FINANCIAL STATEMENT : No cost to. City. DESCRIPTION : On April 20 , 1987 , Permit No . 87-305 was issued authorizing installation of a patio roof. The patio .structure was 22 ' 6" long and 13 ' 4" wide and was partially enclosed . The long wall being open and the short walls closed . On June 23 , 1987 , the applicant visited the office and requested approval of a change to the plan . The change was to allow the open side of the patio structure to be enclosed, creating a fully enclosed room. As a result of the enclosure of the open side the window of the bathroom, which originally opened into the open patio now opened into a fully enclosed structure . Section 1205 ( a ) of the Uniform Building Code provides that all required windows open into a street , public alley, yard or court on the same lot or open into a roofed porch which is open at least 65% on the long side . The purpose of this requirement is so that windows are available to provide a natural ventilation to dissapate water vapors , or odors that may be generated in a bathroom. Section 1205 ( a ) also provides that in lieu of windows , bathrooms may have an exhaust fan . It should be noted that the plans prepared by the applicant , Exhibit 1 do not show the true condition , as they exist , in that e adjoining rooms are not shown . Exhibit 2 , prepared by the Building Department Staff shows the relations-hip between the existing house and the addition , and the powder room window opening into the addition . In approving the change to allow the open side of the patio structure to be enclosed , the Building Department Staff was unaware of the existing conditions and relied on the applicants plans . The problem with the window was discovered when an inspection was made . At that time the applicant was advised of the requirement of the exhaust fan for the existing bathroom. ------------------------------------------------ ITEM NO. 17 COPIES TO : Russell Bebout -The applicant requests a variance to Section 1205 ( a ) so as to waive the requirements for an exhaust fan in _e powder room and indicates that there is a screen door on the left side of the structure and feels this is adequate for natural ventilation . In order to grant a variance the City Council must find that the granting of the variance is consistant with the purpose of the building code and it will not lessen the protection to the people of the City of Dublin or the property situated therein . It is the opinion of the Building Official that these findings cannot be made . The applicant raises another issue in his July 9 , 1987 , letter which is not the subject of this variance request . It can be seen that the plans were not prepared by a professional and do not show every detail of construction . When the applicant constructed the side walls of the patio enclosure , he used a redwood sill on the concrete as required by code . When he enclosed the long wall of the enclosure he did not use a redwood or pressure treated sill . The plans do not show the sills and he feels that the Building Department should have told him that redwood or pressure treated sills are required . Since he used the proper material on the short walls , it was assumed that the applicant was familiar with construction practices and code . The problem is one of weighing the expense and inconvenience to the citizens of the City in requiring plans for minor structures to be prepared by a professional , who would be aware of all code provisions , so that the plans show every little detail of construction , against the possibility of work being .done incorrectly as a result of lack of detail on the plans . The Building Department has leaned toward the former approach because Staff is available for at least two and usually four hours per day to answer phone inquiries . The Staff is also available to answer questions on the job . Being on top of a hill here with a wind problem I went back on 6/23/87 and requested a change. I requested a small window on the left side and a solid front consisting of fir siding with 2 X 4 , s two feet on center. This was approved signed and dated by Bob White on my existing drawing. On 7/8/87 I was told that the bottom portion of my framing ( 2x4 , $ ) need to be replaced with pressure treated lumber. This was an extensive job alough I did it . On 7/9/87 I at then told that I need a fan installed on the wall at the bathroom for which this room is inclosing, which does have a window. My permit and alteration have been approved with no previous mention of any fan. Had I known previously of this requirement I would have just left the room open on one side . I did install a screen door on the left side to give this room sufficient ventilation. I am requesting a waiver on the fan installation. I do not feel that it is proper to make this additional requirement after the fact. J�'l� 4 �PJ.s �flau.T.h T RESOLUTION NO.-87 A RESOLUTION OF' THE CITY COUNCIL OF THE CITY OF DUBLIN --------------------------------------------- DENYING VARIANCE TO SECTIONS 12O5(a) OF THE UNIFORM BUILDING CODE WHEREAS, . Russell Bebout, 11318 Bloomington Way requested a variance to Section 1205(a) of the Uniform Building Code so as to allow the omission of the exhaust fan in the existing bathroom; and WHEREAS, the City Council did hold a public hearing on this matter on July 27, 1987; and WHEREAS, the City Council finds that granting the variance would lessen the protection to the people of the City of Dublin and property situated thereon, and that the granting of the variance is not consistent with the spirit and purpose of the Building Code; NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby deny said requested variance.
