HomeMy WebLinkAboutPC Reso04-39 Rec CC Tassajara & Fallon Rds ROW RESOLUTION NO. 04 - 39 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN REPORT AND RECOMMENDATION THAT THE CITY COUNCIL ADOPT A RESOLUTION OF INTENTION TO ESTABLISH ULTIMATE RIGHT-OF-WAY LINES FOR TASSAJARA ROAD AND FALLON ROAD WHEREAS, the City of Dublin has proposed the establishment of right-of-way lines for Tassajara Road and Fallon Road in accordance with Municipal Code Chapter 7.68; and WHEREAS, the effected segment of Tassajara Road extends from the northern boundary of Dublin Ranch Phase 1 (Tract 6925) near Shadow Hills Drive to the Alameda County/Contra Costa County line, generally following the existing road; and WHEREAS, the planned segment of Fallon Road extends from a future intersection at Tassajara Road to a point approximately 1,500 feet south-east of the intersection for connection with the portion of Fallon Road to be constructed as part of Dublin Ranch Area A; and WHEREAS, the proposed right-of-way lines conform to the lines previously established by Ordinance No. 20-99 adopted on September 7, 1999 for the southern segment of Tassajara Road between 1-580 and the northern boundary of Dublin Ranch Phase I; and WHEREAS, the project has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and implementing Guidelines, and a Mitigated Negative Declaration has been recommended to the City Council for adoption, as it will have no significant effect on the environment; and WHEREAS, an Agenda Statement was prepared on behalf of the City Engineer and submitted to the Planning Commission as required by Municipal Code Chapter 7.68 recommending that the Planning Conunission recommend to the City Council adoption of a Resolution of Intention to establish right-of-way lines; and WHEREAS, the Planning Commission did hold a public hearing on May 11, 2004; and WHEREAS, proper notice of said public hearing was given in all respects as required by law. WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth; and WHEREAS, the right-of-way line is appropriate and compatible with the existing land uses and will not overburden public services; and WHEREAS, the right-of-way line will not have a substantial adverse effect on health or safety or be substantially detrimental to the public welfare or be injurious to property or public improvements; NOW, THEREFORE, BE IT RESOLVED that the Dublin Planning Commission does hereby recommend that the City Council adopt a Resolution of Intention to establish right-of-way lines for Tassajara Road and Fallon Road as depicted on the plat maps and legal descriptions included as Attachment 3 to the Agenda Statement.
