Smoking Pollution Control Ordinance for Apartment Housing Annual
Compliance Report

EXECUTIVE SUMMARY:
In 2011, the Dublin City Council adopted an Ordinance that amended the Smoking
Pollution Control provisions (Chapter 5.56) of the Dublin Municipal Code to require that
apartment communities (with 16 or more units) designate at least 75 percent of units as
non-smoking. The City Council will receive a report regarding compliance with the
Ordinance provisions.
STAFF RECOMMENDATION:
Staff recommends that the City Council receive the report.

DESCRIPTION:
On July 19, 2011, the City Council adopted an ordinance that amended Chapter 5.56 of
the Dublin Municipal Code, titled Smoking Pollution Control. The Ordinance requires
that apartment communities with 16 or more rental apartment units designate at least 75
percent of units as non-smoking. In order to verify compliance, the Ordinance includes a
provision that requires landlords or property managers at each eligible community to
submit an annual compliance report to the City.
Staff has collected annual surveys for the 2016 reporting year from all eligible apartment
communities. All complexes were found to be in compliance with the Ordinance.
Current Non-smoking Units
A total of 22 apartment communities are subject to the Ordinance. These communities

comprise 5,270 units (up from 5,018 in 2015). As of January 1, 2016, 5,150 of these
units (98%) are designated as non-smoking. This is an increase from last year, when
4,803 units (96%) were designated as non-smoking. All but three Dublin apartment
communities are now 100 percent non-smoking, down from six communities in January
2015. Park Sierra, Sofi, and Tralee converted all units to non-smoking over the past
year. The table below shows the number and percentage of non-smoking units in Dublin
rental communities in 2015 and 2016.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
A copy of the Staff Report was provided to all apartment complexes required to report
under the Ordinance.
