DESCRIPTION: This is the second reading of a proposed ordinance which was introduced at the November 18th City Council meeting. If radar is to be used for traffic enforcement, the California Vehicle Code (CVC) requires that a local jurisdiction conduct an engineering and traffic survey ("speed survey") prior to establishing speed limits on streets which meet criteria outlined in CVC Section 40802.(Attachment 4). Under this section, surveys are needed for all streets except those which have residential frontage and are no more than 40 feet wide, have no more than one half mile of uninten'upted length, and have no more than one lane in each direction. The surveys must then be renewed at seven-year intervals or when the character of the street changes due to construction or other factors that could influence prevailing speeds. New speed limits are now proposed to be established for Tassajara Road, Glyrmis Rose Drive, and Amador Plaza Road south of Dublin Boulevard. No other speed limits are proposed to be changed at this time. The basis for the engineering and traffic surveys is the 85th percentile (critical) speed, which is the speed at or below which 85% of the vehicles are traveling. The 85th percentile speed is generally accepted as a "safe" speed; however, the survey is also required to consider factors such as accident history and roadway characteristics such as curves, driveways, or parking (see Survey Forms, Attachment 3). TasSajara ROad Until recently, Staff has been unable to conduct surveys on Tassajara Road due to ongoing construction. HoweVer, all existing traffic signals have now been energized, and the roadway construction is complete for the foreseeable future, Radar speed surveys were conducted on Tassajara Road on September 9 and 10 and November 4, 2003. The 85th percentile (critical) speed between 1-580 and Dublin Boulevard was 39.7 mph, which supports a 35 mph speed limit. The 85th percentile speed between Dublin Boulevard and Gleason Drive was 44.5 mph, between Gleason Drive and North Dublin Ranch Drive, 47 mph, and between North Dublin Ranch Drive and the northerly City Limit, 52 mph. These speeds suppOrt a 45 mph speed limit. .' Based on the factors considered in the survey, Staff recommends that speed limits on Tassajara Road be established as' follows: 'Segment from 1-580 to Dublin Boulevard: Segments from Dublin Boulevard to northerly City Limit: 35 miles per hour 45 miles per hour The only speed limit signs currently posted on Tassajara Road are a 35 mph sign on the 1-580 overcrossing and a 45 mph sign posted on the rural two-lane portion north of North Dublin Ranch Drive. The appropriate sPeed limit signs are proposed to be posted on all segments as soon as the ordinance becomes effective. G1yrmis Rose Drive Construction on Glynnis Rose Drive is now complete. The roadway serves a rear entrance to the Waterford shopping center and provides access to both the Waterford Apartments and the Dublin Greene residential development. Parking is allowed on both sides of the street and is used by residents of the apartments and the adjacent houses. Radar speed surveys were conducted on Glyrmis Rose Drive on September 23, 2003. The 85th percentile (critical) speed was 31.5 mph. Based on the survey results, the surrounding uses, and the incidence of pedestrians, Staff recommends establishing a speed limit of 25 mph. No speed limit signs are currently installed but would be installed as soon as the ordinance becomes effective. Arnador Plaza Road (South of Dublin Boulevard) A 30 mph speed limit on all of Amador Plaza Road was pre-existing and was formally adopted by the City during the 1987 Code update. Engineering surveys conducted prior to the 1-580 / 1-680 interchange construction supported the 30 mph speed limit. A survey update conducted in 1999 recommended a "Construction 25" speed limit pending completion of the improvements. There are currently no pos. ted speed limit signs. The character of the southerly segment of Amador Plaza Road has changed considerably due to the construction of St. Patrick Way and the 1-680 ramps, as well as the addition of Page 2 businesses on the east side of the street. A radar speed s~ey Was conducted on September 18, 2003. The 85th percentile (critical) speed was found to be 26.8 mph. Based on the critical speed and the multiPle business driveways, as weI1 as the occasional vehicle queues from the freeway ramps, Staff recommends that the speed limit for Amador Plaza Road south of Dublin Boulevard be set at 25 miles per hour. The City's Municipal Code requires that speed limits be adopted by ordinance. Staff recommends that the City Council conduct a public hearing, deliberate, and adopt the ordinance establishing speed limits on Tassajara Road, Glynnis Rose Drive, and Amador Plaza Road south of Dublin Boulevard. Page 3 /r~ ~ ORDINANCE NO. -03 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DUBLIN ESTABLISHING SPEED LIMITS ON TASSAJARA ROAD, GLYNNIS ROSE DRIVE, AND AMADOR PLAZA ROAD SOUTH OF DUBLIN BOULEVARD The City Council of the City of Dublin does ordain as follows: Section.!.'