SUBJECT: Public Art Agreement — Emerald Glen Recreation and Aquatic Complex

EXECUTIVE SUMMARY:
The City Council will consider approval of a Public Art Agreement with artist Todji Kurtzman to
fabricate and install an artwork based on the final approved design for the Emerald Glen
Recreation and Aquatic Complex. The size and height of the primary sculptural piece have
been increased based on feedback from the City Council, Heritage and Cultural Arts
Commission and the Art Selection Committee.
FINANCIAL IMPACT:
The proposed fee for services under the Agreement is $225,800. Due to the increase in the size
and height of the primary sculptural piece a Budget Change of $50,000 is needed due to
increased costs for materials, engineering and fabrication for the artwork and structural
elements. Sufficient funds are available in Public Art Fund.
RECOMMENDATION:
Staff recommends the City Council adopt a Resolution Approving an Agreement with Todji
Kurtzman for the design, fabrication and installation of artwork at the Emerald Glen Recreation
and Aquatic Complex; and, approve the Budget Change in the amount of $50,000 to increase
size and height of the artwork.

DESCRIPTION:
In May 2014, the City Council approved proposed artwork by artist Todji Kurtzman, and
authorized Staff to negotiate an Agreement with the artist for the design, fabrication and
installation of the public artwork at the Emerald Glen Recreation and Aquatic Complex. The
negotiation included determining the most appropriate scale of the artwork in in relationship to
the environment and plaza area where it will be installed.

The artwork consists of a symbolic female sculpture located at the amphitheater plaza. The
figure casts a stone that skips the length of the boardwalk towards the entrance to the
Recreation and Aquatic Complex. Each of seven skips leaves a splash, a mark in history
celebrating various iconic periods in Dublin's history. The last element of the sculpture is a calm,
mirror - polished stainless disc that will reflect the faces of those who decide the future.
The final cost for the artwork including design, engineering, fabrication and installation is
estimated to be approximately $225,800. This reflects an increase of $50,000 from the original
cost estimate to accommodate an enlargement of the figure from the six -foot height proposed in
Mr. Kurtzman's original proposal, to a height of eight feet.
The attached Resolution includes the Agreement as Exhibit A, which reflects the scope of
services for the artist as well as the schedule for completion of the work. Upon approval of the
Agreement, Staff anticipates that the artwork will be installed prior to completion of the
Recreation and Aquatic Complex during summer 2016.
The proposed Budget Change Form is included as Attachment 4.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
APPROVING AN AGREEMENT WITH TODJI KURTZMAN
FOR THE EMERALD GLEN RECREATION AND AQUATIC COMPLEX
PUBLIC ART PROJECT
WHEREAS, the 2014 -2019 Capital Improvement Program includes a project to design,
fabricate and install public art at the new Emerald Glen Recreation and Aquatic Complex; and
WHEREAS, the City Council has approved a design proposal for artwork from Todji
Kurtzman for the Emerald Glen Recreation and Aquatic Complex; and
WHEREAS, the City Council has solicited a proposal from Todji Kurtzman to complete
the design, fabrication and installation of the artwork; and
and
WHEREAS, Todji Kurtzman has demonstrated adequate ability to perform said tasks;
WHEREAS, Todji Kurtzman is available to perform the work as specified.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin does
hereby approve the Agreement with Todji Kurtzman attached hereto as Exhibit A and
authorizes the City Manager to execute the Agreement.

PROPOSAL
Attached is Artist's Proposal at the time of the Agreement date.
"Proposal" shall mean the proposed visual, aesthetic, and artistic intent and design of the Artwork
incorporated in the Contract Documents approved by the Dublin City Council. The most recent
design approved by the Dublin City Council is incorporated herein by reference, and is binding
unless or until changes are approved by resolution of the Dublin City Council.
Artist's Proposal shall be automatically superseded by any Contract Documents that are later
approved by the City Council.
Artist's proposal will be developed, fabricated and installed in accordance with Exhibit B: Scope of
Work.

"THE SPIRIT OF ALAMILLA SPRING"
Skipping a Stone Across Time
Thank you for considering our proposal
to represent "The Spirit of Alamilla Spring"
skipping a stone across time. The city of
Dublin stands where it does today because of
Alamilla spring. This bronze monument with
turquoise patina would be the first sculpture
that pays tribute to the fountain source of the
city.
Splashes ripple down the plaza of the
Emerald Glen Recreation and Aquatics
Complex, each ripple splash represents
a different era of Dublin's history.
Todji Kurtzman Sculpture LLC is a five
person team that includes a master sculptor, a
California licensed architect (my father),
foundry associates and administrative and
artistic support by my talented wife. We work
collaboratively with our clients, project
designers, stakeholders and communities to
fulfill their objectives and we aim to exceed
expectations. We deliver monumental
sculptures in bronze and stainless steel that
support health, ecology, culture and finance
with the intention to inspire communities for
generations to come.

