HomeMy WebLinkAboutPC Reso04-37 Rec CC Adopt Tassajara Rd/Fallon NegDec RESOLUTION NO. 04-37 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING CITY COUNCIL ADOPTION OF AN INITIAL STUDY/MITIGATED NEGATIVE DECLARATION AND MITIGATION MONTORING AND REPORTING PROGRAM FOR THE TASSAJARA ROAD/FALLON ROAD ULTIMATE RIGHT-OF-WAY ALIGNMENT WHEREAS, the City of Dublin has proposed the establishment of right-of-way lines for Tassajara Road and Fallon Road in accordance with Municipal Code Chapter 7.68; and WHEREAS, the effected segment of Tassajara Road extends from the northern boundary of Dublin Ranch Phase 1 (Tract 6925) near Shadow Hills Drive to the Alameda County/Contra Costa County line, generally following the existing road; and WHEREAS, the planned segment of Fallon Road extends from a future intersection at Tassajara Road to a point approximately 1,500 feet south-east of the intersection for connection with the portion of Fallon Road to be constructed as part of Dublin Ranch Area A; and WHEREAS, the California Environmental Quality Act (CEQA), together with the implementing Guidelines and City environmental regulations require that projects be reviewed for potential environmental impacts and that environmental documents be prepared; and WHEREAS, an Initial Study was conducted by the City of Dublin finding that the project, as proposed, would not have a significant effect on the environment; and WHEREAS, based on the findings of the Initial Study, a Mitigated Negative Declaration has been prepared pursuant to the Califomia Environmental Quality Act (CEQA) and State CEQA Guidelines and is on file in the City of Dublin Planning Department; and WHEREAS, a Mitigation Monitoring and Reporting Program has been prepared in accordance with CEQA and implementing guidelines to ensure compliance with mitigation measures included in the Initial Study; and WHEREAS, the Planning Commission did review and use their independent judgment to consider the Mitigated Negative Declaration at a public hearing on May 11, 2004; and WHEREAS, proper notice of said public hearing was given in all respects as required by law. NOW, THEREFORE, BE IT RESOLVED that the City of Dublin Planning Commission does hereby find that: The proposed establishment of right-of-way lines for Tassajara Road and Fallon will not have a significant effect on the environment based on review of the Initial Study, Mitigated Negative Declaration, and public testimony. The Initial Study identified a number of potentially significant environmental impacts including but not limited to air quality, biological resources, cultural resources, soils and geology, hydrology and water quality, noise, and transportation. However, measures have been included in the Initial Study to reduce each potentially significant impact to a less-than- significant level. 3. The Mitigated Negative Declaration has been prepared in accordance with State and local environmental laws and guideline regulations. 4. The Mitigated Negative Declaration is complete and adequate. NOW, THEREFORE, BE IT FURTHER RESOLVED THAT the Dublin Planning Commission does hereby recommend adoption of the Mitigated Negative Declaration and Mitigation Monitoring Plan for PA 04-018 "Tassajara Road/Fallon Road Ultimate Right-of-Way Alignment" by the City Council. PASSED, APPROVED, AND ADOPTED this 11 th day of May, 2004. AYES: Cm.
