Administration of the Building & Safety Department 2 . Plan Checking 3 . Building Inspection 4 . Housing Code Enforcement 5. Zoning Enforcement The City last evaluated this service in August, 1985. The purpose of this evaluation is to: 1) Review the performance of the contractor during the last year; 2) identify any areas where the service could be improved; 3), determine if the contract is still the most cost effective means of providing building and safety services . In 1984, the City adopted Building Law Enforcement Service Contract Evaluation Criteria. These criteria have been used as part of the evaluation process . A review of the Contractor' s performance during Fiscal Year 1985-86 follows : Contract Compliance Has Contractor complied with the conditions set forth in the Contract Agreement in the following areas? Revenue and costs comparisons particularly become skewed when permits for major projects are pulled during the latter part of the fiscal year as was the case in the three (3) previous fiscal years . As evidenced by the above figures, the fees charged by Taugher & Associates have remained within the building permit fee structure, which has not changed since incorporation. Contract vs . City- Building & Safety Services This year Staff evaluated the cost of providing Building & Safety Services with City employees . A discussion of the viability of this alternative follows : Assuming the City were able to hire a Building Official who had similar qualifications to Mr. Taugher, including registration as a Structural Engineer, the estimated costs (excluding overhead, i .e. personnel and finance administration) , is as follows : (1 ) Includes Administration (2) 11 months of contract service Page 3 • It is also important to recognize that there would be no back-up coverage to handle the Building Official or Building Inspector ' s duties in their absence under the City Employee Service Alternative, without incurring additional costs, except in the case of the Building Inspector 's duties, when there is more than one City Building Inspector. Taugher & Associates has historically provided back-up personnel as needed. If the City were to find contract personnel to provide back-up coverage, there would be additional costs for a Building Inspector (except where other employee hours available to provide back-up) as well as for the Building Official . As shown below, as a result of these additional costs for back-up coverage, the cost of the City Employee Provided Service would have exceeded the cost of the Contract Provided Service in every year with the exception of Fiscal Year 1986-87 in which an abnormally high level of construction activity is anticipated. This is particularly true during times in which construction activity is at an average or below average level . Based upon a review of the approved plans for building within the existing City and the time frame for anticipated development in the City ' s sphere areas, it is likely that the high level of construction activity will diminish after Fiscal Year 1987-88 for several years . Thus, one could conclude that the contract service will continue to be the most cost-effective means of providing Building & Safety Services after Fiscal Year 1987-88 and until the sphere areas begin to develop. 1987-88 Proposed Contract Taugher & Associates have proposed new rates for Fiscal Year 1987-88 as indicated in the January 8, 1987 memo from Vic Taugher . The proposed rates for the upcoming fiscal year are as follows : Proposed Rate Increase in Rate Building Official $ 70 . 00/hr $2 . 00/hr Building Inspector 43 . 75/hr 1 . 25/hr Zoning Investigator 37 . 50/hr 1 . 00/hr The proposed increase is 'slightly less than 3%, which Staff believes is reasonable . However, the Contractor has also proposed that the City once again assist in covering the liability insurance increases that the Contractor will incur . During Fiscal Year 1986-87, the Council agreed to cover a $12, 000 increase in the Contractor' s insurance rates in order that the Contractor could continue providing services . This year, the Contractor has requested that the City increase this subsidy to approximately $16, 000, should the Contractor' s insurance coverage premium increase to that amount . At this time, the Contractor has not received a firm premium quotation from the Contractor ' s Insurance Broker . Recommendation Based upon the overall quality and level of professionalism which has been provided by the Contractor, as well as the modest rate increase proposed for Fiscal Year 1987-88, it is Staff ' s recommendation that the City Council review the performance of the Contractor and approve an amendment to the Contractor ' s existing agreement for Fiscal Year 1987-88. Actual Actual Actual Budget 1983-84 1984-85 1985-86 1986-87 Hours Worked 1760 3520 3520 5280 Cost $ 49, 800 $ 99, 600 $ 99, 600 $149, 400 As evidenced above, the