Constitution Week 2019 The City Council will consider proclaiming September 17-23, 2019 as Constitution Week. STAFF RECOMMENDATION: Present the proclamation. 3.2. Public Comment At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Approval of the August 20, 2019 Special and Regular City Council Meeting Minutes The City Council will consider approval of the minutes of the August 20, 2019 Special and Regular City Council meetings. STAFF RECOMMENDATION: Approve the minutes of the August 20, 2019 Special and Regular City Council meetings. 4.2. Ordinance Adding Chapter 5.34 to the Dublin Municipal Code to Ban Expanded Polystyrene for Use as Disposable Food Serviceware The City Council will hold a second reading of an ordinance and consider adopting Chapter 5.34 to the Dublin Municipal Code to ban expanded polystyrene for use as disposable food serviceware in the City of Dublin. The Ordinance will also mandate that food vendors and city facility users use only readily recyclable or compostable disposable food serviceware for prepared food. STAFF RECOMMENDATION: Waive the second reading and adopt an Ordinance Adding Chapter 5.34 (Disposable Food Serviceware) to Title 5 (Public Welfare) to the Dublin Municipal Code. September 3, 2019 Dublin City Council Agenda Page 2 of 3 4.3. 2019 Walk and Roll to School Proclamation The City Council will consider proclaiming September 30, 2019 to October 4, 2019 as Walk and Roll to School Week” in the City of Dublin. International Walk and Roll to School Day is an annual event scheduled for October 2, 2019 that encourages students and parents to walk, bicycle, scooter, or skate to school. The City of Dublin will work with the Dublin Unified School District and Alameda County Safe Routes to Schools to promote participation in the event. STAFF RECOMMENDATION: Proclaim the week of September 30, 2019 through October 4, 2019 as “Walk and Roll to School Week” in the City of Dublin. 4.4. Amendment #1 to Agreement with Rincon Consultants, Inc. The City Council will consider amending the consultant services agreement with Rincon Consultants, Inc. (Rincon) to extend the term of the contract to June 30, 2020 and to add project scope for assistance with developing an updated Climate Action Plan. STAFF RECOMMENDATION: Adopt the Resolution Approving Amendment #1 to the Consultant Services Agreement between the City of Dublin and Rincon Consultants, Inc. 4.5. Words for Imagine Playground Art The City Council will consider word selection for public art at Imagine Playground. STAFF RECOMMENDATION: Approve the word selection for public art at Imagine Playground. 4.6. Ordinance to Establish Right-Of-Way for Dublin Boulevard – North Canyons Parkway Extension Project The City Council will consider adopting an ordinance establishing a Precise Alignment of Dublin Boulevard Right-Of-Way Lines. STAFF RECOMMENDATION: Waive the second reading and adopt an Ordinance to Establish Right-Of-Way Lines for Dublin Boulevard between Fallon Road and the Eastern City Limit. 4.7. Request Caltrans Update Population Signs on Freeways The City Council will consider requesting the California Department of Transportation (Caltrans) update the City of Dublin population on city limit signs located on freeways. STAFF RECOMMENDATION: Adopt the Resolution Requesting Caltrans Update the City of Dublin Population on City Limit Signs Located on Freeways. 4.8. Ratification of City Manager’s Employment Agreement & City’s Salary Plan The Council will consider ratification of the Fifth Amendment to City Manager’s Employment Agreement and the City’s Salary Plan. STAFF RECOMMENDATION: Ratify Fifth Amendment to City Manager’s Employment Agreement and ratify the Resolution Amending the Salary Plan. 5. WRITTEN COMMUNICATION – NONE. 6. PUBLIC HEARING – NONE. 7. Informational Report on the Dublin Transit Center The City Council will receive an informational report on the Dublin Transit Center. Established in 2002, the Dublin Transit Center is a 91-acre project area planned for high- density, mixed-use development, located adjacent to the East Dublin/Pleasanton BART Station. The City Council may provide feedback to Staff and discuss the remaining undeveloped sites within the Transit Center. As this is an informational item, no action will be taken. STAFF RECOMMENDATION: Receive the Staff presentation and provide feedback, as necessary. 9. OTHER BUSINESS Brief information only reports from City Council and/or Staff, including committee reports and reports by City Council related to meetings attended at City expense (AB1234). 10. Public Comment - None 3. Work Session with Urban Field Studio Assistant City Manager Linda Smith provided an introduction and background on the project. Jane Lin, with Urban Field Studio, led the work session on the preferred vision for Downtown Dublin’s Retail District including the creation of a public town square, associated street infrastructure and redevelopment of private parcels. Sub-consultants Ryan Call (ELS Architecture + Urban Design) and Kevin Feeney (Keyser Marston Associates) also presented during the work session. There was consensus from the City Council for City Staff and the consultants to continue to refine the Dublin Square (Concept A) design concept as the preferred vision for the Retail District. The preferred vision includes density and massing for three-to-five story buildings, and land uses for office, hotel, retail and residential. 