BACKGROUND: At its meeting of January 16, 2001, the City Council appointed Vice
Mayor Lockhart and Councilmember McCormick to an Ad Hoc Committee whose purpose was to meet
with representatives of Alameda County to discuss the City' s concems with respect to the proposed
Juvenile Justice Facility on the Santa Rita property.
On January 25, 2001, the City' s Ad Hoc Committee, the City Manager, and the Community Development
Director met with representatives from Alameda County including Supervisor Scott Haggerty, Supervisor
Nate Miley, County Administrator, Assistant County Administrator, General Services Agency Director,
and the County Community Development Director.
At the meeting, the County discussed its plans for the County governmental site on the Santa Rita
property, which is located immediately north of Gleason Drive. The County indicated that it planned a
Juvenile Justice Facility, a courthouse and other County offices. The County indicated its intention to
initiate the Environmental Notice of Preparation for the Santa Rita site in February 2001 and have the
Juvenile Justice Facility completed by the winter of 2004-2005. The County also discussed the site
selection process for the Juvenile Justice Facility and its reasons for selecting the proposed location. At
the meeting, the County had indicated that they did not do an exhaustive search of sites throughout the
County; however, they had looked at a several sites and concluded that the Santa Rita site was the only
site that could be developed in a timely manner, in order that the County might avail itself of grant
funding from the State. The County also discussed the difficulties of expanding the existing Juvenile
Justice Facility site in San Leandro due to geological concems.
The City representatives discussed a number of issues with the County that are included in Attachment 4
of this agenda report. City representatives discussed the feasibility of selling some of the County
Governmental Center property for private use in order to generate additional funds for the County to use
toward a Juvenile Justice Facility; however, the County did not seem to feel this was feasible or desirable.
Although Boardmember Nate Miley indicated that the selection of the Dublin site was preliminary and
that the County would work with Dublin to evaluate other logical sites, it was apparent that from the
balance of the discussion from the remaining County representatives that the Santa Rita site was the site
that the County was going to pursue and there was little encouragement given to the City' s concems about
the appropriateness of this site, the impacts on families who might have to travel long distances to visit
incarcerated youth, or the reasonableness of locating the facility far from the approximately 90% of the
users in North and Central County. The County representatives did indicate they would work with the
City on the Santa Rita site to make it more compatible to adjacent residential and commercial areas. At
the conclusion of the meeting, it was agreed that there should be continued dialogue between the County
and the City regarding the development of the County Governmental Center and the Juvenile Justice
Facility.
Ad Hoc Committee's Recommendation
It is the belief of the Ad Hoc Committee that the Board of Supervisors' intention is to continue to pursue
the development of the Santa Rita location for a Juvenile Justice Facility. The Ad Hoc Committee
representatives would recommend that the Council give consideration to adamantly opposing the location
of the County Juvenile Justice Facility .on the Santa Rita property. This recommendation is based upon
the following:

The City of Dublin should not be the sole location for the preponderance of incarceration facilities in
the County. The City already has a Federal jail, Federal prison, and County jail facility within the
City' s boundaries.
The location of the Juvenile Justice Facility creates a serious impact on the families of youth
incarcerated within the facility. Most of the youth that will be located in this facility live in
communities a great distance from the facility, and this will result in a significant financial and
transportation impact on the families of those youth. In addition, the youth are removed further from
various support groups that can assist these youths in returning to society.
There would be an impact on Police Departments throughout the County who would need to travel to
the east end of the County to testify regarding matters involving juvenile cases, as well as transporting
juveniles long distances. This will create a greater cost to local Police Departments than a more
central location in the County would create.
The Committee has concems that the facility proposed by the County is not compatible with adjacent
development that the County had petitioned the City for,' and the City has approved. The proposed
facility will be in close proximity to residential neighborhoods.
The Ad Hoc Committee strongly believes that the County should evaluate other sites throughout the
County that are more suitable than the Santa Rim site. In the meantime, the Ad Hoc Committee
recommends that the City Council adopt a resolution opposing the location of a County Justice Facility on
the Santa Rita site at Gleason Road and Amold Drive, and recommends that the Council authorize a letter
to be sent to the California Board of Corrections in opposition to the County's grant application for
construction of the Juvenile Justice Facility by Alameda County at this location.
It is the Ad Hoc Committee' s hope that this action on the part of the Council will prompt serious discuss
with the County Board of Supervisors regarding identifying a new site for the Juvenile Justice Facility
outside of the City. The Ad Hoc Committee will continue with discussions with representatives from the
County to that end unless the Council provides different direction.