cost/hour of service is higher for contract service than service provided by City employees, but that does not necessarily mean that the contract is less cost effective than City employee provided services . This. is particularly true in years where the level of building activity is low. For example, in Fiscal Year 1983-84, the total contract costs for a 12 month period would have been approximately $100, 200 . If City employees were performing the service, the cost would have been approximately $113, 900 . One might argue with the City employee service alternative, the City Building Official would have 934 additional hours and the City Building Inspector an additional 160 hours when compared to the contract. However, because of the specialized nature of the services performed, this time would not necessarily be productive time without more construction activity. However, it is possible that more zoning enforcement could have taken place . (1 ) . Employee absences due to leave, holiday, training, etc . , have been deducted. (2 ) Since Mr. Taugher ' s contract only covered 11 months of Fiscal Year 1983-84, the hours worked and costs were adjusted to reflect 12 months for purposes of comparison. Page 4 . 4.,. The Building and Safety Department Business Office is open from 8: 00 a.m. - 5: 00 p .m. During this time, there is always someone available to handle permit applications and answer common building and safety questions . The office hours for the Building. Official and the Building Inspector are 8: 00 a.m. - 12: 00 noon and 8: 00 .a.m. - 10 : 00 a.m. respectively. Appointments can be made with the Building Official and Building Inspector to discuss more detailed and complex building issues . By scheduling office hour availability, the services of the Contractor can be effectively maximized and the costs to the City reduced. Although Staff has . not done a survey to determine whether these office hours are sufficient, the City has not received many complaints that office hours are insufficient. The Zoning Investigator ' s regular hours were 8: 00 a.m. - 4 : 00 p.m. Monday and Tuesday. However, these hours were expanded to 800 a.m. - 4 : 00 p.m. Monday - Thursday with the sign enforcement survey. With respect to the sign enforcement survey, the Council authorized a total of 420 hours for Fiscal Year 1985-86. The Building Official estimated that approximately 1, 000 signs remained to be reviewed as of December 31, 1986 and that 339 . 5 hours for the program had been expended. The Building Official has requested that the City authorize an additional 500 hours of zoning enforcement services at a cost of $18, 250, if the sign enforcement survey and notification is to be completed by June 30, 1987 . Responsiveness . Has Contractor processed plans, made inspections and responded to inquiries within a reasonable time? • • In Staff ' s view, the Contractor has performed in a timely manner most of the time. The City Manager has received an occasional complaint, but usually the complaint involved an applicant who wanted to obtain occupancy before all the work was completed and inspected. Interdepartmental Coordination Does the Contractor make an effort to work with other City Departments in the coordination of common projects? The Contractor meets on a regular basis with the management staff of the City to discuss common projects and to improve coordination of these projects . During 1986, Mr . Taugher taught numerous seminars for City Staff as part of the City' s "Brown Bag" Training Program. This has resulted in developing an improved level of knowledge for those individuals working in the Development Services Office who regularly handle counter and telephone inquiries . Public Relations Does Contractor ' s actions result in complaints regarding the professionalism or courtesy exercised by Contractor? Given the nature of the service provided and the broad range of people that the Department encounters, the overall public relations has been good. There have been a few occasions where courtesy has not been exercised when Building & Safety Staff have encountered a builder who may not have dealt in a straightforward and honest manner with the City. These infrequent occasions have been brought to the attention of Mr. Taugher for correction . Cost Effectiveness Are the cost of services managed effectively and kept within the revenue generated by the function? Is the Contract still the most cost effective means of providing building, and safety services? Page 2 • AGREEMENT P FOR BUILDING LAW ENFORCEMENT SERVICES THIS AGREEMENT is made and entered into this 1st day of August , 1983 , by and between the City of Dublin, a municipal corporation, hereinafter referred to as the "City" , and Taugher & Associates, an Individual, hereinafter referred to as the "Building Official" . W I T N E S S E T H WHEREAS, the Building Official has submitted to the