.. Pursuant to Dublin Municipal Code Section established as follows: Tassajara Road: Glynnis Rose Drive Amador Plaza Road: 6.04.340, speed limits shall be From southerly City Limit to Dublin Boulevard, 35 miles per hour. From Dublin Boulevard to northerly City Limit, 45 miles per hour. Entire Street, 25 miles per hour From Dublin Boulevard to southerly end, 25 miles per hour. Section 2: Said speed limits shall be added to City of Dublin Traffic Code Sections 6.60.010 (25 miles per hour), 6.60.030 (35 miles per hour), and 6.60.050 (45 miles per hour). Section. 3.: Section 6.60.020 (30 miles per hour) of the City of Dublin Traffic Code shall be. amended to read: Amador Plaza Road: From Dublin Boulevard to Amador Valley Boulevard. Section 4: This ordinance shall become effective 30 dayS after its final passage and adoption by the City Council. The City Clerk of the City of Dublin' shall cause this ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California. (a) A "speed trap" :is either of the ~ollowing: (1) A particular section of a highway measured as to distance and with boundaries marked,-designated, or otherwise determined in order that the speed Of a vehicle may be calculated by securing the time it takes the vehicle to travel the known distance.. (2) A particular section of a highway with a prima facie speed limit that is provided by this code or by local ordinance under subparagraph (A) of paragraph (2) o~ subdivision (a) of Section 22352, or established under Section 22354, 22357, 22358, or ~2358.3, if that prima facie .speed limit is not justified by an engineering and traffic survey conducted within five years prior to'the date of the alleged violation, and enforcement of the speed limit involves the use of radar or any .other electronic device that measures the speed of moving objects. This paragraph'does no= apply to a local street, road, or school zone. (b) (1) For purposes of this section, a local street or road is defined by the latest functional usage'and federal-aid system maps submitted to'the federal Highway Administration, except that when these maps.have not been submitted, or when the street or road is not shown on the maps, a "local street or road" means a street .or road that primarily Provides access to abutting residential property and ~eets the following three conditions: (A) Roadway width of not more than 40 feet. (B) Not more than one-half of a mile of uninterrupted length. Interruptions shall include official traffic control signals as defined i~"~ection 445. (C) Not more than one traffic lane in each direction. (2) Fo~ purposes of this section "school zone" means that area approaching or passing a school buildiRg or the grounds thereof that is contiguous to a highway and on which is posted a standard "SCHOOL" warning s~gn, while children are going to or leaving the school either during school hours or during the noon recess p~riod. "School zone" also includes the area approaching or passing any school ~rounds that are not separated from the highway by a fence, gate, or .other physical barrier while the grounds are !n use by children if that highway is posted with a standard "SCHOOL" warning sign. (c) (1) When all of the following criteria are met, paragraph (2)' of this subdivision shall be applicable and subdivision (a) shall not be applicable: '(A) When radar is usad, the arresting officer has successfully completed a radar operator course of not less than 24 'hours on the use of.police traffic radar, and the course was approved.and certified by the Commission on Peace Officer Standards and Training. 627. (a) "Engineering and traffic survey," as used in this code, means a ~urvey of highway and traffic conditions in accordance with methods determined by the Department of' Transportation fox use by state and local authorities. (b) An engineering and'traffic survey Shall include, among other requirements deemed necessary by the dePartment, consideration of all of the following: (1} Prevailing speeds as determined by ~raffic. angineering measurements. ('2) Accident records. (3) Highway, traffic, and roadside conditions not readily apparent to the driver. (c) When conducting an engineering and traffic survey, local authorities, in addition to the factors set forth in paragraphs (1) to (3~, .inclusive, of subdivision (b) may consider all of the following: {1) Residential density, if any of the f~llowing conditions exist on the particular portio~ of.highway and the property contiguous thereto, other than a business district: (A) Upon one side of the highway, within a distance of a quarter 0f a mile, the contiguous property fronting there'on is-occupied by 13 or more separate dwelling houses or business structures. (B) Upon both sides of the highway, collectively, within a distance, of a quarter of a mile, the-contiguous property fronting thereon is occupied by 16 or more separate dwelling houses or business structures. (C). The portion of highway Is longe~ than one-quarter of a mile but has the ratio cf separate dwelling houses or business-structures to the lengtk Of the highway described in either subparagraph (A) or (B). (2) Pedestrian and bicyclist safety.
