HomeMy WebLinkAbout8.1 Candidate Statement and Cost n -y0 CITY OF DUBLIN AGENDA STATEMENT CITY COUNCIL MEETING DATE: July 14, 1986 SUBJECT General Municipal Election to be consolidated with 'the Statewide General Election to be held in the City of Dublin on Tuesday, November 4 , 1986 EXHIBITS ATTACHED Resolution calling election; Resolution adopting regulations for candidates & costs of candidate ' s statements RECOMMENDATIO Consider alternatives and Adopt Resolutions FINANCIAL STATEMENT: Budget and estimated election cost - $2, 500 DESCRIPTION On May 14 , 1984, by unanimous vote, the City Council adopted an ordinance consolidating the City Municipal Election with the Statewide General Election, to be held in November of even numbered years . The election will be held on Tuesday, November 4, 1986 . There will be three ( 3 ) City Council positions up for election. The first day for taking out and filing nomination papers will be July 14, 1986 . The last day to file nomination papers will be August 7 , 1986 if all incumbents file . If an incumbent does not file, the nomination period will be extended five ( 5 ) days . The City Council may determine whether the statement of qualifications which each candidate is allowed to place in the sample ballot should be a maximum of 200 or 400 words . Staff recommends the maximum of 200 words . The Alameda County Registrar of Voters Office has also recommended the 200 word maximum in order to maintain uniformity. The City Council may also determine whether the City or each candidate should pay for the costs associated with printing, translating and handling the Candidate ' s Statement . The estimate for the cost to a candidate for publishing his or her statement of qualifications is approximately $100 for a 200 word statement. It is Staff ' s recommendation that the City Council 1 ) determine whether the City or the candidates pay the costs, associated with the Candidate ' s Statement and 2 ) establish the 200 word length for Candidate ' s Statements . i ---------------------------------------------------------------------------- COPIES TO: ITEM NO. RESOLUTION NO. - 86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ************************** CALLING FOR A GENERAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF DUBLIN ON NOVEMBER 4, 1986; AND REQUESTING THE ALAMEDA COUNTY BOARD OF SUPERVISORS TO CONSOLIDATE THE CITY OF DUBLIN GENERAL MUNICIPAL ELECTION WITH -WHE STATEWIDE GENERAL ELECTION; AND AUTHORIZING CERTAIN PROCEDURAL ACTIONS THEREFOR WHEREAS, a General Municipal Election to be consolidated with the Statewide General Election is to be held on Tuesday, November 4 , 1986, in and for the City of Dublin; and WHEREAS, certain actions are required in connection with said election. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Dublin that the General Municipal Election to be held in the City of Dublin on November 4, 1986, is hereby called. BE IT FURTHER RESOLVED as follows : 1 . The Alameda County Board of Supervisors is requested to consolidate the City of Dublin General Municipal Election with the Statewide General Election. 2 . The Registrar of Voters of Alameda County is requested to perform services in connection with said election at the request of the City Clerk. 3 . The offices to be voted upon shall be three (3 ) City Councilmembers . 4 . The City Clerk is hereby directed to cause the posting, publication and printing of all notices or other election materials pursuant to the requirements of the Government Code of the State of California. 5 . The City Clerk is hereby directed to obtain printing, supplies and services as required. 6 . The City Clerk is hereby authorized to provide such other services and supplies in connection with said election as may be required by the statutes of the State of California. AYES : NOES : ABSENT: Mayor ATTEST: City Clerk RESOLUTION NO. - 86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ************************** ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATE' s STATEMENT AND THE COSTS THEREOF FOR THE GENERAL MUNICIPAL ELECTION TO BE CONSOLIDATED WITH THE STATEWIDE GENERAL . ELECTION TO BE HELD ON TUESDAY, NOVEMBER 4, 1986 WHEREAS, Section 10012 of the Elections Code of the State of California specifies that the local agency for that election shall determine whether a charge shall be levied against the candidate for the Candidate ' s Statement and whether or not the limitation on words for such statement shall be increased from 200 to 400 words; and WHEREAS, Section 10012 of the Elections Code of the State of California further provides that a written statement of the regulations with respect to charges for handling, packaging and mailing shall be provided to each candidate or his/her representative at the time the nomination papers are received. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby adopt the following regulations pertaining to the General Municipal Election to be held in the City of Dublin on November 4 , 1986 : Section 1 . Pursuant to Section 10012 of the Elections Code of the State of California, each candidate for elective office to be voted for at the General Municipal Election to be held in the -City of Dublin on November 4 , 1986, may prepare a candidate ' s statement on an appropriate form provided by the City Clerk. Such statement may include the name, age and occupation of the candidate and a brief description no more than 200 words, of the candidate ' s education and qualifications , expressed by the candidate himself or herself. Such statement shall not include the party affiliation of the candidate nor membership or activity in partisan political organizations . Such statement shall be filed in the Office of the Clerk at the time the candidate ' s nomination papers are filed. Such statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5 : 00 p.m. , of the next working day after the close of the nomination period. Section 2 . Spanish Language. That in compliance with amendments to the Federal Voting Rights Act of 1965 (Public Law 54-73 , August 6, 1975 ) , a Spanish translation of the candidate ' s statement shall be made available to anyone requesting the translations . Section 3 . Payment . The City Clerk shall estimate the total cost of printing, handling, translating and mailing the candidate ' s statement filed pursuant to the Elections Code, and require each candidate filing a statement to pay in advance his/her prorata share as a condition of having his/her statement included in the voter ' s. pamphlet. The City Clerk shall bill each candidate for any cost in excess of the deposit and shall refund any unused portion of any deposit. Section 4 . That the City Clerk shall provide each candidate or the candidate ' s representative a copy of this Resolution at the time nominating petitions are issued.