RESOLUTION NO. - 01
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN
OPPOSING THE LOCATION OF A COUNTY JUVENILE JUSTICE FACILITY ON
THE SANTA RITA SITE AT GLEASON ROAD AND ARNOLD DRIVE
BY THE COUNTY OF ALAMEDA AND AUTHORIZING A LETTER TO BE SENT
TO THE CALIFORNIA BOARD OF CORRECTIONS IN OPPOSITION
TO A GRANT APPLICATION FOR CONSTRUCTION OF THE JUVENILE
FACILITY BY ALAMEDA COUNTY
WHEREAS, the County of Alameda is proposing to locate a new County Juvenile Justice
Facility at the Santa Rita Governmental site at Gleason Road and Arnold Drive; and
WHEREAS, the Alameda County Board of Supervisors approved on December 19, 2000 the
location of this new facility on the site mentioned above; and
WHEREAS, the Alameda County Board of Supervisors approved on January 23, 2001 the
filing of an application for funding to the California Board 'of Corrections for the County Juvenile
Justice Facility; and
WHEREAS, the City of Dublin staff met with the County Administrative staff to gather
information about this proposed action on January 10, 2001; and
WHEREAS, the City Council at its January 16, 2001 meeting appointed an Ad Hoc
Committee of Cm. Lockhart and Cm. McCormick to meet with members of the Board of Supervisors
to discuss the proposed County Juvenile Facility; and
WHEREAS, the Ad Hoc Committee has reported to the City Council that, based on its initial
information, it has significant concerns regarding the impacts of the proposed facility on the City of
Dublin, if it is located at this site; and
WHEREAS, this action by the Board of Supervisors to locate the County Juvenile Justice
Facility at this location may cause significant impacts on adjacent Dublin Residential and
Commercial/Industrial neighborhoods, which impacts have not yet been adequately investigated or
· addressed by the County; and
WHEREAS, this new facility at this location may not provide safe and nurturing environments
to those youths in County care while striving to keep their 'families intact because of the financial and
transportation impacts caused by the distance of the proposed facility from family and support groups;
and
WHEREAS, the City of Dublin is concemed that the peripheral location of the proposed
facility may negatively impact the efficiency of police transportation and operations in the County.

NOW, THEREFORE, BE IT RESOLVED that the City of Dublin City Council does hereby
oppose the location of the County Juvenile Justice Facility .on the County Governmental site located
north of Gleason Road, and east of Arnold Drive in the City of Dublin and hereby authorizes the
Mayor to sign a letter to the California Board of Corrections when the Alameda County Board of
Supervisors formally files an application for grant funding opposing the application.

RE: Alameda County Funding Request for New Juvenile Justice Facility - 2001
Dear Ms. King:
The City of Dublin hereby opposes the request of Alameda County for a Juvenile Local
Detention Facility Construction Grant for a site located on County-owned property at
Gleason Drive and Arnold Road in the City of Dublin.
Such a facility, if located on the above site, does not provide a safe and nurturing
environment for those juveniles who would be in the County's care while striving to keep
their families intact. If constructed at this location:
· Serious financial and transportation problems will occur since most juveniles sent
to this facility are located at great distances away (Oakland, Berkeley, San
Leandro and Hayward are located 20 or more miles to the west).
· Local Police operations throughout the County will be impacted due to
transportation to a non-centralized location.
· Major new Dublin residential and commercial neighborhoods are located
immediately adjacent to this Juvenile Justice site and traffic visual impact, lighting
and noise impacts may occur.
· Other more centrally located sites closer to the major source of juvenile detainees
are probably available in Alameda County.
Presently, two Federal prisons, the main santa Rita Jail and numerous other County
facilities are located in close proximity to this proposed Juvenile Justice Facility. In
addition, brand new residential neighborhoods and major office commercial structures

have been built directly adjacent to this site. It is the City Council's position that Dublin
has more than it share of correctional facilities in this area. If the grant is approved and
the County proceeds with the Juvenile Justice Facility, the County will be required to
process a Site Development Review application with the City of Dublin, in accordance
with the agreement between the City and the CoUnty.
Other sites are available within Alameda County, in our view. The City' of Dublin urges
your denial of the construction grant for this location.