4. Foss, City Manager SUBJECT: Ordinance Adding Chapter 5.34 to the Dublin Municipal Code to Ban Expanded Polystyrene for Use as Disposable Food Serviceware Prepared by: Shannan Young, Environmental Coordinator EXECUTIVE SUMMARY: The City Council will hold a second reading of an ordinance and consider adopting Chapter 5.34 to the Dublin Municipal Code to ban expanded polysty rene for use as disposable food serviceware in the City of Dublin. The Ordinance will also mandate that food vendors and city facility users use only readily recyclable or compostable disposable food serviceware for prepared food. STAFF RECOMMENDATION: Waive the second reading and adopt an Ordinance Adding Chapter 5.34 (Disposable Food Serviceware) to Title 5 (Public Welfare) to the Dublin Municipal Code. FINANCIAL IMPACT: Upon adoption, Staff time will be required to conduct outreach and support to food vendors and city facility users during the initial implementation phase of the ban. The current budget would support these efforts. Subsequently, minimal additional Staff time will be required to enforce the ban. Enforcement on food vendors could be completed as part of the Municipal Regional Stormwater NPDES Permit business inspection program for which fee recovery is included in the Master Fee Schedule. There will be no impact to the General Fund. DESCRIPTION: On August 20, 2019, the City Council waived the reading and introduced an Ordinance to add Chapter 5.34 (Disposable Food Serviceware) to Title 5 (Public Welfare) to the Dublin Municipal Code (Attachment 1). The August 20, 2019 Staff Report is attached as reference (Attachment 2). 4.2 Packet Pg. 15 Page 2 of 2 The Ordinance is now ready for adoption. If approved, the Ordinance would go into effect 30 days after tonight's adoption. Food vendors and city facility users would have six months (180 days) from adoption to comply with the ordinance. STRATEGIC PLAN INITIATIVE: N/A NOTICING REQUIREMENTS/PUBLIC OUTREACH: Staff will provide at least three notifications to food vendors and known city facility users regarding the EPS ban. Noticing would occur at the ordinance effective date, within three-months of the effective date, and prior to initiation of the enforcement period. Staff will also work with AVI and the Chamber of Commerce to distribute outreach information. ATTACHMENTS: 1. August 20, 2019 Disposable Food Serviceware Staff Report with Attachments 4.2 Packet Pg. 16 Dublin Disposable Food Serviceware 1 ORDINANCE NO. __ - 19 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DUBLIN ************** ADDING CHAPTER 5.34 (DISPOSABLE FOOD SERVICEWARE) TO TITLE 5 (PUBLIC WELFARE) OF THE DUBLIN MUNICIPAL CODE WHEREAS, the City of Dublin has a duty to protect the natural environment and the health of its citizens; and WHEREAS, expanded polystyrene litters city storm drains, streets, creeks, parks and other public places; and WHEREAS, expanded polystyrene in the environment may become part of the food chain, resulting in negative impacts to wildlife; and WHEREAS, banning expanded polystyrene disposable food serviceware in the City of Dublin will help address pollution by requiring the use of compostable or recyclable alternatives while helping educate business owners and citizens about the positive impact their packaging choices can make; and WHEREAS, there is no currently economically feasible means of recycling expanded polystyrene disposable food serviceware in the City of Dublin; and WHEREAS, due to these concerns, a number of California cities have banned expanded polystyrene disposable food serviceware, and many local businesses and several national corporations have successfully replaced expanded polystyrene food serviceware; and WHEREAS, the City’s goal is to replace expanded polystyrene disposable food serviceware with alternative products that are compostable and recyclable. NOW, THEREFORE, the City Council of the City of Dublin does hereby ordain as follows: Section 1. Chapter 5.34 of the Dublin Municipal Code is hereby added to read as follows: Chapter 5.34 DISPOSABLE FOOD SERVICEWARE 5.34.010. Purpose A. The purpose of this Chapter shall be to reduce garbage in landfills and assist the City with meeting its recycling goals and Municipal Regional Stormwater NPDES Permit requirements. 4.2.a Packet Pg. 17 Attachment: 1. The requirements of this Chapter do not replace or supplant the requirements of California or Federal law. 5.34.020. Definitions In addition to the general definitions applicable to this Code, whenever used in this Chapter, the following terms shall have the meanings set forth below: A. “City facility users” means all persons, societies, associations or organizations or special events promoters that require a permit to use a city facility as defined in Chapter 5.100, Parks and Recreation Areas and Facilities; or that require a special events permit for events which require city services, involve city-owned property such as streets and plazas, closure of public right -of-way or impair emergency vehicle access, and parades, as defined in Chapter 5.12, Parades and Events, and including permits to reserve or rent a city facility, including concession contracts with the city and city-managed concessions, city- sponsored events, and food services provided at city expense. These city facility permits also include but are