The Governor’s Executive Order N-08-21 (June 11, 2021) has extended this provision regarding the conduct of public meetings through September 30, 2021. The City of Dublin will adopt the following practices during upcoming City Council meeting: • Per normal practice, the meeting will be livestreamed and available at www.tv28live.org for viewing and also broadcast live on Comcast T.V. channel 28 beginning at 7:00 p.m. This meeting will also be available on the City’s website: https://dublin.ca.gov/1604/Meetings- Agendas-Minutes-Video-on-Demand • To maximize public safety while maintaining transparency and public access, members of the public may participate in one of the following ways: o Virtual Platform (Zoom): • If you wish to speak via Zoom during the meeting, please fill out the online speaker slip available at www.dublin.ca.gov. The speaker slip will be made available at 10:00 a.m. on Tuesday, July 20, 2021. Upon submission, you will receive Zoom link information. Speakers slips will be accepted until the staff presentation on an agenda item ends, or until the public comment period on non-agenda items is closed. • Once connected, the public speaker will be connected to the Zoom webinar as an attendee and muted. The speaker will be able to see the meeting from inside Zoom. • When the agenda item upon which the individual would like to comment is addressed, the speaker will be announced in the meeting when it is his/her time to speak to the City Council. The speaker will then be unmuted for comment. Conference with Legal Counsel—Anticipated Litigation Initiation of Litigation Pursuant to Paragraph (4) of Subdivision (d) of Section 54956.9: 1 case Regular Meeting 7:00 PM 1. CALL TO ORDER AND PLEDGE OF ALLEGIANCE 2. REPORT ON CLOSED SESSION 3. ORAL COMMUNICATIONS 3.1 Receive a Presentation from Tracy Farhad, CEO of Visit Tri-Valley on the "To Dublin With Love" and "To Tri-Valley With Love" Local Recovery Campaigns The City Council will receive a presentation on the “To Dublin with Love” and “To Tri-Valley with Love” local recovery campaigns from Visit Tri-Valley CEO, Tracy Farhad. STAFF RECOMMENDATION: Receive the presentation. 3.2 Acceptance of Donation from the McCreary Family Foundation and Recognition of Paul McCreary The City Council will accept a donation in the amount of $50,000 from the McCreary Family Foundation to be used as an endowment fund to assist Dublin youth with financial challenges in joining the Dublin Green Gators Swim Team. The City Council will also consider providing direction to Staff to formally recognize Paul McCreary for his service to the community. STAFF RECOMMENDATION: Formally accept the donation of $50,000, recognize the McCreary Family Foundation for their generosity, and provide direction to Staff on further recognition of Paul McCreary for his service to the community. 3.3 Preview of Splatter The City Council will receive a presentation that previews Splatter, taking place September 18, 2021 at Emerald Glen Park. STAFF RECOMMENDATION: Receive the presentation and provide feedback on this year's Splatter event. 3.4 Employee Introductions July 20, 2021 Dublin City Council Regular Meeting Agenda 3 New City of Dublin interns, Raymond He with Public Works and Jerry Liang with Information Services, will be introduced. STAFF RECOMMENDATION: Welcome the City of Dublin interns. 3.5 Public Comment At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Co uncil agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Approval of the June 15, 2021 Regular City Council Meeting Minutes and June 29, 2021 Special City Council Meeting Minutes The City Council will consider approval of the minutes of the June 15, 2021 Regular City Council Meeting and June 29, 2021 Special City Council Meeting. STAFF RECOMMENDATION: Approve the minutes of the June 15, 2021 Regular City Council Meeting and June 29, 2021 Special City Council Meeting. 4.2 Agreement with Bay Island Officials Association for Sports Officiating Services The City Council will consider a service agreement with Bay Island Officials Association to provide officiating services for adult basketball and softball leagues and for youth basketball leagues. STAFF RECOMMENDATION: Adopt the Resolution Approving an Agreement with Bay Island Officials Association for Sports Officiating Services. 