City a proposal to provide building law enforcement services to the City; and WHEREAS, the City has determined that it is advantageous and in the best interest of the City to enter into the Agreement hereinafter set forth; NOW, THEREFORE, in consideration of the mutual promises, conditions and covenants herein contained, the parties agree as follows : 1. Building Inspection Services . Building Official shall enforce the provisions of the City' s Building, Electrical, Plumbing, Mechanical and Housing Codes ; the City ' s Zoning Ordinance; and related State laws . Building Official shall make such inspections and investigations as may be required to effect such enforcement and issue permits as are required by City' s Ordinances and Codes . Such enforcement shall include the duties as set forth in the Ordinance of the City for the Building Official and in the performance of such work, the employees of the Building Official .shall do the following: a. Plan Review. Building Official shall review the plans prepared by or on behalf of private developers for compliance with applicable State and City ordinances and regulations . Building Oficial shall maintain close liaison with the City' s Planning Director in order that the appropriate requirements of the Zoning Ordinance are incorporated within such building plans . Building Official shall arrange review by other appropriate agencies having 'jurisdiction in such matters relative to enforcement of fire codes, sanitation codes and health codes . When satisfied that the appropriate 'requirements of the City' s codes have been met, Building Official shall issue permits as set forth in such codes . b . Building Inspection. Building Official shall provide building inspection service during the course of construction of private facilities to enforce compliance with the provisions of the applicable State and City ordinances and regulations set forth on the plans for which the permit is issued. In the performance of such duties, Building Official shall provide prompt inspection for each project at the completion of the various stages of construction to determine compliance. c . Zoning Enforcement. Building Official shall provide enforcement of all aspects of the City' s Zoning Ordinance and will make all necessary investigations and follow-up inspections to assure compliance with the Zoning Ordinance and the conditions of approval of various variances, conditional use permits , site reviews and other zoning approvals. Enforcement will include . preparation of cases for citation hearings and criminal proceedings in municipal court. Building Official shall perform other activities as directed by the City. d. Housing Code Enforcement. Building Official shall enforce the City' s Housing Code by investigation of complaints regarding sub-standard housing conditions and where necessary, prepare cases for citation hearings, criminal proceedings in municipal court, and civil abatement proceedings . The City shall provide an office for conducting the duties set forth in this Agreement, and shall provide necessary furnishings, telephone, permit forms and codes . Within this office, Building Official shall assemble such records customarily maintained by a City Building Department. Such records shall, at all times, be the property of the City. 2 . Collection of Fees . All fees to be collected in connection with the carrying out of the functions set forth above, shall be collected by the City. Building Official shall review the appropriate ordinances and fee schedules in effect by the City, and shall compute the amount of such fees to be collected by the City. 3 . Compensation to Building Official . Building Official shall be compensated monthly for services rendered in accordance with the schedule contained on Exhibit "A" which is attached hereto. 4 . General Conditions . a. Avoidance of Conflicts . During the life of this Agreement, Building Official shall not provide services to any client for a project which requires any permit or approval from the City. b . Compliance with Laws . Building Official, his agents and employees, shall comply with all laws, ordinances, rules and regulations of the State, County, the City of Dublin, and all governing bodies having jurisdiction applying to work done or to be done under the Agreement. c . Insurance and Indemnification. Building Official shall assume liability and pay all costs of defense, including legal fees and court costs, and hold the City harmless from loss, damages , costs or expenses caused by any negligent or wrongful acts , errors, or omissions of Building Official ' s officers, employees and agents which may occur in the performance of the terms , duties and obligations of this Agreement. Building Official shall provide a certificate of insurance to the City, to be included as part of this Agreement, which will give evidence of general liability insurance of not less than $1, 000, 000 . 