RECOMMENDATION: 1) Accept the final facility improvements; 2) Adopt Resolution accepting improvements to Stagecoach Park, Contract Number 08-08; and 3) Authorize Staff to accept a maintenance bond in the amount of $9,386 at a future date. FINANCIAL STATEMENT: Original Contract Amount $93,860 Approved Change Orders ~Q Total $93,860 Project Budget $116,750 Remaining Contingency $22,890 DESCRIPTION: At its meeting of June 17, 2008 the Dublin City Council awarded Contract No. 08-08, Stagecoach Park Play Area Renovation to M.A.K. Associates, Incorporated. Work under the Contract included replacement of existing play equipment and sand surfacing with new equipment and poured-in-place rubberized surfacing. Staff along with representatives from M.A.K. Associates completed a walkthrough of the project on December 23, 2008 and all elements of the project were complete. The City presently holds a performance bond in the amount of $93,860 to provide the necessary security for the performance of the work involved. As the work is now complete, the performance security requirement can be reduced, in accordance with authority contained in Section 66499.7 of the Government ------------------------------------------------------------------------------------------------------------- COPY TO: M.A.K. The Contractor will provide a new maintenance bond in the amount of $9,386, which is 10% of the final contract amount, and is sufficient to cover the one-year guarantee period. Upon City Council acceptance of the project, Staff will file a notice of completion with Alameda County Clerk. The City will release the 10% retention thirty-five days subsequent to recording the notice of completion with Alameda County. RECOMMENDATION: Staff recommends that the City Council take the following action: 1. Accept the final facility improvements; 2. Adopt Resolution accepting improvements to Stagecoach Park, Contract Number 08-08; and 3. Authorize Staff to accept a maintenance bond in the amount of $9,386 at a future date. a~~, ~~( RESOLUTION NO. - 08 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING IMPROVEMENTS TO STAGECOACH PARK CONTRACT NUMBER 08-08 WHEREAS, M.A.K Associates, Incorporated entered into a contract with the City of Dublin to complete the renovation of the Stagecoach Park Play Area in accordance with plans and specifications on file with the City Engineer; and WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract, M.A.K. Associates, Incorporated is required to warranty the improvements for a period of one year following acceptance of the work by the said City of Dublin; NOW, THEREFORE BE IT RESOLVED that: 1. The improvements completed within the said Facility, are hereby approved and accepted subject to the aforesaid one-year warranty; and 2. The said original performance bond posted in connection with the work involved in the construction of said Facility be hereby released upon acceptance of said warranty.
