An urgency Ordinance would have to be introduced and adopted by the Council on January 9, 1995. 2) If interviews are not completed on December 27, continue this item to December 28, 1994. RECOMMENDATION: FINANCIAL STATEMENT: None at this time. DESCRIPTION: On November 28, 1994, the City Council directed Staff to place ads in local newspapers inviting interested residents of Dublin to apply for the opening on the City Council created as a result of Guy Houston being elected Mayor midway through his 4-year Council term of office. As a result of the ads, a total of 22 individuals requested applications and 14 applications were returned to the City Clerk by the December 22nd deadline. All of the applicants were individually notified that the Council would be conducting interviews beginning at 6:30 p.m., on Tuesday, December 27th and that the meeting would be continued to December 28th if necessary . The City Attorney's Memorandum clarifies the procedure for appointment of a Councilmember to fill the vacancy. L AGENDA STATEMENT - Council Appointment PAGE 2 At the City Council meeting on December 12, 1994, the consensus of the Council was to conduct interviews on a random selection basis. Therefore, the names will be drawn from an envelope by the City Clerk. If an applicant receives a majority vote of the Council, the Council should detennine when the new Councilmember should be sworn in and seated If no applicant receives a majority vote, Staff should be directed to proceed with the preparation of the necessary documents to call a special election on June 6, 1995. The 30-day period that the Council has to make an appointment will expire on January II, 1995, so this documentation could be presented to the Council at its regular meeting on January 9, 1995. Staff estimates that special election costs would be approximately $10,000. If any other local agency within Dublin places issues on the June ballot, costs would be shared and this amount would be reduced somewhat. ~ An additional option would be for the Council to fill the vacancy on a temporary basis only until a newly elected Councilmember is sworn in and seated on the Council. A Councilmember elected on June 6, 1995 would likely be seated at the first meeting in July, 1995. A temporary appointment could be accomplished through the adoption of an urgency Ordinance which could be prepared and brought to the Council at its next meeting for introduction and adoption. Silver City Attorney RE: Procedure for Appointment of Councilmember to Fill Vacancy A vacancy exists on the Council due to the election of Councilmember Houston as Mayor. One option available to the Council is to appoint a person to fill the vacancy. The purpose of this memorandum is to address the procedure for selection of a person to fill the vacancy if the Council determines to appoint a person to fill the vacancy rather than the other options available to the Council. The Brown Act prohibits any action by secret ballot (Government Code ~ 54953, subd. (c)). The City's Rules of Conduct for Council meetings (Resolution No. 28-94) provide that meetings shall be conducted pursuant to Robert's Rules of Order. Generally, the following procedure for selection of a person to fill the vacancy appears to be consistent with provisions of Robert's Rules of Order and the Brown Act. However, because Robert's Rules of Order are not completely clear, the Council may, if it wishes, agree in advance to. a different method of selecting a person to fill the vacancy. Council members would make nominations. Nominations would not need to be seconded. More than one person could be nominated. Nominations would continue for a reasonable period of time until a motion to close nominations is made. Once TO: FROM: RE: City Council Elizabeth H. Assuming that all four Council members are present and vote, three affirmative votes will be required to appoint a person to the vacancy. If two vote in favor of an individual and two vote against the individual, that person has not received sufficient votes to be selected. However, if two vote in favor of a particular individual, one votes against and one abstains (for reasons unrelated to a conflict of interest), the individual would have received sufficient votes to be selected. (Drv Creek Valley Assn., Inc., v. Board of Supervisors (1977) 67 Cal.App.3d 839, 135 Cal.Rptr. 726.) Similarly, if two vote in favor of a particular individual and two Council members abstain, the individual would have received sufficient votes to be selected. (Martin v. Ballenqer (1938) 25 Cal.App.2d 435, 77 P.2d 888i 62 Ops,Atty.Gen. 698 (1979).) The reason for the foregoing is that the basic parliamentary rule is that where a quorum is present, the direct approval of more than half of those members actually votinq for or against the measure becomes the act or choice of the body. (62 Ops.Atty.Gen. 698, 700.) Only those votes that are for or against the measure are counted. "Those members who wish to remain neutral thus acquiesce in the action taken by the majority of those who vote affirmatively or negatively." (Id.) I understand what it means to meet a payroll, hire, evaluate, fire, pay rent, mortgages, payroll taxes as