Thompson, Public Works Director ATTACHMENTS: 1) Letter from Kier and Wright 2) Resolution, with Plat and Description RECOMMENDATION: opt resolution FINANCIAL STATEMENT: No cost associated with this action. DESCRIPTION: The southeast corner of the Best Buy building is encroaching approximately 5-1/2 feet into a 10-foot-wide public service easement (P.S.E.). The area of the P.S.E. affected is approximately 111 square feet. This P. S.E. was offered for dedication to the public as a part of Parcel Map 7223 and was accepted by the City Council on February 10, 1998. There are no utilities installed within this easement, nor is it anticipated that utilities will be installed here in the future. Therefore, under the provisions of Streets and Highways Code Chapter 4, this P.S.E. may be abandoned by summary vacation. Staff recommends that the City Council adopt the resolution summarily vacating this portion of the Public Service Easement. The southeast comer of the building foundation is encroaching approximately 5.5 feet into a 10 foot wide public service easement (p.s.e). (see attached sketch) 2. Said 10'foot wide p.s.e, was offered for dedication to the public and accepted on behalf of the public by the city council of the city of Dublin on m~d by Parcel Map 7223, filed on February 10, 1998 in book 234 of_parcel maps at page 45, official records of Alameda county. 3. There were never any pUblic utilities located within the affected p.s.e. 4. There are not now any public utilities located within the affected p.s.e. 5. There are no public utilities anticipated that will need to be located within the affected p.s.e, in the future. BE IT FURTHER RESOLVED that the City Clerk is directed to submit a certified copy of this ~ Resolution to the County Recorder for recording.
