The City Council also requested a copy of all the policies related to these appointments . Staff has prepared a list of the Park & Recreation Commission, Planning Commission, Mosquito Abatement Board of Directors, and Downtown Improvement Study Committee. As indicated by Resolution No. 57-83 in the attached ByLaws and Rules of Procedure for the Park & Recreation Commission and Ordinance No. 12-84, the Commission members on both the Planning and Park & Recreation Commissions serve at the sole pleasure of the respective Councilmember that appointed the Commissioner. The City Council does not review or approve each individual Councilmember ' s appointment of a member to these 2 commissions . The Downtown Improvement Committee consists of a total of 11 members ; one member representing the Chamber of Commerce and two members appointed by each Councilmember, one of which must be from the business community within the designated downtown area and another from the residential community. PLANNING AGENCY ESTABLISHED. Pursuant to Government Code Sections 65000 et. seq. ,- there is hereby established a planning agency consisting of a Planning Commission. Section 2. PLANNING COMMISSION: APPOINT. The Planning Commission shall consist of five members. They shall be appointed for a term of four years except that the members first appointed shall , at their first meeting, determine by lot that three members shall serve initially for a four year term and two members a two year term. Terms shall begin on the date of the first meeting of the Commission. If a vacancy occurs otherwise than by expiration of term, it shall be filled by appointment for the unexpired portion of the term. No person shall be appointed to more than two consecutive four-year terms. Section 3. MEMBERS: REMOVAL FROM OFFICE. Although a member shall be appointed for a term, he may be removed by a majority vote of all the members of the City Council . A member who fails, without permission, to attend three successive meetings of the commission is subject to removal . Section 4. EXPENSES. Planning Commission members shall be entitled to reimbursement for expenses as the City Council may approve. Section 5. CHAIRMAN; RULES; RECORDS AND MEETINGS. The Planning Commission shall elect a Chairman and Vice Chairman from its membership annually. In the absence or disability of either the Chairman or Vice Chairman, the Commission may designate a temporary Chairman. The Commission shall hold at least one regular meeting each month and such other meetings as may be necessary. The Commission shall adopt rules for the transaction of its business and shall keep a public record of its resolutions, transactions, findings and determinations. The rules shall provide that not less than three affirmative votes shall be . required to recommend matters to the City Council for adoption. The Commission shall appoint a secretary who may be one of its members or someone else. r Section 6. POWERS AND DUTIES GENERALLY. The Planning Commission shall have the power and it shall be its duty: A. To recommend for adoption by the City Council a comprehensive long term general plan for the physical development of the City and of any land outside its boundaries which in the Planning Commission.'s judgment bears relation to its planning. B. To recommend for adoption by the City Council specific plans based on the general plan and drafts of such regulation, programs and legislation as may in its judgment be required for the systematic execu- tion of the general plan. C. To periodically review the capital improvement program of the City. D. To recommend for adoption by the Council a zoning ordinance and to perform such other duties in reference to planning and zoning and land use matters as may be required by the Council . Section 7. SUPERSESSION OF COUNTY ORDINANCE. It is the intention of the City Council of the City of Dublin that this ordinance shall supersede the effectiveness of the ordinance or ordinances of the County of Alameda regarding the organization or functioning of the Alameda County Planning Commission as it relates to land use matters within the boundaries of the City of Dublin as adopted by the City Council by Ordinance No. 1 of the City of Dublin. PASSED AND ADOPTED by the City Council of the City of Dublin on this 16th day of February 1982, by the following vote: AYES: Councilmembers Burton, Hegarty, Jeffery, Moffatt and Mayor Snyder NOES: None ABSENT: None MAYO ATTEST: CITf CLERK ORDINANCE NO. 12 - 84 AN ORDINANCE OF THE CITY OF DUBLIN ° AMENDING ORDINANCE NO. 5 ESTABLISHING A PLANNING AGENCY BY PROVIDING THE METHOD FOR APPOINTMENT AND REMOVAL OF PLANNING COMMISSIONERS THE CITY COUNCIL OF THE CITY OF DUBLIN does ordain as follows; Section 1 . AMENDMENTS Section 3 of Dublin Ordinance No. 5 is amended to read as follows ; "Section 3 . MEMBERS : APPOINTMENT AND REMOVAL FROM OFFICE Members shall be appointed to the Planning Commission by individual councilmembers and shall serve their respective terms of office at the sole pleasure of said councilmembers . The appointing