not limited to picnic area reservations, park use application permits, field reservations, rental facilities, historic buildings and senior center rentals, and permits for gatherings and meetings in all parks and recreation areas which include group picnics and organized gatherings, educational, entertainment or recreation for 25 or more persons. B. “Compostable” means that all materials in the product or package will biodegrade or otherwise become part of usable compost (e.g., soil conditioning material, mulch) in an appropriate composting program or facility. These products are made primarily from natural fibers such as paper, cardboard, wood, bamboo, sugarcane, or wheat stalks. These products may have very thin (de minimis) polyethylene or polylactic acid coatings only, and uncoated p roducts are preferred. Rigid compostable plastic products are not compliant. C. “Disposable food serviceware” means single-use disposable products used by food vendors or city facility users for serving or transporting prepared and ready- to-consume food or beverages. This includes, but is not limited to, plates, cups, bowls, trays and hinged or lidded containers. This definition does not include single-use disposable straws, utensils, or cup lids. D. “Expanded polystyrene” means a thermoplastic petrochemical material utilizing the styrene monomer, marked with recycling symbol No. 6, processed by any number of techniques including, but not limited to, fusion of polymer spheres (expandable bead polystyrene), injection molding, form molding, and extrusion- blow molding (extruded foam polystyrene), sometimes referred to as Styrofoam™, a Dow Chemical Company trademarked form of polystyrene foam insulation. In food service, expanded polystyrene is generally used to make cups, bowls, plates, trays, and clamshell containers. 4.2.a Packet Pg. 18 Attachment: 1. Ordinance Adding Chapter 5.34 (Disposable Food Serviceware) to the Dublin Municipal Code (Disposable Food Serviceware Dublin Disposable Food Serviceware 3 E. “Food vendor” means any establishment which provides prepared food or beverages for public consumption within the City of Dublin, including, but not limited to, any store, supermarket, delicatessen, restaurant, retail food vendor, sales outlet, shop, cafeteria (including schools and corporate centers), catering truck or vehicle, sidewalk or other outdoor vendor, or caterer. F. “Prepared food” means any food or beverage prepared for consumption using any cooking, packaging, or food preparation technique by a food vendor or city facility user. “Prepared food” does not include uncooked meat, fish, poultry, or eggs unless provided for consumption without further food preparation. G. “Recyclable” means any material included as part of the commercial recycling program including, but not limited to, paper, glass, metal, cardboard, and plastic. H. “Commercial recycling program” means the city of Dublin’s adopted commercial recycling program. 5.34.030. Use of Expanded Polystyrene Food Serviceware Prohibited. A. A food vendor that offers prepared food shall utilize only disposable food serviceware that is either recyclable or compostable. The use of disposable food serviceware manufactured with expanded polystyrene is prohibited, unless otherwise specified in this chapter. B. All City facility users are prohibited from using disposable food service wares made from expanded polystyrene. All city facility users shall use a suitable recyclable or compostable product for disposable food serviceware. 5.34.040. Exemptions The Public Works Director, or his or her designee, shall have the responsibility to grant waivers or exemptions from the requirements of this chapter. A. Application for Exemption. If a food vendor or city facility user can demonstrate undue hardship resulting from compliance with the provisions of this chapter, or that a container required by the food vendor or city facility user is only available in expanded polystyrene, then the food vendor or city facility user may apply, in writing, for a one-year exemption from compliance. The Public Works Director or his/her designee will review the application for exemption and may meet with the applicant to discuss possible ways of meeting the requirements of this chapter. If the Public Works Director or his/her designee determines that compliance with the provisions of this chapter would cause the food vendor or City facility user to experience undue hardship, or that a non-expanded polystyrene version of a necessary container is not available, then the Public Works Director or his/her designee shall grant the food vendor or city facility user a one-year exemption. At the end of the one-year exemption, the food vendor or city facility user will be required to comply with this 4.2.a Packet Pg. 19 Attachment: 1. B. Prepackaged Foods. Prepared food prepackaged outside the limits of the city of Dublin (i.e., commercially packaged foods) are exempt from the provisions of this chapter. This exemption does not apply to food vendors as defined in this chapter, including caterers which provide prepared food for public consumption within the city of Dublin. Purveyors of food prepared or packaged outside the City are encouraged to follow the provisions of this Chapter. C. Emergency Supplies or Services Procurement. Food vendors, city facility users, city franchises, and contractors doing business with the City shall be exempt from the provisions of this chapter in a situation deemed by the city council or city manager, or his or her designee, to be an emergency for the immediate preservation of the public health, safety, or welfare. 