Receive staff presentation and public testimony Question staff and the public Adopt Resolution authorizing or denying request. FINANCIAL STATEMENT: None at this time. DESCRIPTION: Robert Enea is requesting a General Plan Amendment Study for a 4- 30,000 sq. ft. parcel located at 7475 Starward Drive, adjacent to an existing apartment building on the east, single family houses and the flood channel to the north and west and the Shamrock Shopping Center to the south. The site is presently zoned C-O and has a 5,000 sq. ft. office building and a vacant 25,000 sq. ft. lot on the single parcel. The General Plan designation for this site is Retail/Office. The applicant wishes to change the General Plan designation for the site from Retail/Office to either Medium High or High Density residential to construct a small infill multifamily project that will upgrade the present site. The City Council needs to determine whether a General Plan Amendment Study should be authorized. All other land use and environmental concerns will be addressed by the General Plan Amendment Study itself. If the Study is initiated, subsequent public heatings will be held before the Planning Commission and City Council regarding rezoning, site development review and other entitlements. This small site is mostly vacant with an older 5,000 sq. fi. office structure on the north side adjacent to the flood control channel. All uses north of Starward Drive from the Fire Station at Donohue to the flood control channel are multifamily apartment structures now. This site might be appropriate for higher density residential use in the future. As a part of the Park and Recreation Master Plan, this site was shown as a possible park site to be considered in the future. If authorized, this site would also be evaluated to its park potential as well. Notice of this proposed General Plan Amendment Study request has been sent to all property owners within 300 feet of the site. The applicant's request for a General Plan Amendment Study would change the use of this property from commercial/vacant to some residential density permitting a small scale multi family project. If authorized, .this General Plan Amendment Study needs to also study the feasibility of park use as outlined in the Park and Recreation Master Plan; even though this site was not a high priority site for a potential park. The resolution approving the initiation of this Study would include this park analysis as well. RECOMMENDATION: Staff recommends that the City Council receive Staff presentation and public testimony; question Staff and the public; and adopt a Resolution either authorizing or denying the General Plan Amendment Study request. The northern border backs up to'the flood canal and serves as a natural'bUffer to larger single family homes. The property consists of an outdated five thousand (5,000 sq ft) square foot office building and a vacant twenty-five thousand (25,000 sq fl) lot. We would propose fo demolish the existing .building and develop the entire site into a high quality multi-family project'that will enhance and upgrade the neighborhood. In conclusion, we: see this as a small infill multi-family project that will better serve the community and be. more consistent and compatible use with the surrounding properties. RESOLUTION NO. - 03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN INITIATING A GENERAL PLAN AMENDMENT STUDY FOR PROPERTY OWNED BY ROBERT ENEA APN 941-0173-002-02 WHEREAS, a General Plan Amendment Study has been requested by Robert Enea for a ± 30,000 sq. ft. site located at 7475 Starward Drive (APN 941-0173-002-02). The predominate land use designation proposed for this area is medium-high and high density residential use as requested by the Applicant; and WHEREAS, the applicant will be required to pay all processing costs associated for the General Plan Amendment Study; and WHEREAS, additional entitlements including Rezoning and other associated permits will need to be processed before development can occur; and WHEREAS, the site also needs to be studies for possible park use in accordance with the Park and Recreation Master Plan; and WHEREAS, Section 65'358(a) of the State of california Government Code states that an amendment'to the General Plan shall be in a manner specified by the legislative body; and WHEREAS, the initiation request has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15306, Class 6 of the State CEQA Guidelines; and WHEREAS, the staff report submitted one recommendation that the City Council initiate a General Plan Amendment Study for the Enea properties; and WHEREAS, the City COuncil did hear and consider all such reports, recommendations and testimony herein above set forth and is in support of a General Plan Amendment Study to determine the appropriate land use and General Plan designation for the property before making a decision as to the merits of requested specific entitlements. NOW THEREFORE, BE IT RESOLVED THAT the Dublin City Council does hereby initiate a General Plan Amendment Study for the Robert Enea property with the direction that the applicant prepare general plan designation proposals for Medium High and High Density Residential for this site located at 7475 Starward Drive and that Staff study the possible use of this site as a park in accordance with recommendations of the Park and Recreation Master Plan.
