HomeMy WebLinkAbout4.02 DevAgmt Review CITY CLERK FILE # 600-60 AGENDA STATEMENT CITY COUNCIL MEETING DATE: September 21, 1999 SUBJECT: Annual Review of Nine Development Agreements: Santa Rita Commercial Center Opus - Creekside Business Park California Creekside Hansen Ranch Villa's at Santa Rita Summerglen Jefferson at Dublin Emerald Pointe Casterson Property (Report Prepared by Eddie Peabody Jr., Community Development Department ) ATTACHMENTS: None (copies of the Development Ageements are available for review in the Community Development Department) / RECOMMENDATION: By motion, find that developers have complied in good faith with J/the terms and provisions of the following Development AEreements · .~,'~' and conclude the Annual Review Period: Santa Rita Com;~ercial Center; Opus - Creekside Business Park; California O'eekside,' Hansen Ranch,' -Villa's at Santa Rita; Summerglen; Jefferson at Dublin; Emerald Pointe and Casterson Property FINANCIAL STATEMENT: The fiscal impacts of these projects were addressed as part of a fiscal analysis performed for the approved projects. BACKGROUND: The Annual Review of Developmeni Agreements is required by State law and Chapter 8.56 of the City' s Municipal Code. Daring the review period the City Council has the oppommity to review the compliance of the parties of the Agreement and either determine the parties are in compliance and conclude the review; or, if the City Council determines that parties have not complied in good faith, the City Council may modify or terminate the A~eement. The burden of proof of good faith compliance is on the developer. COPIES TO: :Alameda Count), Surplus Prop. Opus West K& B Warmington Homes JPI Mission Peak Homes ITEM NO. The Development Ag-reements have been reviewed by the various City Departments, and commen~.'wii~ returned to the Community Development Director. Many of the larger improvements are either bonded or scheduled to be completed as the projects proceed. Staff has concluded that the developers for these 9 projects are proceeding in good faith with the terms of the Development Agreements. If any Council member has concerns about the compliance of a particular developer, that Development A~eement will be set for a public hearing at the next City Council meeting. The following Development Agreements are due for annual review at this time: Santa Rita Commercial Center formally known at Homart, now known as Hacienda Crossings Commercial Center) ~ In compliance - This project is well underway, although not yet complete. There has been no indication from either Alameda County or Opus West of any problems regarding future compliance with the Agreement. Opus - O-eekside Business Park (known as Humphrey Systems) - In compliance - This project is complete, except for minor landscape issues. California Creekside - In compliance - This project is almost complete. The houses have been completed and occupied; however, the City is holding bonds to assure the successful completion of the remaining items to be done. Kaufrnan & Broad has been working' to complete the landscaping and bardscape improvements along Dublin Boulevard and Central Parkway. The landscaping has been completed, but much work is still to be done to repair sagging soundwalls, place lamps, repair paving and curbs, repair a metal gate at the end of Pheasant Court and other minor issues. Staff is confident these items will be completed to the City's satisfaction. Hansen Ranch - In compliance - Warminion Homes is working with City staff to resolve some wildfire buffer issues relative to landscaping palette and maintenance and also required improvements to Martin Canyon Creek. The improvements to Martin Canyon Creek will be made this summer/fall. The City is holding 24 building permits until the improvements to Martin Canyon Creek are completed and once the Creek improvements are made, the City will release the remaining 24 building permits. Warminion Homes is revising the landscape plans and will submit an agreement to the City to assure that the fire buffers are properly maintained. Villas at Santa d~ita - In compliance - There has been no indication from Alameda County of any problems regarding future compliance with the Ageement. Summerglen - In complia~ce - Units are being completed at this time. Improvements required under the 'Development A~eement are being constructed currently. The recreation center and landscape improvements required by the Development A~eement will be constructed in the near future. There has been no indication from Alameda County of any problems regarding future compliance with the Agreement. Jefferson at Dublin - In compliance - This project is near completion. There has been no indication from either Alameda County or JPI of any problems regarding future compliance with the A~eement. Emerald Pointe - In compliance - This project is well underway. There has been no indication from either Alameda County or Opus West of any problems regarding future compliance with the Ageement. Casterson Property (Tinown as Tassajara Meadows I) - In compliance - Four model homes are currently under construction and expected to be open by mid September. There has been no indication from Mission Peak Homes of any problems regarding future compliance with the A~eement. Co~hclusion: Staff has determined that the Developers for the above mentioned Development Agreements have complied in good faith with the terms and conditions of the Develo ~ment Agreements during the past year. RECOMMENDATION: Staff recommends that the City Council, by motion, make a determination that the developers of the nine (9) Development Agreements Santa Rita Commercial Center; Opus - O'eekside Business t'ark; California Creekside; Hansen Ranch; Villa's at Santa Rita; Summerglen; Jef-Jkrson at Dublin; Emerald Pointe and Casterson Property have complied in good faith with the terms and conditions of the Agreements during the past year and conclude the period of review.