5.34.050. Enforcement and Penalties A. Enforcement. Public Works Director or his/her agent has primary responsibility for the enforcement of this Chapter. The Public Works Director or his/her agent is authorized to promulgate regulations and to take any and all other actions reasonable and necessary to enforce this Chapter, including , but not limited to, investigating violations, issuing fines, and entering the premises of any food vendor during business hours. Other City staff may assist with this enforcement responsibility by entering the premises of a food vendor as part of their regular inspection functions and reporting any alleged violations. B. Written Warning. If a food vendor or city facility user is found to be in violation of this chapter, the Public Works Director or his/her designee shall issue a written warning to the food vendor. C. Penalties for Violation. Any food vendor or city facility user that violates or fails to comply with any of the requirements of this chapter after written notice has been issued for a previous violation shall be guilty of an infraction punishable as specified in section 1.04.030 of this Code. Section 2. Severability. The provisions of this Ordinance are severable and if any provision, clause, sentence, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any person or circumstances, such illegality, invalidity, unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, sections, words or parts thereof of the ordinance or their applicability to other persons or circumstances. Section 3. Effective Date. This Ordinance shall take effect and be enforced thirty (30) days following its adoption. Foss, City Manager SUBJECT: 2019 Walk and Roll to School Proclamation Prepared by: Rebecca Parnes, Environmental Technician EXECUTIVE SUMMARY: The City Council will consider proclaiming September 30, 2019 to October 4, 2019 as Walk and Roll to School Week” in the City of Dublin. International Walk and Roll to School Day is an annual event scheduled for October 2, 2019 tha t encourages students and parents to walk, bicycle, scooter, or skate to school. The City of Dublin will work with the Dublin Unified School District and Alameda County Safe Routes to Schools to promote participation in the event. STAFF RECOMMENDATION: Proclaim the week of September 30, 2019 through October 4, 2019 as “Walk and Roll to School Week” in the City of Dublin. FINANCIAL IMPACT: The Fiscal Year 2019-20 budget includes $3,500 funded by Measure B Bicycle/Pedestrian Funds to cover the costs of events and outreach related to Walk and Roll to School Week. DESCRIPTION: The Safe Routes to Schools program, found in more than 40 countries and in all 50 states, endeavors to increase the percentage of students and parents utilizing alternative methods of travel to and from school through the provision of resources, encouragement, and expertise. Walk and Roll to School Day is a day to reduce air pollution, traffic congestion, and to make streets safer near schools. Children learn safe walking and biking behavior and celebrate their school’s community spirit. The City of Dublin has participated in local Walk and Roll to School events with the Alameda County Safe Routes to Schools program and Dublin Unified School District (DUSD) as part of its annual Inte rnational 4.3 Packet Pg. 43 Page 2 of 2 Walk to School Week event. Last year all DUSD elementary and middle schools held Walk and Roll to School Day events. This year, Staff anticipates all schools in the DUSD will participate in a Walk and Roll to School Day event. At the time this report was submitted the following schools had committed to hosting events; Amador Elementary School, Cottonwood Creek Elementary School, Dublin Elementary School, Kolb Elementary School, and Murray Elementary School. Most schools will hold their event on October 2, 2019. Staff will provide giveaways to schools for distribution to all students participating in Walk and Roll to School Day. Staff will also support a minimum of six schools (yet to be selected) on the day of the event by visiting the school to h elp greet participating students, distribute safety information and giveaways, and help students record how they traveled to school. (Rincon) to extend the term of the contract to June 30, 2020 and to add project scope for assistance with developing an updated Climate Action Plan. STAFF RECOMMENDATION: Adopt the Resolution Approving Amendment #1 to the Consultant Services Agreement between the City of Dublin and Rincon Consultants, Inc. FINANCIAL IMPACT: The original agreement included a compensation amount of $75,000. This amendment includes additional scope of work in the amount of $6,740, bringing the total compensation to $81,740. Sufficient funds were included in the Fiscal Year 2018 -2019 budget to cover the scope included in the origin al agreement and sufficient funds are available in the Fiscal Year 2019-2020 budget to cover the additional scope of work. Half of the cost is budgeted from Measure D funds ($3,370) and half of the cost is budgeted from the General Fund ($3,370). DESCRIPTION: On June 19, 2018, the City Council