CELEBRATING SOURCE
Fresh Water at a Crossroads
Founds a City
The city of Dublin that we know today stands
where it does because of Alamilla Spring. The
area from Dublin to Pleasanton was once
a robust wet land teeming with wildlife, game,
fresh water and the Muwekma Ohlone people.
When Mexican citizen Jose Maria Amador was
awarded the land that the city of Dublin sits
upon for his service as a Mexican soldier and
for being the administrator of mission San Jose,
he built his adobe ranch houses next to the
sweet waters of Alamilla spring.
Above is a preliminary digital representation
of what the watery feminine representation
of the spring can look like.
Alamilla Spring bears the name of Michael Murray's first wife Alamilla. Michael Murray
was among the first Irish immigrants to arrive in this little western town in a newly
American territory following the Mexican American war. Many more Irish arrived in the
following years escaping the potato famine of 1845 -1849. The influx of Irish immigrants led
to the naming of this horse watering town at a cross roads as Dublin.
In regards to the name Alamilla, Elizabeth Isles of The Dublin Heritage Park and Museum
did a little research and came up with the following information: The word alma in Spanish,
Portuguese and French means "soul ". Atma in Sanskrit also means soul and in Latin almus,
means "kind ", "fostering ", or "nourishing." Also, the Arabic word for "water" is al -ma. In
Greek the related word aAlt y means "salt water ". Another close name is Amelia, derived
from the Germanic word amal meaning "work ", and means "industrious" and "fertile"
(wikipedia). If there are related linguistic roots in Asian languages, that remains unknown
to me at this time.
Little is known about Michael Murray's first wife Alamilla
who passed away fairly young leaving her husband and
their three sons in 1860. Today her namesake evokes the
qualities of the soul, water and maternal nurturing in the still
flowing Alamilla Spring near the corner of Dublin Blvd
and San Ramon Valley Rd.

ACTIVATING THE PLAZA
To fulfill the objective of activating
the plaza between the amphitheater
and the aquatic recreation center, we are
proposing a multiple piece bronze
monument. The Spirit of Alamilla Spring
is represented as a splashy female water
figure skipping a stone down the plaza
of the aquatic center.
There are seven stone skips down the
length of the plaza, represented by four
separate bronzes, (the last four splashes
are contained in one bronze), culminating
in front of the Aquatic recreation center
entryway. The last sculpture is a placid,
mirror polished stainless steel disc whose
reflection represents "you" the future.

haiku of intersecting ripple patterns that can activate the imagination of the viewer.

I have begun sculpting a clay maquette of a splashy female water spirit skipping a stone.
She is at an intermediary stage and is in progress. All of my figurative bronze sculptures are
characterized by unique form and dynamism. The design and sculpting of a piece like this
requires three months of full time work. The images that I am presenting in this proposal
are not of a finished sculpture, but a work in progress to give the idea of how she can look.

Maintenance
Bronze is easily maintained with annual, bi- annual or quarterly cleaning with mild soap
and water applied with a non abrasive sponge or towel. Cleaning is followed by
application of paste wax rubbed with a towel to bring out a shine. A four page detailed
.pdf document entitled "Care for Outdoor Bronze Sculpture" will be provided. Replacing
light bulbs can be done by hand by a staff utility person.

The bronze will be cast by one or more of these three fine art foundries with whom I have
worked with in monument production previously:

public bronze sculpture yourself. Frequently touched areas become polished and shiny. A
well touched bronze is a sign of a well loved work of art. As in life, human touch breathes
life into a work of art. We can expect children to be putting their hands all over the water
splashes as they are a perfect height for children to grab onto and to peer inside. Climbing
on The Spirit of Alamilla Spring is not preferred, and can easily be dissuaded by appropriate
signage or by planting shrubs around the base.
How the Work Will be Installed
The work will be installed under my supervision by either the contractor who is building
EGARC or another local contractor who is recommended to me by the contractor building
EGARC. Installation is straightforward, as a small crane or back hoe will lift the bronzes.
Holes are drilled in the concrete plinths; epoxy is used as an adhesive and 3/4 ",1" or 11/4"
diameter stainless steel threaded rod welded to the bottom side of the bronzes are used to
secure the sculptures.

