Foss, City Manager " SUBJECT: Acceptance of Tract Improvements and Approval of Regulatory Traffic Control Devices for Tracts 7943, 8069 and 8070, Emerald Vista (KB Home Arroyo Vista, LLC) Prepared by Jayson Imai, Senior Civil Engineer EXECUTIVE SUMMARY: KB Home Arroyo Vista, LLC (KB Home) has constructed the improvements for Tracts 7943, 8069 and 8070, Emerald Vista, in accordance with the Tract Improvement Agreements for the respective tracts. It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. FINANCIAL IMPACT: KB Home has provided Warranty Bonds (Bond Nos. SU1110292-M, 1102793, and 1102494) in the amounts of $996,650.00 (issued by Arch Insurance Company), $136,750.00 and $145,250.00 (both issued by Lexon Insurance Company) to guarantee, for one year, the public and private improvements associated with Tracts 7943, 8069 and 8070, respectively. Upon acceptance of the improvements, the City will incur annualized maintenance costs estimated to be $22,772.00 for street sweeping and street lighting (monthly), slurry seal (every five years) and asphalt concrete pavement overlay (every 20 years). RECOMMENDATION: Staff recommends that the City Council adopt the Resolution Accepting the Improvements and Approving the Regulatory Traffic Control Devices for Tract 7943, Tract 8069 and Tract 8070, Emerald Vista. "ubmitted By Reviewed By Public Works Director Assistant City Manager DESCRIPTION: Pagel of 4 ITEM NO. 4.10 The Final Map for Tract 7943 (Attachment 1) created large-lot parcels which have subsequently been subdivided with Tracts 8069 and 8070 (Attachments 2 and 3) to create a community of 378 residential units. The total project, originally named Arroyo Vista but later renamed as Emerald Vista, consists of 198 market rate and 180 affordable units. KB Home Arroyo Vista, LLC (KB Home) entered into a Tract Improvement Agreement for Tract 7943 with the City of Dublin on May 3, 2011 for the construction of street and other tract improvements for Emerald Vista. These improvements included construction of Monterey Way, South Mariposa Lane, South Mariposa Court, North Mariposa Lane, North Mariposa Court, Mariposa Circle, Ventura Way and improvements on Dougherty Road. KB Home subsequently entered into Tract Improvement Agreements for Tract 8069 and Tract 8070 with the City of Dublin on January 17, 2012, for the construction of street and other tract improvements associated with the respective tracts. These improvements included construction of the private streets internal to Tract 8069 and Tract 8070. KB Home provided Faithful Performance Bonds and Labor & Materials Bonds to guarantee construction of the tract improvements for Tracts 7943, 8069 and 8070. The tract improvements are now complete and the developer is requesting that the bonds for this work be released. The warranty bond amounts are equal to twenty five percent (25%) of the full cost of completion of the respective improvements. Page 2 of 4 Because the landscape improvements originally bonded for with Tracts 8069 and 8070 are limited to private areas internal to the respective tracts, the City will not require KB Home to provide Warranty Bonds to guarantee the landscape improvements installed with Tracts 8069 and 8070. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. "STOP" signs and markings installed at the following intersections: • On Monterey way at Dougherty Road. • On Monterey Way at South Mariposa Lane. • On South Mariposa Court at Monterey Way. • On South Mariposa Lane at Monterey Way. • On South Mariposa Lane at Mariposa Circle. • On Mariposa Circle at South Mariposa Lane. • On Ventura Way at Dougherty Road. • On Ventura Way at North Mariposa Lane. • On North Mariposa Lane at Ventura Way. • On North Mariposa Court at Ventura Way. The tract improvements for Tract 7943, Tract 8069 and Tract 8070 are hereby approved and accepted subject to a one-year guarantee period. 2. The private landscape improvements for Tract 8069 and Tract 8070 are hereby approved. 3. The submitted Warranty Bond issued by Arch Insurance Company in the amount of $966,500.00 (Bond No. SU1110292-M) for the tract improvements for Tract 7943 be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 21st day of July, 2016. 4. The original Faithful Performance Bond (Bond No. SU1110292) in the amount of $3,866,000.00 for the Tract 7943 public tract improvements be released. 5. The original Labor and Materials Bond (Bond No. SU1110292) in the amount of $3,866,000.00 for the Tract 7943 public improvements be released in accordance with the requirements of Section 66499.7 of the Government Code of the State of California. 6. The submitted Warranty Bond issued by Lexon insurance Company in the amount of $136,750.00 (Bond No. 1102493) for the tract improvements for Tract 8069 be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 22nd day of July, 2016. 7. The original Faithful Performance Bond (Bond No. 5040282) in the amount of $547,000.00 for the Tract 8069 improvements be released. 8. The original Labor and Materials Bond (Bond No. 5040282) in the amount of $547,000.00 for the Tract 8069 improvements be released in accordance with the requirements of Section 66499.7 of the Government Code of the State of California. 2 9. The traffic regulatory devices installed by the developer within the development are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: A.