adopted Resolution 72-18 approving a consultant services agreement (agreement) with Rincon Consultants, Inc. (Rincon) (Attachment 1). Staff began working with Rincon in July 2018 to develop an updated Climate Action Plan (CAP) that will provide greenhouse gas (GHG) emissions reduction goals for 2030 and 2050 to align with Senate Bill 32 and Executive Order B -30-15. Staff has found that Rincon has been helpful in development of an updated draft CAP. The agreement with Rincon expires on September 30, 2019. In order to ensure alignment with regional neighbors and analyze the GHG emissions impacts of the 4.4 Packet Pg. 46 Page 2 of 2 recently released 2019 Title 24 California Building Code, Staff desires to extend the current agreement term to June 30, 2020. Staff would also like to amend the agreement to add scope of work in an amount not to exceed $6,740 for a new compensation total of $81,740. The additional scope of work includes conducting additional GHG emissions analyses and completing pote ntial revisions to the proposed CAP measures. Bringing businesses, residents, and even students into the conversation will make implementing a comprehensive update to the CAP a reality. During this phase of the project, Rincon will review the Advisory Committees’ structure and suggest additional stakeholders whose involvement will help develop and implement Dublin’s CAP. Branding and Project Logo: Working with the City’s Public Information Officer, the project team will develop a logo for the CAP Update which the project team will use to link together marketing, outreach, and education campaigns. Through the consistent use of the project logo and brand, the project team will build awareness of the CAP Update. The City will then be able to attach the logo to future projects allowing the community to easily identify implementation projects. Social Media The project team will coordinate with the City’s PIO to operate an Instagram account throughout the project where we will post information, major event dates, and solicit feedback. The project team will encourage the community to use a project specific hashtag, and will conduct a green product giveaway each month of the project (12 total) to get people involved. Potential prizes may include an LED lightbulb, reusable drinking water container, or similar sustainability related item. Potentially, businesses like The North Face and Peet’s Coffee could be involved as their mission statements include sustainability related missions. Getting outreach and/or social media support from these groups could help propel this project to the forefront. 4.4.c Packet Pg. 79 Attachment: 3. Task 4: Recommendation of 2030 and 2050 GHG Reduction Targets With the recently approved 2017 Scoping Plan, GHG emission targets for municipalities have gotten clearer. The California Air Resources Board (CARB) has set a recommended target of 6 Metric Tons of CO2e per person by 2030 and 2 MT of CO2e per person by 2050. These per person estimates can also be translated into per service person (employees + population). A complete analysis of both options will be conducted and presented as options. Rincon will identify a suite of key GHG reduction measures on which the City can focus as it pursues the goal of 6 MT CO2e by 2030 and beyond to 2050. The Rincon Team will ensure that each measure has a finance plan, is fully vetted by the community, and that the hurdles to implementation have been addressed. The measures included in the updated CAP shall be fully actionable with funding opportunities identified. The measures will be separated into those that apply to municipal facilities/operations and those that apply to the community-at-large and organized by GHG reduction area (e.g., transportation, energy, solid waste, water, etc.). A finalized list will be presented to City staff and Committees for review and input. Every measure will come with a GHG reduction potential, list of co-benefits, approximate implementation costs, and potential funding sources. From this information the Rincon Team will supply an implementation strategy which will outline which measures should be prioritized. Rincon will develop a user friendly and readable CAP which leverages 4.4.c Packet Pg. 80 Attachment: 3. Exhibit A to the Resolution - Amendment #1 to Consultant Services Agreement with Rincon Consultants, Inc. (Amendment #1 to infographics, photos, and other visuals whenever possible and leaves all technical documentation to the appendix. The CAP will include both near-term and long-term action steps (measures) as well as the departments and community partners who will be responsible for implementing them. The CAP will also set key performance indicators (KPIs) which will help define a successful implementation of the CAP strategy as well as measure progress over time. The Rincon team shall prepare a comprehensive Plan to be consistent with the State Attorney General’s recommendations and the CEQA Guidelines’ definition of a “Qualified Greenhouse Gas Reduction Strategy” (Section 15183.5). The Plan Update shall also align with the City’s existing policies. The plan will provide a framework that reimagines the current systems – built, natural, and behavioral – as ones that are interconnected and mutually beneficial. The plan will integrate measures that improve quality of life, build prosperity, and enhance community resilience. Specifically, the CAP will:  Clearly explain the community’s climate challenges, and the challenges and opportunities it faces in meeting more ambitious climate adaptation and GHG reduction goals;  Serve as a mechanism to tie together the City’s existing and developing sustainability initiatives, strategies, and plans with the community’s goals;  Establish a set of cohesive and specific sustainability strategies, implementation plans, and metrics for regional and State strategies and initiatives; and  Activate and engage residents, businesses, and institutions with positive actions and tangible benefit.  