Foss, City Manager " SUBJECT: Acceptance of Tract Improvements and Approval of Regulatory Traffic Control Devices for Tract 6765, Schaefer Ranch Unit 1 Phase 2 (Schaefer Ranch Holdings, LLC) Prepared by Jayson Imai, Senior Civil Engineer EXECUTIVE SUMMARY: Schaefer Ranch Holdings, LLC has constructed the improvements for Tract 6765, Schaefer Ranch Unit 1 Phase 2 in accordance with their Tract Improvement Agreement. It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. FINANCIAL IMPACT: Schaefer Ranch Holdings, LLC, has provided a Maintenance Bond (Bond No. 104757058-W) in the amount of $3,293,775.00, issued by Travelers Casualty and Surety Company of America, to guarantee the improvements associated with Tract 6765, Schaefer Ranch Unit 1 Phase 2 for one year. Upon acceptance of the Tract 6765 improvements, the City will incur annualized maintenance costs estimated to be $119,246 for street sweeping and street lighting (monthly), slurry seal (every five years) and asphalt concrete pavement overlay (every 20 years). RECOMMENDATION: Staff recommends that the City Council adopt the Resolution Accepting the Improvements and Approving the Regulatory Traffic Control Devices for Tract 6765, Schaefer Ranch Unit 1 Phase 2. ubmitte` By Reviewed By Public Works Director Assistant City Manager DESCRIPTION: Schaefer Ranch Holdings, LLC, entered into a Tract Improvement Agreement with the City of Dublin on February 20, 2007 for the construction of street and other tract improvements Page 1 of 4 ITEM NO. 4.8 associated with Tract 6765, Schaefer Ranch Unit 1 Phase 2. These improvements included construction of all streets internal to Tract 6765 as well as the extension of Dublin Boulevard west of Schaefer Ranch Road. The improvements also included certain improvements within parcels designated for future transfer to the Schaefer Ranch Geologic Hazard Abatement District (CHAD). In addition, as part of Tract 6765 Schaefer Ranch Unit 1 Phase 2, Schaefer Ranch Holdings, LLC constructed and dedicated a regional trail to the East Bay Regional Park District (EBRPD). In order to ensure that the trail improvements were completed, EBRPD requested that the work be included and guaranteed with the Tract 6765 Unit 1 Phase 2 improvements. Schaefer Ranch Holdings, LLC, provided a Faithful Performance Bond and a Labor & Materials Bond to guarantee construction of the tract improvements, GHAD improvements and EBRPD trail improvements associated with Tract 6765 Unit 1 Phase 2. In March 2009, because Schaefer Ranch Holdings, LLC, had completed approximately 80% of required improvements, City Council approved the partial release of the Faithful Performance Bond to an amount equal to twenty five percent (25%) of the original bond amount, or $3,293,775.00. Landscape Improvements within Tract 6765 Schaefer Ranch Unit 1 Phase 2 were governed by a separate Improvement Agreement executed on February 20, 2007. City Council previously accepted these landscape improvements on July 17, 2012 (City Council Resolution No. 127-12). Per the Plan of Control for the Schaefer Ranch CHAD, before Schaefer Ranch Holdings, LLC could transfer the GHAD parcels and the management and maintenance requirements of those parcels to the Schaefer Ranch CHAD, the improvements required to be constructed within the GHAD parcels had to be formally accepted by the City. In October 2013, City Council accepted the improvements in the GHAD parcels subject to a one-year warranty period. At that time, the Decreased Rider for the Faithful Performance and Labor & Materials Bonds approved in March 2009, each in the amount of $3,293,775.00 remained in place to guarantee construction of the remaining improvements for Schaefer Ranch Unit 1 Phase 2. Schaefer Ranch Holdings, LLC has completed construction of the remaining tract improvements associated with Tract 6765 Schaefer Ranch Unit 1 Phase 2. In addition, Schaefer Ranch Holdings has entered into a separate Agreement with EBRPD for completion of the remaining trail improvements. A copy of the letter Agreement between EBRPD and Schaefer Ranch Holdings, LLC dated October 15, 2013 is attached as Attachment 3. Schaefer Ranch Holdings, LLC is now requesting that the bonds associated with Tract 6765, Schaefer Ranch Unit 1 Phase 2 be released. The bond amount is equal to twenty five percent (25%) of the full cost of completion of the improvements. In accepting the completed improvements, the following regulatory traffic control devices will also be accepted, approved, and added to the City of Dublin Traffic Code: A. The tract improvements for Tract 6765, Schaefer Ranch Unit 1 Phase 2 are hereby approved and accepted, subject to a one-year guarantee period. 1 2. The submitted Maintenance Bond issued by Travelers Casualty and Surety Company of America (Bond No. 104757058-W) in the amount of $3,293,775.00 for the Tract 6765 Schaefer Ranch Unit 1 Phase 2 improvements be accepted as security for the aforesaid one-year warranty period, said period to commence on this date and terminate on the 21St day of July, 2016. 3. The original Faithful Performance Bond issued by Travelers Casualty and Surety Company of America (Bond No. 104757058 with bond reduction rider) in the amount of $13,175,100 for the Tract 6765 Schaefer Ranch Unit 1 Phase 2 improvements be released. 4. The original Labor and Materials Bond issued by Travelers Casualty and Surety Company of America (Bond No. 104757058 with bond reduction rider) in the amount of $13,175,100 for the Tract 6765 Schaefer Ranch Unit 1 Phase 2 improvements be released in accordance with the requirements of §66499.7 of the Government Code of the State of California. 5. The traffic regulatory devices installed by the developer within the development are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: A. Re: DUBLIN HILLS REGIONAL OPEN SPACE Schaefer Ranch Tract loo, 6765, Dublin, CA Dear Mr. Chen: As we discussed, Schaefer Ranch Holdings, LLC (Schaefer), as Grantor of the Grant of Emergency Vehicle and Maintenance Access Easement and Recreational Trail Easement (the "Trail"), which is within Parcel H, has agreed to make certain improvements to the Trail prior to its acceptance by the East Bay Regional Park District (District), as Grantee. The improvements required to complete the Trail to the satisfaction of the District are as follows: •- Install up to five (5) directional Trail posts as provided by District at locations as designated by District; - Add up to 40 feet of split rail fencing in two areas designated by District to delineate the Trail, keep trail users away from drainage ditch adjacent to the Trail, and protect the adjacent hillside and utility box (as shown can the attached); Install up to five (5) general information signs along the Trail as directed by District; and M Treat entire Trail alignment with weed abatement in the area from Dublin Boulevard to 1-580 freeway underpass.