00 for personal injury, accidental death and property damage; and further provide to the City a Certificate of Insurance, which gives evidence of automobile liability insurance coverage of not less than $1, 000 , 000 . 00 for personal injury and accidental death, and $50, 000 . 00 for property danage per occurrence. City shall be named as an additional insured in any such liability insurance policy. Building Official shall pay all premiums for said insurance . Building Official shall also provide the City with a certificate of insurance, to be included as part of this Agreement, which will give evidence that Building Official ' s employees are covered by worker' s compensation insurance . All certificates of insurance which are a part of this Agreement shall be approved by the City Manager and City Attorney as to form and content . d. Assignability. Building Official shall not assign this contract without prior written consent of the City. e . Clerical Support . City agrees to provide adequate clerical support to the Building Department function as mutually agreed upon by City and Building Official . f . Subcontractor . The name, background and experience of any and every firm to which any work outlined in these specifications is to be sub-contracted by the person or firm to which the prime agreement is awarded must be submitted to the City Manager for his approval . Unless a sub-contract is approved by the City Manager, the holder of the prime agreement must do all the work outlined in these specifications , using his own equipment and personnel . It must be clearly understood that the holder of the prime agreement, Page 2 irrespective of any approved sub-contract, will be held entirely responsible for the quality and quantity of work to be done under the terms of the agreement. No sub-contract to do any work outlined in these specifications is to run longer than one year, and the extension or renewal of any such sub-contract agreement can only be made with the approval of the City Manager. The . agreement will not be assignable in whole or part, without the express written approval of the City Manager. 5 . • Responsible Individual. The individual directly responsible for the performance of the duties of Building Official as hereabove . set forth shall be Victor L. Taugher, a California Registered Civil Engineer, License #9556, and Fire Protection Engineer License #911. Upon mutual agreement and direction of the City Manager, Building Official may substitute other individuals in the above capacity as responsible individual. 6. Term of Agreement. a. Term of Agreement. This Agreement shall be effective until terminated. This Agreement may be cancelled by the City, upon thirty (30 ) days advance written notice. This Agreement may be cancelled by Building Official upon ninety (90) days advance written notice. b. Notices . The rates will be adjusted thereafter annually, as mutually agreed upon by the Building Official and the City. In the event that Building Official is requested to perform services in excess of forty (40 ) hours in any one (1) week, or in the event that there is an emergency requirement for the services of the Building Official and the City is reimbursed for said services, Building Official shall be compensated at 1-1/2 times the above hourly rates . Standard rates will apply for Building Official ' s attendance at Planning Commission and City Council meetings . * Supervision duties include review and coordination of work performed by inspectors and clerical support staff. Administrative duties include Council and Commission meeting attendance when requested, meeting with applicants and developers, interagency coordination and coordination with Staff, development of office procedures, operations, etc . • • Page 4 • • .AMENDMENT TO AGREEMENT BETWEEN • - CITY OF DUBLIN AND TAUGHER and ASSOCIATES, INC. • • FOR BUILDING LAW ENFORCEMENT SERVICES WHEREAS, the City of Dublin (hereinafter referred to as "CITY") , and Taugher and Associates, Inc. (hereinafter referred to as "BUILDING OFFICIAL" ) , first entered •into . an Agreement on August 1, 1983 to provide Building Law Enforcement Services to the -City of Dublin; and WHEREAS, the .fees established in Exhibit A of the original agreement were to be annually reviewed and adjusted as mutually ' agreed upon by the Building Official and the City; and WHEREAS, an adjustment of fees for services has been made by the City on an annual basis in the past; . and • WHEREAS, the City wishes to continue contracting for services from Building Official; and WHEREAS, an adjustment of fees for services rendered is desired by both the City and Building Official. ' NOW, THEREFORE, the parties hereto agree as follows: SECTION I. ADJUSTMENT OF RATES The Taugher and Associates hourly rate schedule (Exhibit A) shall replace the rate schedule which was adopted by the