Be optimized for online viewing on the City’s website Task 7: CEQA Streamlining and Documentation 7.1 CEQA Documentation In general, an Initial Study Mitigated Negative Declaration (ISMND) is sufficient California Environmental Quality Act (CEQA) documentation for a Climate Action Plan due to the generally positive environmental impacts associated with the project. However, due to the potentially significant resiliency measures which may be proposed including infrastructure construction, shifting of housing patterns, and others, a programmatic Environmental Impact Report (EIR) may be required. This will ultimately depend on the measures chosen as well as the response by the community. Therefore, the Project Team should begin with an ISMND but be prepared for an optional task of a more in depth EIR analysis. The funding source is the Public Art Fund. DESCRIPTION: On February 19, 2019, City Council unanimously approved the proposed ar twork by artist Barbara Grygutis, which will include laser cut stainless steel words reflecting Dublin's diversity to be embedded in the walkway. The artist requests that the City provide as many as 10 approved words, with the artist being given license to select from among them, depending on which words fit best within the design. The public was invited to select the words to be included via survey. The survey was published on Open City Hall May 2-15, 2019, listing words gleaned from public comment received during the Imagine Playground public meeting and the artists own statement about the artwork. Forty people responded to the survey. Foss, City Manager SUBJECT: Ordinance to Establish Right-Of-Way for Dublin Boulevard – North Canyons Parkway Extension Project Prepared by: Obaid Khan, Transportation and Operations Manager EXECUTIVE SUMMARY: The City Council will consider adopting an ordinance establishing a Precise Alignment of Dublin Boulevard Right-Of-Way Lines. STAFF RECOMMENDATION: Waive the reading and adopt an Ordinance to Establish Right-Of-Way Lines for Dublin Boulevard between Fallon Road and the Eastern City Limit. FINANCIAL IMPACT: As approved in the 2018-2023 Capital Improvement Program (CIP), the total estimated cost of the Dublin Boulevard Extension - Fallon Road to North Canyons Parkway is approximately $147.4 million, of which $97.1 million is estimated as the City of Dublin share. Funding for Project costs will be shared between the City of Dublin and the City of Livermore. Through Fiscal Year 2019-2020, City Council has appropriated a CIP budget of approximately $7.6 million from Measure BB Grants, Traffic Impact Fees, and Road Maintenance and Rehabilitation Account (SB -1) funds. Project funding also includes $123,000 of funds from the City of Livermore. Current project funding is for the preliminary engineering, environmental impact report, and initial design. After completion of the preliminary engineering and environmental impact report, Alameda County Transportation Commission (ACTC) will take the lead on project design. Establishing the Right-of-Way Lines will not obligate the City to acquire the right -of-way for Dublin Boulevard. There is no impact on the General Fund. DESCRIPTION: On August 20, 2019, the City Council waived the reading and introduced an Ordinance to Establish Right-of-Way Lines for Dublin Boulevard between Fallon Road and the 4.6 Packet Pg. 95 Page 2 of 3 Eastern City Limit. The Ordinance is now ready for adoption. The extension of Dublin Boulevard to the Doolan Road/North Canyons Parkway intersection has been planned since 1984. The City of Dublin General Plan (GP), the General Plans of Alameda County and the City of Livermore, the Eastern Dublin Specific Plan (EDSP), the Fallon Village Supplemental Environmental Impact Report, and Plan Bay Area 2040 all include the extension of Dublin Boulevard. The Dublin Boulevard extension area is north of Interstate 580 (I -580) between the existing terminus of Dublin Boulevard to the west and terminus of North Canyons Parkway to the east. There are developed residential areas north of the site and a commercial landscaping business south of the proposed roadway extension within the City of Dublin. The City of Dublin, in cooperation with the California Department of Transportation, City of Livermore, Alameda County Transportation Commission, and Alameda County, propose to extend Dublin Boulevard from its current terminus at Fallon Road, approximately 1.5 miles eastward through unincorporated Alameda County, terminating at the boundary between the County and the City of Livermore at the Doolan Road/North Canyons Parkway intersection. This roadway extension would provide four to six travel lanes and bicycle and pedestrian facilities (i.e., pathways, sidewalks and bike lanes). The permanent area