HomeMy WebLinkAboutPC Reso04-61 Appv GenPlan Amnd RESOLUTION NO. 04- 61 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING A GENERAL PLAN TO REFLECT ORIGINAL INFORMATION INCLUDED IN THE EASTERN EXTENDED PLANNING AREA LAND USE MAP, AS OUTLINED BELOW, P A 04-054 WHEREAS, the General Plan for the City of Dublin was adopted on February 11, 1985 and has been amended a number of times since that date; and WHEREAS, the Environmental Impact Report (EIR) for the original General Plan was prepared and adopted in 1984 and General Plan Amendments have each received individual environmental review under the California Environmental Quality Act (CEQA), as they have been approved over the years; and WHEREAS, the City adopted the Eastern Dublin General Plan Amendment and Specific Plan to provide a comprehensive planning framework for future development of the Eastern Dublin Area. In connection with this approval, the City certified a program EIR pursuant to CEQA Guidelines section 15168 (SCH: 91103064, Resolution 51-93, and Addendum dated August 22, 1994, hereafter "Eastern Dublin EIR" or "program EIR"). The program EIR was integral to the planning process and examined the direct and indirect effects, cumulative impacts, broad policy alternatives, and areawide mitigation measures for developing Eastern Dublin; and WHEREAS, the Eastern Dublin General Plan Amendment Land Use Map, or the Eastern Extended Planning Area Land Use Map (Figure 2B), and Eastern Dublin Specific Plan Land Use Map (Figure 4.1) were adopted by City Council on May 10, 1993; and WHEREAS, City Council adopted a General Plan Amendment on November 5, 2002 that adopted the current General Plan Land Use Map (Figure l-la); and WHEREAS, the intent of the Amendment adopted on November 5, 2002 was to capture all of the information of the previous General Plan Land Use Maps (Figure 1-1, Figure 1-2, and Figure 2B) in one map; and WHEREAS, as changes in land use maps have occurred over the years, the City has contracted with various parties to prepare the modifications to the General Plan Land Use Map, and the media and physical appearance of the modifications to the Map varied slightly; and WHEREAS, a few significant features of the original Eastern Dublin General Plan Amendment map were inadvertently altered when the three Land Use Maps were merged together, and now the City has the ability to more precisely follow the original Eastern Dublin General Plan Amendment map; and WHEREAS, the EIR for the Eastern Dublin General Plan Amendment was adopted May 10, 1993 (a copy of which is available at the Community Development Department's public counter). The current proposed Amendment to the General Plan was reviewed in the EIR for the 1993 Eastern Dublin General Plan Amendment in which the Eastern Extended Planning Area Land Use Map (Figure 2B) and G:\PA#\2004\04-054 Eastern Dublin Land Uses GPA\PC Reso.doc proposed Amendment modifications were part of the EIR's "Reduced Project Area" plan and analysis. The current modification would not create environmental impacts beyond those identified in the EIR; and WHEREAS, a public hearing was scheduled before the Planning Commission for October 26, 2004 in consideration of a General Plan Amendment to reflect the original information included in the Eastern Dublin Extended Planning Area Land Use Map (Figure 2B) to restore land use features inadvertently altered from the Eastern Dublin General Plan Amendment Land Use Map; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and, WHEREAS, the Staff Report was submitted recommending that the Planning Commission adopt a resolution recommending that the City Council approve the General Plan Amendment; and, WHEREAS, the Planning Commission did hear and consider all such reports, recommendations, and testimony hereinabove set forth and supported the approval of the amended General Plan Land Use Map; and NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission does find that: 1. Proper environmental documentation has been prepared on the proposed General Plan Amendment in accordance with the California Environmental Quality Act and the documentation has been reviewed and considered prior to the Planning Commission's recommendation. 2. The proposed changes of the land use designations for the General Plan Land Use Map is consistent with all other goals, policies, and implementing programs set forth in the Dublin General Plan. 3. The proposed General Plan Amendment is in the public interest and it will not have an adverse affect on health or safety or be detrimental to the public welfare or be injurious to property or public improvement. NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission of the City of Dublin does hereby adopt a Resolution recommending City Council approval of a General Plan Amendment to revise the General Plan Land Use Map to reflect original information included in the 1993 Eastern Dublin General Plan Amendment Land Use Map, as shown attached in Exhibit A. NOW, BE IT FURTHER RESOLVED THAT the following modifications shall be made to the General Plan: Land Use Map The specific modifications to the General Plan Land Use Map are as follows: . Correction of neighborhood parks locations within the EDPO area of the General Plan Land Use Map in the vicinity of the Croak properties (APN 905-0002-002 and APN 905-0002-001-01). · Correction of the configuration and shape of the General Plan land uses in locations in the Eastern Extended Planning Area. In particular, the Amendment would restore the original land use configurations in the general vicinity of the following properties: Anderson, APN 905-0001-006-03 Bragg, APN 986-0004-003; Branaugh, APN 905-0001-004-04; ChenlTMI, APN 985-0027-002; DR Acquisition, APN 985-0029-012; Dublin Executive/Campbell, APN 905-0001-004-03 Dublin InvestorsIBraddock and Logan, APN 905-0002-003; EBJ Partners, APN 985-0027-004; Fallon Enterprises, APN 985-0028-002; First American Title/Jordan, APN 985-0027-006 and 007; Fredrich, APN 986-0004-002-03; Kobold, APN 985-0002-005-02 Mission Peak, APN 985-0002-001; Moller/Richey, APN 985-0001-001; Nielsen, APN 985-0002-009; Quarry Lane, APN 985-0002-006-01; Righetti, APN 905-0001-005-02; Tipper, APN 986-0004-001; Vargas, APN 986-0004-002-01; and Wallis/Lin, APN 986-0004-005-0l.
