Adopt Resolution FINANCIAL STATEMENT: See below DESCRIPTION: In August of 1984, the City Council adopted Resolution Number 96-84 establishing fees ~/nd charges for certain municipal services. In November of 1984, the City Council adopted Resolution Number 120-84 establishing a policy to waive fees and charges for' specified activities sponsored by Dublin based non- profit groups and organizations. Since 1984, the City Council has adopted other amendments to Resolution Number 96-84 revising fees for various municipal services 'established in the resolution. Exhibit 1 of Resolution Number 96-84, established specific fees for Police Department services, including copies of police reports. A fee of $10 for copies of police reports was established as part of this exhibit. No review of the charge has occurred since that time. The $10 fee, originally established by Alameda County in October 1981, was based on existing law. That law stated the fees for public records could not exceed the "reasonable cost" of providing the service. Due to a change in law, staff has reviewed the fee charged for copies of police reports. The new law states that agencies may charge only for the "direct costs of duplication" as set forth in Government Code §6253(b). Upon reviewing the direct costs for duplication of a police report, it was determined that the existing fee should be modified in order to comply with the law change. Staff proposes that the fee for copies of police reports be reduced to $2 for the first eight pages of a police report and $0.25 for each additional page. COPIES TO: ITEM NO. Exhibit 7 of Resolution Number 96-84, established fees for general services provided by the City. Staff is proposing the establishment of a new fee for the processing of checks returned by the bank due to non- sufficient funds. Based upon the results of a cost analysis, staff recommends the adoption of a $20 fee to recover costs associated with returned checks. This charge is not considered an excess tax. Public heating notices were published twice in accordance with the requirements of state law related to fee establishment and adjustments. RECOMMENDATION: Staff recommends that the City Council adopt the attached Resolution amending Resolution 96-84, Exhibit 1, Police Services Fees and Exhibit 7, General Fees for Service. RESOLUTION NO. - O1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AMENDMENTS TO RESOLUTION NO. 96-84, EXHIBITS 1 AND 7 ADOPTING FEES FOR CERTAIN MUNICIPAL SERVICES WHEREAS, Resolution No. 96-84 adopting fees, charges, and bond amendments for certain municipal services was adopted by the City Council on August 27, 1984; and WHEREAS, Resolution No. 120-84, amending Resolution No. 96-84, to allow waiver of fees and charges for specified activities sponsored by Dublin based non-profit groups and organizations was adopted by the City Council on November 13, 1984; and WHEREAS, due to a change in law, a review of costs involved to provide photo copies of police reports was conducted; and WHEREAS, 'based upon the examination, the City desires to modify the fee schedule for copies of police reports; and WHEREAS, the City would like to establish a fee to recover costs incurred for the processing of checks retumed by the bank due to non-sufficient funds. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does hereby approve amendments to Resolution Number 96-84, Exhibit 1: Police Services Fees and Charges and Exhibit 7: General Fees for Service.