required for the Project, including the roadway, sidewalks, intersections, and land acquired for right-of-way is estimated at 29 acres. Future average daily traffic (ADT) along the roadway extension is projected to be 17,000 to 19,000 vehicles per day. The establishment of Right-of-Way Lines are intended to reserve sufficient right-of-way for future road construction. Adoption of an ordinance to establish the Right -Of-Way Lines will not result in the immediate acquisition of any property but will preclude property owners from constructing structures within the right-of-way area. On August 20, 2019, The City Council held a public hearing and took the following actions: 1. Adopted Resolution 90-19 (Attachment 1) certifying an Environmental Impact Report and adopted required environmental findings for the Dublin Boulevard - North Canyons Parkway Extension Project. 2. Adopted Resolution 89-19 (Attachment 2) amending the GP and EDSP related to the Dublin Boulevard- North Canyons Parkway Project. 3. It was determined that an Environmental Impact Report (EIR) be prepared to analyze the Project; and WHEREAS, the City circulated a Notice of Preparation, dated May 18, 2017, to public agencies and interested parties for consultation on the scope of the EIR. The City also conducted a public scoping meeting on May 31, 2017; and WHEREAS, the City prepared a Draft EIR dated March 2019 for the proposed Project that reflected the City's independent judgment and analysis of the potential environmental impacts of the Project (SCH No. 2017052047). The Draft EIR is attached as Exhibit A and is incorporated herein by reference; and WHEREAS, the Draft EIR was circulated for a 45-day public review period from March 6, 2019 through April 22, 2019; and WHEREAS, the City received comments in ten (10) letters and emails from State, regional, and local agencies as well as interested individuals and organizations during the public review period and 1 additional letter from the Alameda Local Agency Formation Commission (LAFCO) after the close of the comment period. The Final EIR also contain minor clarifications and modifications to the Draft EIR; and WHEREAS, the Draft EIR identified potentially significant environmental effects anticipated as a result of the Project such as, aesthetics, air quality, biological resources, cultural and tribal cultural resources, geology and soils, greenhouse gas emissions, hazards/hazardous materials, hydrology and water quality, land use, noise and vibration, population and housing, public services, recreation, transportation and traffic, utilities, and energy, most of which can be substantially reduced through mitigation measures; therefore, approval of the Project must include impact and mitigation findings as set forth in attached Exhibit C; and WHEREAS, some of the impacts cannot be lessened to a level of less than significant; therefore, approval of the Project must include findings regarding alternatives as set forth in attached Exhibit D, and must include a Statement of Overriding Considerations as set forth in attached Exhibit E; and WHEREAS, the Planning Commission held a public hearing on the project on May 28, 2019 at which time they reviewed and considered the Draft and Final EIRs, and all reports, recommendations and testimony before them. BE IT FURTHER RESOLVED that the City Council hereby adopts the following amendments to the Eastern Dublin Specific Plan: Section 5.1.1 — DUBLIN BOULEVARD shall be amended to read as follows: Dublin Boulevard is a major east-west arterial in the City of Dublin. Dublin Boulevard is extended to Fallon Road. Dublin Boulevard is a six-lane facility from San Ramon Road to Tassajara Road and from Tassajara Road to Fallon Road it is currently a five to six lane facility. Section 5.1.2 PLANNED ROAD IMPROVEMENTS, second paragraph, shall be amended to read as follows: The City of Dublin has completed an extension of Dublin Boulevard east of Dougherty Road to Fallon Road. This extension provides three lanes in each direction, except for a short segment between Tassajara Road and Brannigan Street. The Dublin General Plan also designates a future four-lane Scarlett Drive parallel to Iron Horse Trail, connecting Dougherty Road north of Dublin Boulevard with the Dublin Boulevard east of Dougherty Road. The major arterial streets include Dublin Boulevard, as well as Hacienda Drive, Tassajara Road and Fallon Road. In general, these streets will provide six through lanes, with up to eight through lanes for short street sections connecting directly to a freeway interchange. Dublin Boulevard between Croak Road and North Canyons Parkway in Livermore will be a four-lane roadway. Access to arterials will be permitted only at signalized intersections with arterial or collector streets, or at selected controlled locations with the approval of the Director of Public Works. Foss, City Manager SUBJECT: Request Caltrans Update Population Signs on Freeways Prepared by: Sai Midididdi, Associate Civil Engineer (Traffic) EXECUTIVE SUMMARY: The City Council will consider requesting the California Department of Transportation (Caltrans) update the City of Dublin population on city limit signs located on freeways. STAFF RECOMMENDATION: Adopt the Resolution Requesting Caltrans Update the City of Dublin Population on City Limit Signs Located on Freeways. FINANCIAL IMPACT: There will be no