well as conduct the operations of a personal insurance business to the people I serve. If I were ranked among the 18,000 State Farm Agents, I would be in the top 10%. One of my strongest attributes is the ability to listen to others before I talk. I have an open mind and like to hear all side of an issue. I get along with people and look for areas of common ground to solve problems. I am an organizer, communicator and a people person. I moved to the valley in 1968 and have observed the growth, the improvements and the problems that have occurred since. I have children that grew up in Dublin, went through the school system and now are adults with children. I know how important the safety services, education, recreation, shopping and business services are to the citizen. I not only am buying my home in Dublin, I am also buying my commercial office building and I also own a rental home as well. I have a lot invested in this city and understand the importance of keeping our city safe and attractive. I served on the Board of Directors of the Silvergate HigWands Homeowners Association where I was elected President of the 258 homeowners. I handled the problems and complaints that are generated in this type of position. I am a Past president of the Dublin Chamber of Commerce. While a member of the Board of Directors, I also acted as treasurer and understand the importance of fiscal responsibility. - . I have been elected four times as President of the Dublin Sister City Association and was the leader in the formation of the association. I understand the importance of promoting our city within the valley, within the country and internationally. I am presently working on a project to promote our city within the U.S.A. with the added hope of involving more citizens of Dublin in the D.S.C.A. I am not presently involved in a service club but I was a charter member of the Livermore Amador Valley Exchange Club. I was elected president and formed and chaired the youth Search for Talent for 6 years. I resigned in good standing after 18 years of membership due to other commitments. I believe I still hold the recruiting record of over 25 members brought into the club. This demonstrates my ability to communicate to the individual. I am an ordained elder in the Presbyterian Church. I currently sing in the choir and have done so for approximately 15 years. This activity is very important to me. I feel we don't have total control of what happens and that we are dependent on a source other than ourselves. My most recent service to the city of Dublin was chairing the Dublin Business Development Task Force January through July of94. I reported our findings and recommendations to the City Council on July II, 94 along with other members of the task force. It is my belief that we should set policy for the new Economic Development Director to place an emphasis on attracting employers of skilled workers equal to the emphasis on attracting sales tax generators. I recently completed a certificate program in Land Use and Environmental Planning at UC Davis which contained a strong public finance component. Combined with my ten years experience in local issues, this training provides me with the ability to accurately assess economic and financial impacts of new development. I recently moved to Dublin from Richmond. I bring fresh ideas and experience in creating and implementing policy to the city. As a Human Resources professional, I develop and implement policy on a daily basis. ~am an experienced policy maker who listens to all sides of a debate and makes a decision. I do not know all of the specific challenges that Dublin faces because I am new to the community. I have been successful at implementing policy in the ORGANIZATIONS I have worked. Specifically, I always solicit comments and hold focus groups. This process yields the relevant arguments, experiences, practices and history that shapes our expectations. I have demonstrated that the way to implement change is~o change ones expectation through increased communications. I am the youngest member elected to the Northern California Human Resources Council Board of Directors. Ranging from manager or coach in Dublin Youth Soccer, Dublin Little League, Dublin Youth Basketball, CYO Basketball to treasurer of the Dublin Boosters Club and Auditor for the Nielsen PTA. My service to the City of Dublin began 12 years ago as Chairman of the Parks and Recreation Advisory Committee where we recommended that a permanent Parks and Recreation Commission be established. After some lively debate our suggestion was adopted. From 1983 through 1987 I served as Chairman and member of the Dublin Parks and Recreation Commission. During that period we redesigned all the parks in Dublin and began as aggressive program to rebuild Dublin's parks and establish a recreation program. For the last seven years I have been serving as a member or chairman of the Dublin Planning Commission where we held extensive hearings on both West and East Dublin expansions. We recommended City Council approve both plans. The East Dublin plan will help Dublin grow into a more competitive position in the valley and significantly increase our tax base.
