Draft Minutes of the April 21, 2015 Regular City Council Meeting Page 1 of 1 ITEM NO. 4.1 MINUTES OF THE CITY COUNCIL OF THE CITY OF DUBLIN N REGULAR MEETING —APRIL 21, 2015 A regular meeting of the Dublin City Council was held on Tuesday, April 21, 2015, in the City Council Chambers of the Dublin Civic Center. The meeting was called to order at 7:00 p.m., by Mayor Haubert. ROLL CALL PRESENT: Councilmembers Biddle, Gupta, Hart, Wehrenberg, and Mayor Haubert ABSENT: None PLEDGE OF ALLEGIANCE The pledge of allegiance to the flag was recited by the City Council, Staff and those present. ORAL COMMUNICATIONS 7:01 p.m. 3.1 St. Patrick's Day Celebration Event Recap and Acceptance of Gifts to City from Event Sponsors The City Council recognized the sponsors and formally accepted the contributions. Gupta and by unanimous vote, the City Council took the following actions: Approved 4.1 Minutes of the April 7, 2015 Regular City Council Meeting. Received 4.2 the Payment Issuance Report and Electronic Funds Transfers. Adopted 4.3 RESOLUTION NO. 48 - 15 ACCEPTING THE TRACT IMPROVEMENTS, APPROVING THE TRAFFIC SIGNAL MODIFICATIONS AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES INSTALLED WITH TRACT 8093, BRANNIGAN SUBDIVISION Adopted 4.4 RESOLUTION NO. 49 - 15 ACCEPTING THE TRACT IMPROVEMENTS AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES INSTALLED WITH TRACT 7282, SONATA Adopted 4.5 RESOLUTION NO. 50 - 15 APPROVING AN AMENDMENT TO THE AGREEMENT WITH DAHLIN GROUP ARCHITECTS FOR ADDITIONAL DESIGN SERVICES FOR THE PUBLIC SAFETY COMPLEX AND MAINTENANCE YARD FACILITIES Adopted 4.6 RESOLUTION NO. 51 - 15 AMENDING THE CLASSIFICATION PLAN FOR TEMPORARY PART-TIME PERSONNEL RESOLUTION NO. 52 - 15 AMENDING THE SALARY PLAN FOR TEMPORARY PART-TIME PERSONNEL Approved 4.7 the proclamation declaring the month of May as "Bike Month" and May 14, 2015 as "Bike to Work Day" in the City of Dublin. DUBLIN CITY COUNCIL MINUTES 2 VOLUME 34 s REGULAR MEETING APRIL 21, 2015 ���° Continued (4.8), by motion as required by Government Code Section 8630(c), which states that the City Council shall review the need for continuing a local emergency at least once every 30 days until the governing body terminates the local emergency, the State of Emergency that was declared on March 18, 2014, based on the fact that extreme drought conditions continue to exist within both the State of California and the City of Dublin, and the threat to the safety and welfare of Dublin residents remains. Approved 4.9 the Budget Change to install public accessible Wi-Fi in the Downtown Dublin Specific Plan Area. Adopted 4.10 RESOLUTION NO. 53 - 15 AUTHORIZING STAFF TO PROCURE FOUR UNMARKED POLICE VEHICLES FROM THE FORD STORE SAN LEANDRO and approved the budget change. WRITTEN COMMUNICATIONS — None. PUBLIC HEARINGS The Green Mixed Use Project — General Plan and Eastern Dublin Specific Plan Amendment, Planned Development Rezone with related Stage 1 and Stage 2 Development Plan, Site Development Review (Commercial Buildings only), Vesting Tentative Map, Development Agreement, and Supplemental Environmental Impact Report (PLPA-2013-00013) 7:04 p.m. 6.1 Staff presented the Staff Report and responded to City Council questions. Mayor Haubert opened the public hearing. Jerry Hunt, the applicant, provided comment on this item. DUBLIN CITY COUNCIL MINUTES 4 VOLUME 34 s REGULAR MEETING APRIL 21, 2015 ���° Marlene Massetti, Dublin resident, provided public comment on this item. Dr. Ashish Paralkan, Dublin resident, provided written comment on this item. Mayor Haubert closed the public hearing. On motion of Cm. Hart, seconded by Vm. Gupta and by majority vote, (Mayor Haubert, Vm. Gupta, and Cm. Hart voting yes), the motion to deny the request passed. UNFINISHED BUSINESS Community Facilities District Formation 11:26 p.m. 7.1 Cm. Hart stated: "I have voiced my feelings early on about the prospect of CFD formation at Dublin Crossing. Philosophically speaking, I oppose increasing taxes to pay for infrastructure that a developer would otherwise be required to install. However I understand that a CFD provides a mechanism that — in a perfect world — allows the homebuyer to finance the infrastructure that isn't there yet, while increasing their home's worth as those improvements go in. And theoretically the CFD home prices are then lower than the prices in non-CFD areas, where the infrastructure is already in place and the assessed values reflect that. Fortunately the City's housing market is healthy for a variety of factors: the high performance of local schools, the availability of new homes, proximity developments to public transit -- and that is the kind of market that supports a CFD in a way that is fair. A more competitive market will keep those prices in check. I would just emphasize the importance of full disclosure of the special tax levy to the prospective homeowners in Dublin Crossing. With those things in mind, and with the additional community benefit payment to the City that can then be used to the greater good of the entire community, I am going to approve the CFD formation." On motion of Cm. Hart, seconded by Cm. Wehrenberg and by unanimous vote, the City Council continued the process to create a Community Facilities District under the Mello-Roos Community Facilities District Act of 1982, to be designated City of Dublin Community Facilities District No. 08-1 (Dublin Crossing), and adopted RESOLUTION NO. 54 - 15 DUBLIN CITY COUNCIL MINUTES 5 VOLUME 34 s REGULAR MEETING APRIL 21, 2015 ���° APPROVING BOUNDARY MAP COMMUNITY FACILITIES DISTRICT NO. 2015-1 (DUBLIN CROSSING) RESOLUTION NO. 56 - 15 INTENTION TO ESTABLISH A COMMUNITY FACILITIES DISTRICT, TO DESIGNATE FUTURE ANNEXATION AREA, AND SUBJECT TO THE REQUIRED VOTER APPROVAL, TO AUTHORIZE LEVY OF A SPECIAL TAX AND ISSUANCE AND SALE OF SPECIAL TAX BONDS COMMUNITY FACILITIES DISTRICT NO. 2015-1 (DUBLIN CROSSING) RESOLUTION NO. 55 - 15 DECLARING INTENTION TO INCUR INDEBTEDNESS COMMUNITY FACILITIES DISTRICT NO. 2015-1 (DUBLIN CROSSING) Rejection of Bids for Fallon Sports Park Phase II - Contract 14-15 11:36 p.m. 7.2 On motion of Cm. Hart, seconded by Mayor Haubert and by unanimous vote, the City Council adopted RESOLUTION NO. 57 - 15 RESOLUTION REJECTING ALL BIDS FOR THE FALLON SPORTS PARK PHASE II PROJECT, CONTRACT NO. 14-15 and directed Staff to rebid the project in late 2015.