4.3 Informational Report on the Human Rights Campaign Municipal Equality Index The City Council will receive a report on the Human Rights Campaign (HRC) Municipal Equality Index (MEI). The HRC MEI “helps residents learn how inclusive their city’s laws and policies are of LGBTQ people” by conducting a nationwide evaluation and compilation of laws and policies enacted by cities, counties, and states. This information is then scored out of 100 points, which quantifies the level to which a City maintains LGBTQ inclusive laws and policies. The City received a score of 84 out of 100 in the 2020 MEI. STAFF RECOMMENDATION: Receive the report. 4.4 Appointments to the City Council 2021 Ad-Hoc Audit Review Committee The City’s independent auditor, Badawi and Associates, has commenced the field work necessary to complete the Comprehensive Annual Financial Report for year ending June 30, 2021. The City Council will consider the establishment of an Ad-Hoc Committee, comprising July 20, 2021 Dublin City Council Regular Meeting Agenda 4 two City Councilmembers, who will review the audit process and final report with the auditors. STAFF RECOMMENDATION: Confirm the Mayor’s recommendation of Mayor Hernandez and Councilmember McCorriston as the 2021 Ad-Hoc Audit Review Committee. 4.5 Agreement with All City Management Services The City Council will consider an agreement for crossing guard services with All City Management Services. STAFF RECOMMENDATION: Adopt the Resolution Approving the Agreement with All City Management Services, Inc. for the Provision of Crossing Guard Services for Fiscal Year 2021-22. 4.6 Semi-Public Sites and Emerald High School Site Planned Development Zoning Amendment (PLPA-2020-00054) The City Council will consider a City-initiated Planned Development Zoning Amendment for three sites, including 2.5 acres on the GH PacVest property and 2.0 acres on the East Ranch property, as well as the 23.46-acre future Emerald High School site. These sites were the subject of a General Plan and Eastern Dublin Specific Plan Amendment approved by the City Council on June 15, 2021. The proposed project includes amending the existing Planned Development Zoning to provide consistency with the General Plan and EDSP as amended. The first reading of the Ordinance approving the Planned Development Zoning Amendment was held at the June 15, 2021 Regular City Council Meeting. The City Council is now being asked to waive the second reading and adopt the Ordinance. STAFF RECOMMENDATION: Waive the second reading and adopt the Ordinance Approving Amendments to the Planned Development Zoning Stage 1 Development Plans for 2.5 Acres on the GH PacVest Property and 2.0 Acres on the East Ranch property in Fallon Village, and the Emerald High School Site in Dublin Ranch. 4.7 Reducing the Speed Limit on Segments of Arnold Road and Tassajara Road The City Council will consider adopting the ordinance to reduce the speed limits on Arnold Road between Dublin Boulevard and Gleason Drive from 40 to 35 miles per hour (mph) and on Tassajara Road between Dublin Boulevard and Gleason Drive and between Fallon Road and the northern City Limit from 45 to 40 mph. The first reading of the Ordinance was held at the June 15, 2021 Regular City Council Meeting. The City Council is now being asked to waive the second reading and adopt the Ordinance. STAFF RECOMMENDATION: Waive the second reading and adopt the Ordinance Amending the Dublin Traffic Code to Reduce the Speed Limits on Segments of Arnold Road and Tassajara Road. 4.8 Agreement with Wesco Graphics, Inc., for Printing and Distribution Services The City Council will consider the approval of a two-year agreement with Wesco Graphics, Inc., for the printing and distribution of the City's newsletters and activity guides. STAFF RECOMMENDATION: Adopt the Resolution Approving the Two-Year Agreement with Wesco Graphics, Inc., and Authorizing the City Manager to Procure Services in Excess of $45,000. 