HomeMy WebLinkAbout05-26-2015 PC Minutes 0-** Planning Commission Minutes Tuesday, May 26, 2015 CALL TO ORDER/ROLL CALL A regular meeting of the City of Dublin Planning Commission was held on Tuesday, May 26, 2015, in the City Council Chambers located at 100 Civic Plaza. Chair Goel called the meeting to order at 7:00 p.m. Present: Chair Goel; Vice Chair Kohli; Commissioners Do and Bhuthimethee; Jeff Baker, Assistant Community Development Director; Lauren Quint, City Attorney; Martha Aja, Environmental Coordinator; and Debra LeClair, Recording Secretary. Absent: Cm. Mittan ADDITIONS OR REVISIONS TO THE AGENDA — NONE MINUTES OF PREVIOUS MEETINGS — On a motion by Cm. Bhuthimethee and seconded by Cm. Do, on a vote of 4-0, with Cm. Mittan being absent, the Planning Commission unanimously approved the minutes of the May 12, 2015 meeting. ORAL COMMUNICATIONS — NONE CONSENT CALENDAR — NONE WRITTEN COMMUNICATIONS — NONE PUBLIC HEARINGS — 8.1 PLPA-2010-00017 Amendments to Dublin Zoning Ordinance Chapter 8.08 (Definitions) and Chapter 8.12 (Zoning Districts and Permitted Uses of Land) Martha Aja, Environmental Coordinator, presented the project as outlined in the Staff Report. Cm. Do asked if anyone expressed opposition to the ordinance at the outreach meeting. Ms. Aja answered that no one spoke in opposition at the outreach meeting. Cm. Bhuthimethee asked for an explanation of the C-1, C-2 and C-N zoning designations. Jeff Baker, Assistant Community Development Director, described the commercial zoning districts. Cm. Bhuthimethee stated that the City is adopting and modifying its code based on current State law which has given cities the ability to further regulate massage establishments. She asked if the City will adopt more regulations. Ms. Aja answered that State law gives cities a variety of options. Dublin has opted to require state certification for all massage therapists and require that all massage establishments apply for a City permit. She stated that current State law gives cities more authority to regulate massage establishments and it is up to each individual agency to choose what's best for their community. Cm. Bhuthimethee asked if State law allows massage establishments to open by right or if that is a decision for the City. Ms. Aja answered that, if the City chose to, they could continue to require a Conditional Use Permit for massage establishments but Staff from Community Development, Police Services and the City Attorney's office have prepared amendments to Chapter 4.20 that would create a variety of operating requirements in place of a CUP. Mr. Baker added that the proposed Zoning Code would allow massage establishments by right, if certain standards are met. The standards that are proposed for Chapter 4.20 are items that would have been covered by a CUP, and therefore a CUP would be redundant. Cm. Bhuthimethee asked how many massage establishments are located in Dublin. Ms. Aja answered that there are approximately 30 massage establishments, but some only have one person. Cm. Kohli asked if any of the massage establishments are home based and asked how that would work under the State law. Ms. Aja answered that a home massage establishment, where the therapist would go to a client's home to do massage, is considered "outcall" and is prohibited by the City Ordinance. She stated that all existing massage establishments are located within commercial areas. Cm. Kohli asked if there is an appeal process if Police Services rejected a permit application. Ms. Aja answered yes; the decision would be appealed to the City Manager's office and a hearing would be held. Chair Goel opened the public hearing and, having no speakers, closed the public hearing. Cm. Bhuthimethee felt that Staff did a good job in creating the massage establishment process and was in support of the ordinance. Cm. Kohli also felt that Staff did a good job and stated that he is in support of the ordinance. Cm. Do stated that she is in support of the ordinance and felt that it will help regulate massage therapists and ensure that there is no illicit activities in the City of Dublin. On a motion by Cm. Do and seconded by Cm. Bhuthimethee, on a vote of 4-0, with Cm.
