Acceptance of Work - CIP Project No. PK0216, Sean Diamond Park

EXECUTIVE SUMMARY:
The City Council will consider acceptance of Sean Diamond Park, CIP No. PK0216. The
project provided for the construction of a five-acre park, which includes a central
gathering point with lighted rose garden, playgrounds for children ages 2 -5 and 5-12, a
tennis court, picnic area with shade structure, informal lawn area, grass volleyball court,
restroom building, pathways for circulation and exercise, and supporting elements.
STAFF RECOMMENDATION:
Adopt the Resolution Accepting Sean Diamond Park (CIP No. PK0216).
FINANCIAL IMPACT:
Sean Diamond Park, Project No. PK0216, has a total budget of $2,938,530 funded by
Public Facility Fees. The project is now complete with an estimated total of $2,788,900
spent. The remaining budget of approximately $149,630 will be returned to fund
balances after all the final project closeout expenses are cleared.
DESCRIPTION:
On March 21, 2017, the City Council awarded a construction contract with McGuire and
Hester in the amount of $2,025,400 for Sean Diamond Park, Project No. PK0216. The
scope of work for the five-acre park included a central gathering point with lighted rose
garden, playgrounds for children ages 2 -5 and 5-12, a tennis court, picnic area with
shade structure, informal lawn area, grass volleyball court, restroom building, pathways
for circulation and exercise, and supporting elements.
Ten change orders were issued on the project in the total amount of $121,141 . The
change orders covered encountered unforeseen conditions at the site, clarification of
the drawings, and additional work requested by the City.

Staff has determined that the project is complete and recommends that the City Council
accept the project and begin the warranty period for the project. The remaining budget
of approximately $149,630 will be returned to fund balances after the final project
closeout expenses are cleared.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

ACCEPTING SEAN DIAMOND PARK (CIP NO. PK0216)
WHEREAS, on March 21, 2017. the City of Dublin entered into a contract with
McGuire and Hester to construct Sean Diamond Park, CIP No. PK0216; and
WHEREAS, said improvements have been completed in accordance with the
plans and specifications, and any approved modifications thereof, to the satisfaction of
the City Engineer of the City of Dublin; and
WHEREAS, as a condition of the contract, McGuire and Hester is required to
warranty the improvements for a period of one year following acceptance of the work by
the City of Dublin and maintain a maintenance bond in the amount of 10% of the final
contract value; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Dublin does hereby accept the improvements, Sean Diamond Park (CIP No. PK0216)
and authorize Staff to file a Notice of Completion with Alameda County.
BE IT FURTHER RESOLVED that the City Council of the City of Dublin does
hereby authorize the City Manager or his designee to release the retention, if after 35
days of filing the Notice of Completion there are no subcontractor claims.