,R.E.C.C).MMENDATION~ In order to proceed with m~ application for funding for the proposed .Al'jmeda
County Juvenile Justice Facility. it is requested that your Board adopt the attached resolution
authorizing the County Administrator to submii a grant application to tile California Board of
Corrections for construction funds,
DISCUSSION/SUMMARY:. In September 2000 the California Board of Corrections issued a Request
lbr Proposals (RF,P) for Juvenile Local Detention Facility Construction Grants. A total ors 131.8 mi }lion
is available statewide for juvenile facilities. On December 19,'2000 your Bo~d approved a building site
for a new detention facility to be located on County-owned land on the Santa R. ita property and directed
the County Administrator to prepare, the grant application. Applications are due to the Board of
Coreoct}Gas by Febru,'Lry 20, 2001. One of the requirements of the application is a resolution from your
Board which makes the following assurances if grant funds are awarded:
Identifies the County' s Construction Administrator, Project Financial Officer and Contact Person.
Authorizes the County Administrator to sign the assurance statement and submit the appJication.
Assures the County willadhex~ to Statet'fecieral requirements and terms of contract.
'Assures the County will appropriate ,'rod identify the amount of required matching funds and that
such funds do not supplant fu~nd.s otherwise dedicated for construction of the project.
Assures the Count)' will safely staff and operate the facility within 90 days after completion.
Assures the County has rights to the site of the project and that it will not lease the facility for
operation by other entities without State/federal authorization.
Attests to the current fair market value of the land on which the facility will be constructed.
The attached resolution sets forth the required assurances.

FINANCII'ZI_G: No fmanclal adjustments arc necessary at this time. The County Administmtor's Office
will continue to identify and develop financing strategies. State/federal grant funds arc expected to be
awarded in May 2001. To the extent the County is successful in securing grant ftmding for thls project,
the need for debt financing can be reduced.

WHEREAS,. the mission of the Alameda County Juvenile Justice System remains'strongly
comtnitted to the goals of protecting children, preventing juvenile crime, providing for public safety; and
rehabilitaling juvenile offenders by:
· Providing safe and nurturing environments to those in their care while striving to keep families intact.
· Maintaining levels of protection, supervision and custody commensurate with public safety and legal
mandates.
· Providing community focused programs that prevent and resolve the fundamental problems that create
criminal behavior.
· Strengthening cottonunity and public sector resources through collaboration in order to identify and ·
respond to hmilics and youth at the hi ghost risk of involvement with the justice system.
· Emphasize accountability into programs that reduce criminality and maximize an individual's
potentials.

WHEREAS~ this Board recognizes the need to design, construct and occupy a new Juvenile
Justice facility which will not only meet detention requirements, but also provides the opportunity to
assess risks and needs of the occupants-
NOW, THEREFORE, BE IT RE-SOLVED, that this Board authorizes the County Administrator
to submit an application to the California BOard of Corrections for construction funds to build a new
juvenile dete.ntion center; .and
Further, this Board has designated the County Construction Administrator to be Aki Nakao,
Director of the General Services Agency; the Project Financial Officer to be Patrick O'Connell, Auditor-
Controller and the Contact Person to be Susan S. Muranishi. County Administrator, for purposes of this
project; and
Further, this Board authorizes the County Administrator to sign the assurance statement and
submit the application for funding; and
Further, the County will adhere to State and federal requirements and terms of contract in the
expenditure of grant and matching funds; and
Further~ the County will appropriate after grant award but before contracting with the. Bo,'uyd of
Corrections the amount of matching funds ideatitled by the County on the funding application form
submitted to the Board of Corrections, will identify source of cash match when appropriated, and will
assure that grant and match funds do not supplant funds otherwise dedicated for construction activities
related to this project; and
Further~ the County will fully and safely staff and operate the facility subject to construction
consistent with Title 15, California Code of Regulations within 90 days after project completion; and

Further, assures thin the County has a fee simple or other such estate or intereM in the site c}f the
project and fights of access sufficient to assure undisturbed use and possession of the site and will not
dispose of, modify use of, or change the tenus of the real property title or orlxer interest in the site 'of the
facility subject to construelion under this grant, or lease the facility for operation by other eatltles, without'
permission and instructions from the Stem Board of Corrections if State ftmds are awarded. or the Office
of Justice Programs, U.S. Department of Justice if federal funds are awarded; and
Furthers attests to $9,800,000 as the current fair market value of the land on which a new juvenile
detemion center will be consminted.