4.9 Accept Quit Claim of Easement and Grant of Easement to DSRSD for Water Line on the Maintenance Corporation Yard Property July 20, 2021 Dublin City Council Regular Meeting Agenda 5 The City Council will consider accepting a quit claim of easement over the location of a former water line and granting a new easement over the new location of the water line on the City of Dublin Maintenance Corporation Yard property at 5777 Scarlett Court, Assessor’s Parcel No. 941-550-77-1. STAFF RECOMMENDATION: Adopt the Resolution Accepting Quit Claim of Easement from DSRSD and Granting Easement to DSRSD for Water Line Purposes Over a Portion of Assessor Parcel Number 941-550-77-1. 4.10 Second Amendment to the Community Benefit Program Agreement for the Cambria Hotel Project The City Council will consider approving a Second Amendment to the Community Benefit Program Agreement with VP-RPG Dublin, LLC for the Cambria Hotel Project that includes a 90,700-square-foot, 138-room, four-story hotel on an approximately 76,000-square-foot parcel located at 7944-7950 Dublin Boulevard. The Amendment includes language that allows the Developer to design, construct and install the Downtown Monument Sign prior to the Project submitting for building permit and to seek reimbursement for the work. STAFF RECOMMENDATION: Adopt the Resolution Approving a Second Amendment to the City of Dublin Community Benefit Program Agreement between the City of Dublin and VP-RPG Dublin, LLC. 4.11 City Proclamations for the Month of August The City Council will consider the following proclamations for the month of August in the City of Dublin: National Night Out and American Muslim Appreciation and Awareness Month. STAFF RECOMMENDATION: Approve the proclamations. 4.12 Actions Taken During Council Recess - Annual Street Resurfacing Project (2021 Slurry Seal) The City Council will receive a report on the administrative action taken during the City Council recess between June 15, 2021 and July 20, 2021 of awarding a construction contract for the Annual Street Resurfacing Project (2021 Slurry Seal), CIP No. ST0117. STAFF RECOMMENDATION: Receive the report. 4.13 Tract 8437 Ashton – Final Map Notice The City Council will receive a notification of the City Engineer’s pending approval of the Final Map for Tract 8437, Ashton. STAFF RECOMMENDATION: Receive the notification. 4.14 Payment Issuance Report and Electronic Funds Transfers The City Council will receive a listing of payments issued from June 1, 2021 - June 30, 2021 totaling $9,300,813.98. STAFF RECOMMENDATION: Receive the report. 4.15 Agreements for On-Call Financial Consultants The City Council will consider approving on-call agreements with Fieldman, Rolapp & Associates and Goodwin Consulting Group, for financial consulting services. STAFF RECOMMENDATION: July 20, 2021 Dublin City Council Regular Meeting Agenda 6 Adopt the Resolution Approving Agreements for On-Call Financial Consulting Services with Fieldman, Rolapp & Associates and Goodwin Consulting Group. 4.16 Amendment to Legal Services Agreement and Appointment of Jordyn Bishop as Assistant City Attorney Meyers Nave has requested that the City Council consider amending its legal services agreement with the City to increase the hourly rate for general legal services, litigation services, and reimbursable third-party services. In addition, pursuant to the legal services agreement, the City Attorney is proposing that the City Council appoint Meyers Nave associate attorney Jordyn Bishop to serve as the Assistant City Attorney. STAFF RECOMMENDATION: Approve the Second Amendment to the Amended and Restated Agreement for Legal Services and appoint Jordyn Bishop as the Assistant City Attorney. 5. WRITTEN COMMUNICATION – None. 6. PUBLIC HEARING 6.1 Outdoor Seating Zoning Ordinance Amendments and Master Fee Schedule Amendments (PLPA-2021-00024) The City Council will consider City-initiated amendments to the Zoning Ordinance to facilitate outdoor seating for eating and drinking establishments on both a long-term temporary and permanent basis to aid in economic recovery post-COVID-19. Amendments are proposed to Dublin Municipal Code Section 8.12.050 (Permitted and Conditionally Permitted Land Uses), Section 8.76.080 (Parking Requirements by Use Type), Section 8.104.030 (Site Development Review Waiver), and Section 8.108.020 (Uses Permitted with a Temporary Use Permit). The City Council will also consider adopting changes to the Master Fee Schedule pertaining to Site Development Review Waiver and Temporary Use Permit application fees for outdoor seating. STAFF RECOMMENDATION: