Foss, City Manager SUBJECT: Authorization of Acceptance of Work and Approval of Final Change Order - CIP Project No. ST0911, Dougherty Road Improvements Prepared by: Michael Boitnott, Capital Improvement Program Manager EXECUTIVE SUMMARY: The City Council will consider authorizing the City Manager to accept the Dougherty Road Improvements and to approve the Final Contract Change Order for CIP No. ST0911. The project provided for the widening of Dougherty Road from four lanes to six lanes and installing landscaped median islands between Sierra Lane and the Northern City limits. STAFF RECOMMENDATION: Adopt the Resolution Authorizing the City Manager to Accept the Dougherty Road Improvements and to Approve the Final Contract Change Order (CIP No. ST0911). FINANCIAL IMPACT: The proposed final contract change order with DeSilva Gates Construction, LP for $327,924.49 exceeds the City Manager’s contract change order authority by $137,293.48. Sufficient funds are available in the project budget for the proposed final contract change order. Additionally, the change order amount is reimbursable from the Alameda County Transportation Commission project grant funding of Measure B ($6,267,000) and Measure BB ($11,200,000) funds. DESCRIPTION: On May 17, 2016, the City Council awarded a construction contract for the Dougherty Road Improvements (CIP No. ST0911) to DeSilva Gates Construction LP for a not to exceed amount of $14,133,777.60, which included a construction contingency. At the same time, the City Council authorized the City Manager, or his designee, to approve project contract change orders, based on appropriated project fu nds, up to the contingency amount of $2,356.000. Page 2 of 3 The project provided for the widening of Dougherty Road from four lanes to six lanes between Sierra Lane and the Northern City limits. The work include d the installation of new class II bike lanes; 1.4 miles of bicycle/pedestrian pathway; landscaped median islands; storm drainage improvements; new curb, gutter, sidewalk, bus stops, bioretention areas, and landscaping along the easterly side of the existing roadway. The project also provided a rubberized asphalt overlay and new pavement markings over the entire width of the roadway from Dublin Blvd. to the northern city limits, new curb ramps, and fiber optic connections and traffic video cameras at signalized intersections To date, 38 contract change orders were issued totaling $2,165,368.99 for the project varying from time extensions for adverse weather, the extension of bid item quantities, to unforeseen conditions encountered while excavating, and installing unanticipated utilities for the project. The final contract change order for $327,924.49 represents the funding necessary to complete project construction and closeout the contract. The contractor has substantially completed the project and is currently working to correct deficient items identified through the punch list process and to complete project closeout documentation. At this point, it is anticipated the project construction will be fully completed, including the plant establishment period, by the end of the year. The project experienced some significant impacts resulting from adverse weather, unforeseen conditions related to utilities, and varying site conditions. Even with these impacts the project construction will be completed for a total cost that is approximately $400,000 below the Engineer’s estimated cost when the construction was advertised for bids. Once project construction is completed, Staff will recommend the City Manager to accept the project and authorize the filing of the Notice of Completion, which begins the warranty period. Additionally, after construction is completed, the City will be able to closeout several regulatory permits which were necessary to construct the Project. Part of that closeout process will include the final purchase of a conservation easement (mitigation lands) from Collier Creek Mitigation Land. The conservation easement purchase was a requirement of the regulatory agency permits and the purchase was approved by the City Council in October 2015. The final step in the project will be to submit Measure B & Measure BB grant closeout documentation to the Alameda County Transportation Commission. STRATEGIC PLAN INITIATIVE: None. XX- 18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* AUTHORIZING THE CITY MANAGER TO ACCEPT THE DOUGHERTY ROAD IMPROVEMENTS AND TO APPROVE THE FINAL CONTRACT CHANGE ORDER (CIP NO. ST0911) WHEREAS, on May 17, 2016, the City of Dublin entered into a contract with DeSilva Gates Construction, LP. to widen Dougherty Road from four lanes to six lanes and to install landscaped median islands between Sierra Lane and the Northern City limits, CIP No. ST0911; and WHEREAS, said improvements have been substantially completed in accordance with plans and specifications, and any approved modifications thereof, to the satisfaction of the City Engineer of the City of Dublin; and WHEREAS, final completion of said improvements is dependent upon the issuance of a final Contract Change Order, in the amount of $327,924.49; and WHEREAS, as a condition of the contract, DeSilva Gates Construction, LP. is required to warranty the improvements for a period of one year following acceptance of the work by the City of Dublin and maintain a maintenance bond in the amount of 10% of the final contract value. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby authorize the City Manager or his designee to approve the final Contract Change Order in the amount of $327,924.49. BE IT FURTHER RESOLVED that, upon final completion of the improvements in accordance with the plans and specifications, to the satisfaction of the City Engineer, the City Council of the City of Dublin does hereby authorize the City Manager or his designee to accept the Project, Dougherty Road Improvements (CIP No. ST0911) and authorize Staff to file a Notice of Completion with Alameda County. BE IT FURTHER RESOLVED that the City Council of the City of Dublin does hereby authorize the City Manager or his designee to release the retention, if after 35 days of filing the Notice of Completion there are no subcontractor claims.