cost to the City. DESCRIPTION: The estimated population of the City of Dublin is listed on signs located at th e city limits, including at four locations within the California Department of Transportation (Caltrans) freeway right-of-way. Staff recently updated the population number on city limit signs within the City of Dublin right-of-way and Staff proposes that the City Council request that Caltrans update the four freeway signs. As part of this effort Staff reached out to Caltrans. Two signs are located on I -580, one facing westbound, east of Fallon Road, and one facing eastbound, west of San Ramon Road. Two signs are also located on I-680, one facing northbound, north of the I-580 West on-ramp, and one facing southbound, south of Alcosta Boulevard. Attachment 2 shows the location of the signs. Per the Streets and Highways Code, section 101.4, Caltrans shall replace any city limit sign if all of the following conditions exist: 1. If the legislative body of a City requests the replacement. 4.7 Packet Pg. 141 Page 2 of 2 2. If the request is based upon a substantial change of population evidenced by a special or general federal census. 3. If no previous request has been made by the city within a period of five years. The existing freeway signs show a population of 49,890 and the signs were last updated in 2014. The current population is estimated by the Department of Finance to be 64,577 as of January 1, 2019. To meet the Streets and Highways Code requirements to have Caltrans update the population on the city limit signs, a resolution by the City Council requesting the replacement or update of the signs on the freeways is required. Increase the City Manager’s base salary from $2 5,261 per month to $25,514 per month; The revision in base pay would be effective May 1, 2019 2. Lump Sum General Leave Advance of 70 hours; 3. Foss, City Manager SUBJECT: Informational Report on the Dublin Transit Center Prepared by: Michael P. Cass, Principal Planner EXECUTIVE SUMMARY: The City Council will receive an informational report on the Dublin Transit Center. Established in 2002, the Dublin Transit Center is a 91-acre project area planned for high-density, mixed-use development, located adjacent to the East Dublin/Pleasanton BART Station. The City Council may provide feedback to Staff and discuss the remaining undeveloped sites within the Transit Center. As this is an informational item, no action will be taken. STAFF RECOMMENDATION: Receive the Staff presentation and provide feedback, as necessary. FINANCIAL IMPACT: No fiscal impact on the City at this time. DESCRIPTION: Background On December 3, 2002, the City Council adopted Resolution No. 216-02, approving a General Plan Amendment, Eastern Dublin Specific Plan Amendment, Planned Development Rezone with a related Stage I Planned Development, Parcel Map to further subdivide the area into development sites, and Master Development Agreement, establishing the Dublin Transit Center on land owned by the Alameda County Surplus Property Authority (ACSPA). These entitlements established a framework for future specific development proposals, which require (and have required) more detailed Stage II Planned Development zoning and Site Development Review prior to development. The approximately 91-acre Dublin Transit Center Project Area is bounded by the Ironhorse Trail to the west, Dublin Boulevard to the north, Interstate 580 to the south, and Arnold Road to the east (see Figure 1). 8.1 Packet Pg. 171 Page 2 of 4 Figure 1: Vicinity Map The Dublin Transit Center is planned as a high -density, pedestrian-friendly, transit- oriented, mixed-use development. The vision for the Transit Center includes 1,500 units on Sites A-C, located to the west of Iron Horse Parkway, built around a one-acre green space called Campbell Green and a series of open space corridors and plazas, as well as ground floor retail along Iron Horse Parkway. East of Iron Horse Parkway, the Transit Center establishes for 1.7 million square feet of campus office space on Sites D and E and may include up to 300 residential units on Sites D-1 and E-1, as well as ancillary ground-floor retail along Ironhorse Parkway. To date, the Dublin Transit Center is developed with 1,556 dwelling units, as well as limited ground-floor retail space along Iron Horse Parkway, and improvements to Campbell Green have been completed. The County’s General Services Administration is preparing to construct a parking garage on the eastern portion of Site D-1 to accommodate parking for transit riders. Additionally, the County has entered into a purchase and sale agreement for the southern 5.88 acres of Site D-2. The applicant is currently processing an entitlement application with the City to construct a six-story, 162,000 s.f. Westin Hotel comprised of 198 rooms, assembly space (conference center), a restaurant, cafe, gym, pool, and other related amenities. In August 2019, the ACSPA closed a Request for Proposal (RFP) for the development of Site E-1. The ACSPA received one response to the RFP, which included a speculative mixed-use development, comprised of office, hotel, retail, and structured parking. The Authority is currently evaluating the viability of this proposal. Please refer to Table 2 below for additional information regarding the developm ent capacity of these vacant sites based on the current master plan for the Transit Center.