Conduct a public hearing, deliberate, waive the reading and INTRODUCE the Ordinance Approving Amendments to Dublin Municipal Code Section 8.12.050 (Permitted and Conditionally Permitted Land Uses), Section 8.76.080 (Parking Requirements by Use Type), Section 8.104.030 (Site Development Review Waiver), and Section 8.108.020 (Uses Permitted with a Temporary Use Permit), and adopt the Resolution amending the Master Fee Schedule by establishing two new application fees, based on time and materials, for Temporary Use Permit – Outdoor Seating and Site Development Review Waiver – Outdoor Seating, which are valid until the City’s applicable American Rescue Plan Act Budget allocation is exhausted, or until September 30, 2022, whichever occurs first. 6.2 Energy Services Agreement Amendment with Willdan Energy Solutions for Efficiency and Infrastructure Improvement Projects and Consideration of a Financing Plan The City Council will consider the implementation of energy efficiency and related infrastructure improvement projects by approving an amendment to the design-build energy savings performance contract with Willdan Energy Solutions. The City Council will also consider approval of the issuance of tax-exempt bonds to fund the projects and the adoption of a resolution allowing the City to be reimbursed for expenditures on the projects prior to the issuance of bonds. STAFF RECOMMENDATION: Take the following action: 1) Conduct a Public Hearing and Adopt the Resolution Making Findings Required Under Government Code Sections 4217.10-18 and Approving an Amendment to the Design-Build Energy Savings Performance Contract with Willdan Energy July 20, 2021 Dublin City Council Regular Meeting Agenda 7 Solutions for Energy Reduction, Core Facility Infrastructure, and Resiliency Upgrades Projects; 2) Receive a report on the proposed financing plan and provide direction to Staff to return with the financing documents at a future meeting; and 3) Adopt the Resolution Declaring Intention to Reimburse Expenditures from the Proceeds of Certain Tax-exempt Obligations and Directing Certain Actions. 7. UNFINISHED BUSINESS 7.1 Consideration of a Resolution Authorizing the Issuance of Special Tax Bonds for and on Behalf of the City of Dublin Community Facilities District No. 2015-1 (Dublin Crossing), Improvement Area No. 3 and Approving Form of and Execution of Related Documents The City Council will consider the third phase of special tax bond financing for Community Facilities District No. 2015-1 (Dublin Crossing) and the use of the bond sale proceeds to finance authorized public capital facilities and public capital facility impact fees. The item for consideration is a Resolution authorizing issuance of the 2021 special tax bonds and approving the forms and execution of related bond documents. STAFF RECOMMENDATION: Adopt the Resolution Authorizing the Issuance of Special Tax Bonds For and On Behalf of the City of Dublin Community Facilities District No. 2015-1 (Dublin Crossing), Improvement Area No. 3; Approving the Form and Authorizing the Execution of a Fiscal Agent Agreement, a Purchase Contract and a Continuing Disclosure Certificate and Authorizing the Sale and Delivery of Special Tax Bonds Pursuant to Said Purchase Contract; Approving the Form and Delivery of a Preliminary Official Statement and the Preparation and Distribution of a Final Official Statement to be Derived from the Preliminary Official Statement; and Approving Execution and Delivery of Other Documents and Taking of Actions as Necessary to Implement the Issuance, Sale and Delivery of the Bonds. 8. NEW BUSINESS 8.1 American Rescue Plan Act Small Business Support Grant Programs (Commercial Rent Relief and Outdoor Operations) The City Council will consider approving two new small business support grant programs (Commercial Rent Relief and Outdoor Operations) using American Rescue Plan Act funding to help mitigate the severe impacts of the pandemic on small businesses. STAFF RECOMMENDATION: Adopt the Resolution Approving the Commercial Rent Relief Grant Program and Outdoor Operations Grant Program. 9. OTHER BUSINESS Brief information only reports from City Council and/or Staff, including committee reports and reports by City Council related to meetings attended at City expense (AB1234). 10.
