FINANCIAL STATEMENT: Claim is in the amount of $300,000
DESCRIPTION : Daniel J. Reyes, 7690 Ironwood Drive, Dublin, has filed a claim
against the City in the amount of $300,000 alleging false arrest
and injury by Dublin Police.

It is Staff's recommendation that the City Council deny the
claim and notify both the claimant and the City's insurance
carrier.

2 TO: THE CITY OF DUBLIN AND TO THE COUNTY OF ALAMEDA
3 1 . The claimant ' s name and address are:

9 3. The date, place and other circumstances of the occurence
10 that gives rise to this claim are as follows:
11 On or about September 5, 1982, at or about 3: 30 a .m. , at or
12 near the Jack-In-The-Box restaurant located near the intersection
13 of Village Parkway and Amador Valley Blvd. , Dublin, California,
14 officers of the Alameda County Sheriff ' s Department presently
15 under contract to the City of Dublin, California, did wilfully,
16 wantonly and falsely arrest and imprison claimant. Claimant was
17 falsely incarcerated in the City of Dublin jail facility in Dublin,
18 California for approximately five (5) hours against his will and
19 permission, and was thereafter charged with violations of the
20 California Penal Code, all without good cause and as a result of
21 unreasonable conduct on the part of the arresting officers . During
22 the course of said wilful, wanton and false arrest and imprisonment
23 of claimant, said officers did injure claimant as follows :
24 Claimant was injured about his wrists, neck and back and
25 sustained injury to his nervous system and person, all of which
26 said injuries have caused claimant to suffer extreme and severe
27 physical pain and mental suffering and anguish, and, claimant will
28 continue to suffer such physical and mental pain and anguish.

1 4 . The officers above referred to, who are known to claimant
2 are Officers A. Hoelscher and Officer Preston.
3 5. So far as it is known to claimant at the date of the
4 filing of this claim, claimant has incurred damages and expenses
5 in an amount which is unascertained.
$ 6 6. Claimant is claiming as of the date of presentment of thi -
7 claim the sum of $300, 000.00 which includes the estimated amount
8 of prospective damages.
9 7 . The basis of computations of the claim is as follows:
10 a. Medical bills to date which have not been ascertained
11 b. Future medical bills which have not yet been aseer-
12 tained.
13 c . General damages which inclued claimant ' s pain, suffer
14 ing, anguish and great humiliation.