City Council ' and became effective. August 1, 1985. The change in rate shall be effective September 1, 1986 and shall continue in effect until rescinded or amended by the City Council, according to the provisions of the agreement. Proposed Rates It is proposed that the basic rates for inspection services be increased as follows: Current Rate Proposed Rate Building Official $68.00 $70.00 Building Inspection 42.50 43.75 Zoning Investigation 36.50 37.50 The proposed increase is slightly under 3%. It should be noted that the current and proposed rates do- not in- clude the surcharge to cover insurance costs . B. Insurance I have discussed the insurance rates with my broker. It is too early to obtain definite information as to rates for next year. The best estimate at this time is that the increase would approximate last year ' s increase which was approximately 40%. This would translate to $16, 000. A surcharge in hourly rates to cover the $12,000 increase in 1986-87 and the 1987-88 increase is proposed. . 1 � :i C. Staffing levels Staffing levels projected for •next year are as follows: Building Official 1200 hours Building Inspector 3600 hours Zoning Investigator 720 hours. Staffing for 1986-87 was based on one full time Inspector at 200 hours per month and one half time inspector, at 100 hours per month. The building official was 100 hours per month. The Zoning investigator was 60 hours per month plus an additional 420 hours for the sign enforcement program. Construction projects which were anticipated for 1986-87 • have been delayed so that the additional •part time - building inspector was not required at thistime. This position will probably be filled at the end of the rainy season. After these projects are completed it is anticipated that new, construction activity will decline substantially although alterations, additionsand tenant improvement work will continue at a relatively even pace. . Based upon the probability of reduced new construction activity, plan checking services will probably de cline. However, . in 1987-88 1200 hours are projected for the Building Official because the new City :Hall may - require additional hours for the Building Official. When -Alamo Creek Villages 2 & 6 construction begins- to roll it is anticipated that a part time inspector will be added.. This position will be needed through 1987-88. Th-us 3600 hours are projected for the Building Inspector position. 720 hours are projected for the Zoning Investigator. This assumes the sign program will be completed and the levelof ZoningEnforcement will remain •atthe present level. D. Changes in Work Methods If the ordinance for changing v iolations from misdemeanors to infractions is approved , the enforcement procedures will be streamlined . If the city acquires a central computer, an automated land information and per- mit information system will be proposed. This would not be implemented before 1988-89. 3 2. Contract review Additional information requested is provided as follows: A. Productivity It is believed that setting up a separate zoning , l enforcement position has allowed the building inspector to devote full time to building inspection . At the same time the zoning investigator concentrated on zoning enforcement. In addition to the above factor, the hours in the field have increased thus increasing the inspections per day. B. Sign Program The sign program is well underway. Forms and procedures have been developed. The City, Council has approved a time period for removal of illegal signs. All the signs in the City have been photographed. Statistical data has been gathered" from two areas. This data is the basis of these projections. The first area includes the commercial properties fronting on San Ramon Road and the commercial properties fronting on Dublin Blvd. west of San Ramon Road. The second area includes properties east of San Ramon Road' and properties fronting on Regional St. San Ramon Rd. The contract cost per investigation is down substantially. The number of investigations and cases closed is up substantially and the number of pending cases is reduced. In addition, a survey of existing signs has just commenced. The Housing Code Enforcement activity is minimal and has been combined under building regulation. During the past year,• -the following specific items have been accomplished: 1. An ordinance requiring additional electrical outlets in office buildings was prepared and adopted. 2 . Revisions to the County ordinance codes relating to house numbering and swimming pool fencing has been prepared and will be presented to the City Council soon. 3 . An ordinance relating to issuance of citations for building and zoning violations along with the necessary procedures -is being prepared. 4 . The Nichandros abatement is slowly being completed. In closing I want to express my appreciation to you and the City Council for the support received.