councilmember may, without the approval of other councilmembers, remove said planning commissioner at any time during the commissioner 's term of office. The term of office of a member of the Planning Commission shall correspond to the term of office of the appointing councilmember . In the event that a councilmember leaves office prior to the completion of his or her term of office, the successor to the vacated council seat shall have the authority to remove and replace the Planning Commission member appointed by his or her predecessor and appoint a successor member to complete the term of office. Removal and appointment of Planning Commission members shall be made only at a regularly scheduled meeting of the City Council , Members of the Planning Commission shall be residents of the City of Dublin. " Section 2 . IMMEDIATE EFFECT Due to the fact that there are presently vacancies on the Planning Commission which present the possibility of a lack of quoru,n to conduct the regular business. of said Commission, and due to the fact that, by this Ordinance, the method of appointing members of the Planning Commission will be changed, it is necessary for the preservation of the public peace, health and safety that this Ordinance shall take effect immediately. Section 3 . POSTING OF ORDINANCE The City Clerk of the City of Dublin shall cause this Ordinance to be posted in at least three (3 ) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California . Councilmember Vonheeder ABSENT; None Mayor ATTEST t City Clerk ,. - RESOLUTION NO. 57 - 83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN -------------------------------------- CREATING A PARKS ,& RECREATION COMMISSION AND ADOPTING BYLAWS AND RULES OF PROCEDURE FOR THE COMMISSION WHEREAS, the City Council of the City of Dublin has identified a need to create a Parks & Recreation Commission; and WHEREAS, the purpose of a Parks & Recreation Commission is to advise the City Council on matters pertaining to the parks & recreation needs and programs of the City; and - WHEREAS, the City Council has deemed 'it necessary to have Bylaws and Rules of Procedure for the operation of the Parks & Recreation Commission. NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Dublin hereby establishes a Parks & Recreation Commission and adopts the attached Bylaws and Rules of Procedure for the Commission. General Provisions A. These Rules of Procedure shall be known as the Bylaws and Rules of Procedure of the .Parks & Recreation Commission of the City of Dublin. A copy of these Rules and amendments thereto, shall be filed in the offices of the City Clerk for examination by the public . B. These Rules and any amendments hereto shall be effective on the date of the adoption hereof, and shall govern the meetings and activities of the Commission. II . Commission Composition and Method of Appointment A. The Parks & Recreation Commission shall be composed of five members . Each City Councilmember shall be entitled to appoint one member to the Commission who will serve at, his/her pleasure. B. Commission members may resign at any time by giving written notice to the City Clerk and the City Councilmember who made the appointment. III . Term of Office and Removal A. A . Commission member shall be appointed for a term which runs concurrent with the term of the Councilmember who appointed that Commission member. At the end of a Commission member' s term, the Commission member may be reappointed to the Commission in the same manner as the initial appointment. B. Any member of the Commission may be removed from office in the same manner as he/she was appointed. C . If a member of the Commission is absent from all regular meetings for a period of 90 days from the last regular meeting without permission from said Commission, or if a Commission member ceases to reside in the City of Dublin, said Commissioner ' s office shall be declared vacant. IV. Vacancies Vacancies on the Commission occurring other than by expiration of term shall be filled for the unexpired portion of the term in the same manner as the original appointment. V. Officers A. Election and Term of Office. The Chairperson and Vice Chairperson are elected by the majority of the Commission for a 1-year term and hold office until their successors are elected, or until their terms as members of the Commission expire. The officers are elected at the first meeting of the Commission in October of each -year. Elections, whether regular or to fill vacancies shall be held only if 5 Commission members are present. The secretary to the Commission will be the City Manager or his designate . B. Vacancies . In case of any vacancy in the office of Chairperson or Vice Chairperson, the vacancy shall be filled by an election held at the first regular meeting after the occurrence of such vacancy. The person so elected shall serve the balance of the term. Page 1 C.. Duties of Officers . The Chairman performs the following duties: 1 . Presides at all meetings of the Commission. 2 . Appoints committees and chairpersons of committees as necessary. 