SCOPE OF WORK
SCHEDULE FOR COMPLETION OF WORK. The following fabrication schedule shall be adhered
to in the performance of the work. During the term of this Agreement, the City Project Manager
must approve Artist's work at each phase of development before the Artist proceeds to the next
phase. The City Project Manager for this Agreement is:

The scope of work under this phase includes integration of the Artwork into the Construction
Documents.
• Artist shall attend project meetings and make presentations to City staff, Architects, City, and
other individuals and organizations, as needed to incorporate Artwork into the project
construction documents.
• Artist agrees to collaborate closely with Architect through in- person meetings and other
necessary means of communication to allow Architect to thoroughly integrate the Artwork into
architectural drawings (if applicable) throughout all phases of design.
• Artist shall coordinate his/her communications with the Architect through the Arts City Project
Manager.
Phase will be considered complete when all deliverables have been received by City Project
Manager. Payment may be released earlier than date specified should Phase be deemed
complete.

The scope of work under this phase includes:
• Artist will provide City Project Manager with status on the design progress of the five
sculptural splash elements and the "Spirit of the Spring" figure.
• When the design for all of the five sculptural splash elements is complete in clay maquette
form, the City Project Manager will approve the splash design via an in person studio visit
• There will not be any changes to the clay macquette of the five splashes following approval by
the City Project Manager without mutual consent by the Artist and the City Project Manager
• Artist will provide City Project Manager with a status on the sculpting progress with ample time
to coordinate site visit at 100% completion of the clay macquette of the five sculptural splash
elements.
Phase will be considered complete when all deliverables have been received by City Project
Manager. Payment may be released earlier than date specified should Phase be deemed
complete.

2. Artist studio site visit for inspection of splash maquette and September 1, 2014

The scope of work under this phase includes:
• The approved clay maquette of the five sculptural splash elements will be scanned and
imported into 3D digital modeling software. The ripple patterns will be added to the splashes
at this time.
• The City Project Manager will approve the final design of the five sculptural splash elements
with ripples via a studio site visit or remotely via digital images.
• There will not be any changes to the clay macquette of the five splashes with ripples following
approval by the City Project Manager without mutual consent by the Artist and the City Project
Manager
• Phase will be considered complete when all deliverables have been received by City Project
Manager. Payment may be released earlier than date specified should Phase be deemed
complete.

elements with ripples.
2. Digital photos of Progress of "Spirit of Alamilla" figure for December 15, 2014
Review by City Project Manager and Public Art Selection
Committee.
Artist studio site visit for inspection of the final design of the December 15, 2014
splashes and ripples as 3D digital models viewable on the
computer or via digital images, or digital fly through movies;
followed by Authorization to Proceed by City Project
Manager.
4. Progress Report to indicate any potential change to project December 15, 2014
timeline.
The scope of work under this phase includes:
• Enlargement of the First of 5 sculptural splash elements of the Artwork Proposal. The artist
will coordinate a studio visit with the City Project Manager to view and approve the first of the
full size splashes, in wax or clay. Studio visits to see the other four enlarged splashes at
different times will be made available.
• Approval is required by the City Project Manager of each of the five sculptural splash
elements before the mold making or bronze casting process begins. The approval of the
enlarged splash, in wax or clay, will be based on correct size, aesthetic match to the
previously approved designs, and artistic integrity.
• There will be no changes to any of the five enlarged wax or clay splashes after they have
been approved by the City Project Manager without mutual consent by the Artist and the City
Project Manager
• The artist will provide the City Project Manager with a status on the enlargement and sculpting
progress with ample time to coordinate site visit at 100% completion of each of the enlarged
sculptural splash elements.
• Artist will provide a design update on the progress report on the "Spirit of Alamilla" figurative
element at 75% completion.
• Phase will be considered complete when all deliverables have been received by City Project
Manager. Payment may be released earlier than date specified should Phase be deemed
complete.

7. The fifth splash element is a mirror polished stainless steel June 29, 2015
disc which can be authorized with digital photos via email.

