Foss, City Manager SUBJECT: Request for Waiver of Bid Requirement As Authorized by Municipal Code and Authorization to Purchase Replacement Carpet for City Facilities at the Shannon Community Center and Dublin Senior Center from the Mohawk Group Prepared by: Lisa McPherson, Recreation Manager EXECUTIVE SUMMARY: The City Council will consider authorizing the purchase of replacement carpet for City facilities at the Shannon Community Center and Dublin Senior Center from the Mohawk Group. Staff desires to purchase replacement carpet for Ambrose Hall, the lobby, and the hallway at the Shannon Community Center, and the lounge and hallway at the Dublin Senior Center. The Mohawk Group utilizes the California Municipal Awards Schedules program, which allows public agencies enter into agreements established through a cooperative public bid process. The carpet cost will exceed $45,0 00, which requires City Council approval. STAFF RECOMMENDATION: Adopt the Resolution Authorizing Staff to Procure Replacement Carpet for City Facilities at the Shannon Community Center and Dublin Senior Center from the Mohawk Group. FINANCIAL IMPACT: The cost of replacement carpet at the Shannon Community Center and Dublin Senior Center is not to exceed $94,000. Sufficient funds exist in the Fiscal Year 2018 -19 budget for this purchase. DESCRIPTION: The Parks and Community Services Department operates the City's Shannon Community Center and Dublin Senior Center. These facilities are utilized daily by the public for programs, classes, and rentals. The carpet in both facilities has not been replaced for over a decade. When making these purchases, Staff utilizes procurement practices that ensure that the City obtains replacement carpet that meets City standards Page 2 of 2 at a competitive price. Section 2.36.100(B)(9) of the Dublin Municipal Code allows for exceptions to the typical public bidding process when the City is able to procure items from a competitive bid process administered by another public agency. Purchases made in this manner in excess of $45,000 still require City Council approval (Section 2.36.090). The Mohawk Group offers its products to local government agencies based on an agreement with the California Municipal Awards Schedules program which is a Master Contract that can be utilized by local government agencies. Resolution Authorizing Staff to Procure Replacement Carpet for City Facilities at the Shannon Community Center and Dublin Senior Center from the Mohawk Group ATTACHMENT 1 RESOLUTION NO. xx - 19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * * * * * * * AUTHORIZING STAFF TO PROCURE REPLACEMENT CARPET FOR CITY FACILITIES AT THE SHANNON COMMUNITY CENTER AND DUBLIN SENIOR CENTER FROM THE MOHAWK GROUP WHEREAS, the City requires replacement carpet for City facilities at the Shannon Community Center and Dublin Senior Center; and WHEREAS, Staff desires to purchase the replacement carpet from the Mohawk Group, and WHEREAS, Section 2.36.100(B)(9) of the Dublin Municipal Code allows for exceptions to the typical public bidding process when the City is able to procure items from a competitive bid process administered by another public agency; and WHEREAS, The Mohawk Group has a valid pricing agreement publicly bid by California Municipal Awards Schedules, which meets this Municipal Code provision for a publicly bid agreement; and WHEREAS, Section 2.36.090 of the Dublin Municipal Code requires City Council approval of purchased items with a cost greater than or equal to forty-five thousand dollars ($45,000); and WHEREAS, the estimated cost of the Fiscal Year 2018-19 replacement carpet under the Mohawk Group cooperative purchasing agreement, will not exceed $94,000. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby authorizes the City Manager as Purchasing Agent to procure the Fiscal Year 2018-19 replacement carpet for City facilities at the Shannon Community Center and Dublin Senior Center from the Mohawk Group, under a purchasing agreement publicly bid by California Municipal Awards Schedules, at a cost not to exceed $94,000.
