Foss, City Manager " SUBJECT: Acceptance of Work - Shannon Park Water Play Area Renovation—Contract No. 13-06 Prepared by Douglas Rooney, Parks and Facilities Development Coordinator EXECUTIVE SUMMARY: On June 4, 2013, the City Council awarded Contract No. 13-06 to McNabb Construction, to renovate the Shannon Park Water Play Area (Capital Improvement Project #PK0713). The work by McNabb Construction is now complete and ready for City Council acceptance. FINANCIAL IMPACT: As approved in the 2012-2017 Capital Improvement Program, renovation of the Shannon Park Water Play Area was funded with Public Facility Fees, with a total project budget of $718,289 (including design, inspection and administration as well as the costs for improvements). The costs for construction, including all change orders, will be completed under budget. Total Available Construction Budget $570,900 Construction Contract including Change Orders/Expenses $540,449 Estimated Remaining Construction Contingency $30,451 RECOMMENDATION: Staff recommends that the City Council adopt the Resolution Accepting Improvements to the Shannon Park Water Play Area Under Contract No. 13-06 � r Submitted By l Reviewed By Parks and Community Services Director Assistant City Manager DESCRIPTION: On June 4, 2013, the City Council awarded Contract Number 13-06, Shannon Park Water Play Area Renovation, to McNabb Construction. Page 1 of 2 ITEM NO. 4.4 Work under the Contract included the removal of the existing fountain and bridge and replacing them with a modern "splash pad" style water play area. In addition to the spray area, the project included a new equipment building, outdoor shower, areas of new paving, a decorative railing and the on the walls, as well as planting and irrigation. Staff has determined that all punch-list items have been completed, warranties and stop notice releases have been submitted, and all other closeout items are now complete. Therefore, Staff is requesting that the City Council accept the improvements on the project. The City presently holds a performance bond in the amount of $519,400 to provide the necessary security for the performance of the work involved. As the work is now complete, the performance security requirement can be reduced, in accordance with authority contained in Section 66499.7 of the California Government Code, to an amount necessary to guarantee warranty of the work for a one-year period following acceptance of the work. The Contractor will provide a new maintenance bond in the amount of $51,940 which is 10% of the contract amount, and is sufficient to cover the one-year guarantee period. Following City Council acceptance of the project, Staff will file a Notice of Completion with the Alameda County Clerk. Staff will release the remaining retention on the project 35-days after filing the Notice of Completion, provided there are no claims. NOTICING REQUIREMENTS/PUBLIC OUTREACH: A copy of the Staff Report was sent to McNabb Construction. Staff will file a Notice of Completion with the Alameda County Clerk following acceptance of the improvements by City Council. ATTACHMENTS: 1. Resolution Accepting Improvements to Shannon Park Water Play Area Contract No. 13-06 Page 2 of 2 RESOLUTION NO. - 14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * * * * * * * * * ACCEPTING IMPROVEMENTS TO SHANNON PARK WATER PLAY AREA CONSTRUCTION CONTRACT 13-06 WHEREAS, McNabb Construction, entered into a contract with the City of Dublin to renovate the Shannon Park Water Play Area in accordance with plans and specifications on file with the City Engineer; and WHEREAS, said improvements have been completed in accordance with said plans and specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of the City of Dublin; and WHEREAS, as a condition of said contract, McNabb Construction is required to guarantee the improvements for a period of one-year following acceptance of the work by the City of Dublin; and WHEREAS, the improvements are now completed, and the original performance bond security requirement can be reduced, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California, to an amount found necessary to guarantee maintenance of the completed work for the aforesaid one-year period. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Dublin does hereby accept the improvements, subject to the aforesaid one-year warranty, and authorize Staff to file a Notice of Completion with Alameda County. BE IT FURTHER RESOLVED that the City Council of the City of Dublin authorize Staff, if after 35-days of filing the Notice of Completion there are no subcontractor claims, to release the retention and replace the aforesaid performance bond security requirement in the amount of $519,400 with a maintenance bond in the amount of $51,940 as security for the aforesaid one- year maintenance period; and authorize Staff to release said original performance bond posted in connection with the work involved in the construction of said Facility upon acceptance of said warranty.