The scope of work under this phase includes:
• Completion of the design of the "Spirit of Alamilla Spring" figurative element of the Artwork
Proposal.
• Completion of the clay macquette of the "Spirit of Alamilla Spring" figurative element of the
Artwork Proposal.
• Artist studio site visit for inspection of the clay macquette of the "Spirit of Alamilla Spring" and
Authorization to Proceed by City Project.
• Completion of the full scale enlarged "Spirit of Alamilla Spring" figurative element of the
Artwork Proposal.
• Artist studio site visit for inspection of the full scale enlarged "Spirit of Alamilla Spring"
sculpture and Authorization to Proceed by City Project.
• There will be no changes to any of the "Spirit of Alamilla Spring" figurative element after it has
been approved by the City Project Manager without mutual consent by the Artist and the City
Project Manager
• Phase will be considered complete when all deliverables have been received by City Project
Manager. Payment may be released earlier than date specified should Phase be deemed
complete.

City Project.
Drawings as needed for sculpture armature, foundation and
attachment hardware, produced by Artist or Foundry. Shop
Drawings shall be signed and stamped by a structural
engineer as required by the California Uniform Building
Code and any City of Dublin amendments to the Building
Code.
4. Progress Report to indicate any potential change to project

• Artist will work cooperatively with the Project Manager to draft an Artist Vision Statement for
this Artwork that will be incorporated into a plaque installed at the site.
• Prior to transportation and installation of Artwork, Artist's structural engineer shall verify in
writing that the preparation of the artwork attachment or mounting system and installation is
being implemented in accordance with the signed stamped structural engineering drawings.
• Artist shall prepare the Artwork for transportation in accordance with customary industry
standards for the transportation of fine works of art.
• City shall provide Artist with an adequate no -fee storage location for the Artwork. Storage will
be at the Artist's risk and covered by his insurance.
• Artist shall provide for the transportation of the Artwork from storage to the installation site.
Artist shall not transport the Artwork until access to the Site has been approved and
scheduled by the Contract Administrator.
• Artist shall create with the City Project Manager an installation plan indicating the staging and
sequence of all aspects of installation. The Installation Plan must include a detailed
description of the estimated duration of installation, the equipment to be used, and all workers
who will be on site to assist.
• Artist shall consult with the City, the Project Construction Management Team and General
Contractor prior to and during the installation of the Artwork.
• Artist shall coordinate Artist's activities on site with the General Contractor through the
Construction Management Team and/or the City staff.
• The preparation of the Site for installation of the Artwork shall be the responsibility of the
General Contractor in accordance with a separate written agreement between City and the
General Contractor.
• City will coordinate with project Contractor rental of equipment to install the Artwork.
• Artist shall supply all hardware necessary for installation.
• Where Artist's Artwork is associated with that of the General Contractor, or any other
Contractor engaged by the City to do work on the Site, Artist shall examine the work of such
other Contractor and report in writing to the City any visible defect or condition preventing the
proper execution of Artist's Work.
• If Artist proceeds without giving notice, the Artist shall be held to have approved the work or
material and the existing conditions, and shall be responsible for any defects in Artist's own
Work consequent thereon, and shall not be relieved of any obligation or any guarantee
because of any such condition or imperfection.
• To the extent that any part of the Artist's Artwork is to interface with work performed or
installed by the General Contractor or other Contractor engaged by City to perform work on
the Site, Artist shall inspect and measure the in -place work and promptly report to the City any
defect in such in -place work that will impede or increase the cost of Artist's interface unless
corrected.
City and/or its authorized representatives will require the party responsible for the defective
work to make corrections so as to conform to its contract requirements, or if the defect is the
result of a default or omission in the contract documents, may issue a change order.
• If Artist fails to measure, inspect and/or report defects that are reasonably discoverable, all
costs of accomplishing the interface shall be borne by Artist. The forgoing does not apply to
latent defects. Artist shall report to City any latent defects in another Contractor's work at any
time such defects become known.
• City or its authorized representatives shall promptly thereafter take such steps as may be
appropriate. Any difference or conflict that may arise between Artist and the General
Contractor, or other Contractors engaged by City to perform work on the Site, shall be
adjusted as determined by City, its agents, or its authorized representatives when necessary
to facilitate the work of Artist and/or other Contractors or workers.
• No damages or claims by Artist will be allowed other than an extension of time for the
completion of Work. Such an extension will be for the period of time City shall consider Artist
to have been delayed in the completion of Work by reason of the work of other Contractors or
workers.
• Artist shall deliver all information necessary for the City to properly care for and maintain the
Artwork, including information regarding the physical make -up of the Artwork, methods and
materials, and information about the artistic intent of Artist in the Design, Fabrication and
Installation of the Artwork
• Final inspection and closed permits.
• Phase will be considered complete when all deliverables have been received by City Project
Manager. Payment may be released earlier than date specified should Phase be deemed
complete. Should installation date be later than February 29, 2016, City will withhold payment
until all deliverables have been received.
