Thompson, Public Works Director ATTACHMENTS: 1) Resolution 2) Vicinity Map RECOMMENDATION: FINANCIAL STATEMENT: Adopt the Resolution accepting street improvements and approving the traffic control devices installed for Tract 7142, Dublin Ranch Area A, Neighborhood A-7 Toll CA II, LP, has provided a Maintenance Bond in the amount of $313;867.00 to guarantee against defects for one year. Once these improvements have been accepted, the City will incur maintenance and street sweeping costs for the City street improvements. The street light maintenance costs will be paid by'Street Lighting Maintenance Assessment District 1999-1. DESCRIPTION: On July 17, 2001, the City Council authorized the Mayor, via Resolution No. 125-01. to execute two separate Tract Developer Agreements with Toll CA II, LP, for improvements associated with Tract 7142, Dublin Ranch, Area A, Neighborhood A-7 to govern the following: 1) Street improvements 2) Landscaping Of these two agreements, the developer has completed work governed by the street improvements agreement. The remainder of the work governed by the landscape agreement is currently underWay and nearing completion. Tract 7142 is located in the Eastern Dublin Specific Plan area east of Bent Tree Drive and north of Fallon Road. The subdivision consists of 105 residential lots. The street improvements have been constructed pursuant to the Tract Developer Agreement and to the satisfaction of the City Engineer, and should now be accepted by the City for permanent maintenance. The remaining work associated with Tract 7142 will COPIES TO: H. The following regulatory trai'fic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: Stop control devices have been installed on the northerly and southerly approaches of the "tee" intersection at Stonehaven Lane, on the southerly approach of Landmark Way at South Kilbride Lane, on the easterly approach Eagles Landing Court at Piper Glen Terrace, on the westerly approach of Piper Glen Terrace at Bent Tree Drive, on the westerly approach of Stonehaven Lane at Bent Tree Drive, on the easterly approach of Landmark Way at Piper Glen Terrace, and on the easterly approach of North Kilbride Lane at Piper Glen Terrace (Traffic Code Section 6.16.020). At the time that the City and Toll CA II executed the Tract Developer Agreement, the developer provided a Performance Bond in the .amount of $836,979.00 and a Labor and Materials Bond in the amount of $418,489.50 to guarantee performance of the work. Now that the work is complete, these bonds may be released in accordance with the authority contained in §66499.7 of the Government Code, and replaced with a Maintenance Bond in the amount necessary to guarantee the work for a one-year period following acceptance. The developer has provided a Maintenance Bond in the amount of $313,867.00, which is sufficient to guarantee the improvements for a one-year period after acceptance. Staff recommends that the City Council adopt the Resolution accepting the improvements for Tract 7142, Dublin Ranch Area A, Neighborhood A-7, and approving the regulatory traffic control devices. eagO RESOLUTION NO. - 03 A RESOLUTION OF THE CITY COUNCIL OF 'THE CITY OF DUBLIN ACCEPTANCE OF STREET IMPROVEMENTS FOR TRACT 7142, DUBLIN RANCH, AREA A, NEIGHBORHOOD A-7 AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, the subdivider of Tract 7142, filed on August 21, 2001, in Book 261 of Maps at Pages 5 - 10, previously entered into two (2) Tract Developer Agreements with the City of Dublin, one for Street Improvements and one for Landscaping, to improve said Tract in accordance with plans and specifications on file with the City Engineer, said Tract identified as follows: · a) Subdivider: b) Tract Location: c) Tract Size: d) Resolution Approving Agreement: e) City Streets Affected: Toll CA II, L.P., A California Limited Partnership North of Fallon Road, East of Bent Tree Drive, and west of Old Fallon Road 105 Single-Family Lots No. 125-01, .City of Dublin City Council Eagles Landing Court, Landmark Way, North Kilbride Lane, Piper Glen Terrace, South Kilbride Lane, and Stonehaven Lane WHEREAS, the Street Improvements associated with Tract 7142 are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, the Landscaping installation governed by the remaining Tract Developer Agreement is currently underway and nearing completion; and WHEREAS, the developer.has installed certain regulatory traffic control devices as a part of the Tract improvements; and WHEREAS, the original Performance Bond and Labor and Materials Bond that guaranteed the Street Improvements can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California, and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following acceptance; NOW, THEREFORE, BE IT RESOLVED that: The Street ImProvements completed within said Tract are hereby approved and accepted subject to a one-year guarantee period; and The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: Stop control devices installed on the northerly and southerly approaches of the "tee intersectiOn at Stonehaven Lane. o b) c) e) 0 g) Stop control devices installed on the southerly approach of Landmark Way at South Kilbride Lane. Stop control devices installed on the easterly approach of North Kilbride Lane at Piper Glen Terrace. Stop control devices installed on the westerly approach of Stonehaven Lane at Bent Tree Drive. The original Performance Bond issued by The Continental Insurance Company (Bond No. 929200648) in the amount of $836,979.00 be released; and The original Labor and Material Bond issued by The Continental Insurance Company (Bond No. 929200648) in the amount of $418,489.50 be released; and The submitted Maintenance Bond issued by National Fire Insurance Company (Bond No. 929280217) in the amount of $313,867.00 be accepted as security for the aforesaid one- year maintenance period, said period to commence on this date and terminate on the 18th day of November, 2004.