3 . Signs correspondence on behalf of the Commission. 4 . Represents the Commission before the City Council. 5 . Performs other duties necessary or customary to the office. In the event of the absence of the Chairperson or his/her inability to act, the Vice Chairperson presides in place of the Chairperson. In the event of the absence of or the inability to act of both the Chairperson and the Vice Chairperson, the remaining members shall elect one of their members to act as temporary Chairperson. D. The Committees . The Commission or the Chairperson, upon direction of the Commission, may appoint several of its members, but fewer than a quorum, to serve as a Committee. On certain occasions, such as when a particular kind of expertise or public representation is desirable, the Commission may appoint non-members to the Committee. Committee ' s make recommendations directly to the Commission. A Committee may not represent the Commission before the Council or other bodies unless it has first received the authorization of the Commission to do so. VI . Meetings A. The Commission shall hold regular meetings at least once per month at a designated time and place which shall be fixed and determined by the Commission and entered upon its minutes. All meetings of the Commission shall be open to the public. Special meetings of the Commission may be called by a majority , of the members thereof, or by the Chairperson thereof. Notice of any such special meeting shall be given as required by law. B. A majority of the voting members of the Commission shall constitute a quorum for the purpose of transacting business . The secretary shall keep minutes of all regular and special meetings of the Commission, and these shall he sent to all members and administrative officers in advance of the meeting in which they are to be approved. VII . General Responsibilities of the Commission The Commission shall consider and make recommendations as it deems necessary to the City Council and to City Staff in all matters pertaining to the operation and maintenance of an effective, efficient, and adequate recreation service for the citizens of Dublin. Such recommendations would include, but are not limited to the following: recommendations for the development, improvement and/or modification of recreation services and facilities ; future recreation needs ; conduct of persons using recreation facilities ; rules for the use of recreation facilities by the public . VIII . Duties of Commission to be Advisory Only It is intended that the Commission shall be an advisory body to the City Council . Nothing herein contained shall be construed as a limitation on the power of the City Council or the Admiz,istrative Staff of the City or any other agency in their supervision, or authority over property or personnel which are under their respective jurisdictions . IX. Staff Assistance The City Manager shall provide the Commission with such information and Staff assistance as the Commission may, from time to time request, subject to the limitations imposed by the City Council. X. Amendments These Bylaws and Fules of Procedure may be amended in the same manner as originally adopted. Page 2 DOWNTOWN IMPROVEMENT COMMITTEE APPOINTMENTS At its meeting of April 8, 1985 , the City Council agreed to the concept of forming a blue ribbon .ad hoc downtown improvement committee, whose . purpose would be to assist in the development of a downtown plan. The City Council agreed that the committee would consist of 11 members and that each City Councilmember: would appoint a member from the business community within the designated downtown area, and a member from the. residential community. . The eleventh memb.er would be appointed by the Dublin Chamber of Commerce . The City Council agreed to ,officially make these appointments at its first meeting in May. The Chamber of Commerce has indicated that Mr. Jim Dougherty will represent the Dublin Chamber of Commerce on the downtown improvement committee. LIVERMORE-AMADOR VALLEY TRANSIT AUTHORITY JOINT EXERCISE OF POWERS AGREEMENT (JEPA) At its meeting of February 25 , 1985 , the City Council approved in concept , the Transit Authority Joint Exercise of Powers Agreement (JEPA) . Since that meeting, the City Council of Pleasanton approved the original agreement , and the City Council - of Livermore has adopted an agreement with revisions . The City of Pleasanton anticipates that the agreement with the Livermore revisions will be considered at its meeting of May 21 , 19$5 • Those revisions made by the Livermore City Council were reviewed and discussed . Mayor Snyder expressed concern as to why Livermore is treated differently with regard to its RIDEO program. Cm. Jeffery indicated that if the JEPA was not accepted at this meeting, it would have to go back to all the City Councils with recommended changes. On motion of Cm. Jeffery, seconded by Cm. Vonheeder, and by unanimous vote , the Council indicated its concurrence with the final Joint Exercise of Powers Agreement , and to proceed with contracting for services .
