and San Ramon Road, has submitted a request to purchase excess City right-of-way along San Ramon Road at the front of the property. The location of the excess right-of-way is shown on the location map, Exhibit 3. This transaction would be similar to those conducted previously with Arbor Creek, the Fishery, Public Storage, and Stroud's Plaza. Section 54222 of the Government Code requires that the City offer this property to any housing authorities, redevelopment agencies, local park and recreation departments, and the State Resources Agency, prior to committing to sell to a private party. If the property is declared to be surplus and Staff is authorized to enter into negotiations with Mr. Thomas for sale of the property, these agencies will be notified in writing and will have 60 days to respond. If all agencies decline to purchase the property or have not responded within 60 days, a resolution of intent to sell may be adopted, and a public hearing may subsequently be held for final action (Government Code Sections 37421 et. seq.). A use permit, site development review, and variance would be processed for the site prior to this . purchase and would be conditioned upon purchase of the excess property and upon Mr. Thomas' purchasing the '76 station property. This property is not needed by the City for roadway purposes. RESOLUTION NO. -94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ESTABLISHING SURPLUS PROPERTY AND DIRECTING STAFF TO NOTIFY APPROPRIATE AGENCIES WHEREAS, Thomas Properties has requested that the City enter into negotiations to sell approximately 5,200 square feet of City property adjacent to the northwest comer of San Ramon Road and Dublin Boulevard in conjunction with further development of property at that location; and WHEREAS, the City Council has authorized Staff to enter into negotiations for the sale of City property; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin finds that approximately 5,200 square feet of vacant right-of-way at the northwest comer of San Ramon Road and Dublin Boulevard as illustrated in the attached Exhibit A is surplus land and determined to be no longer necessary for the City's use. BE IT FURTHER RESOLVED that the City Council directs Staff to notify the appropriate agencies of the City's offer to sell the property. PASSED, APPROVED, AND ADOPTED this 3rd day of October, 1994.
