Soto, City Clerk/Records Manager EXECUTIVE SUMMARY: CITY CLERK File # 700 -20 The City Council will discuss options regarding Councilmember salaries in the future. FINANCIAL IMPACT: Should the City Council adopt an increase to the maximum allowed, the financial impact for a partial year increase (December 2014 - June 2015) including salary -based taxes and contributions is approximately $4,200. The full year (12 month) additional cost is approximately $7,200 compared to current costs. RECOMMENDATION: Staff recommends that the City Council discuss and provide direction to Staff regarding options for possible adjustments to City Council salaries. F 7 Submitted By City Clerk DESCRIPTION: \ Reviewed By Acting Assistant City Manager Government Code Section 36516(a) allows a general law city to provide a salary to City Councilmembers. An increase in compensation is allowed by ordinance, and "may not exceed an amount equal to 5% for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance or amendment is enacted" (Government Code Section 36516(4). The Dublin City Council last adjusted salaries for the City Council in December 2012 (Attachment 1), which was effective after the November 2012 election. City Councilmembers currently receive $903.91 per month as compensation. Dublin Municipal Code section 2.08.040 Page 1 of 2 ITEM NO. 8.2 (Attachment 2) provides an additional $100 per month to the Mayor in addition to the salary he /she receives as a Councilmember. The Mayor's current salary is $1,003.91 per month. The City Council could direct Staff to return with the first reading of an ordinance that would increase salaries the allowable 5% per year to $996.57 per month. The allowable increase for calendar years 2013 and 2014 was calculated as follows: Current compensation (established 2012): $903.91 5% increase, 2012 to 2013: $949.11 5% increase, 2013 to 2014: $996.57 If the maximum increase were adopted, the financial impact for a partial year increase (December 2014 - June 2015) including salary based taxes and contributions is approximately $4,200. The full year (12 month) additional cost is approximately $7,200 compared to current costs. Attached for your information, is a table showing the base salaries for neighboring cities (Attachment 3). In accordance with Dublin Municipal Code Section 2.08.02013 and State Law, the increase would not become effective until newly elected Councilmembers are sworn into office following certification of the November 2014 election. The City Council could also consider: ■ Reducing current salaries ■ Eliminating salaries altogether ■ Increasing them by an amount less than the maximum permitted by law; or ■ As decided by the City Council in 1992, 1994, and 2010, not increase the current salary. Any of these alternatives, if selected, would not become effective until new City Councilmembers are sworn into office following certification of the November 2014 election. Tri- Valley City Council Salaries Page 2 of 2 ORDINANCE NO. 2 -12 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DUBLIN AMENDING DUBLIN MUNICIPAL CODE SECTION 2.08.020 AND PROVIDING FOR AN INCREASE IN THE SALARY FOR MEMBERS OF THE CITY COUNCIL THE CITY COUNCIL OF THE CITY OF DUBLIN DOES ORDAIN AS FOLLOWS: Section 1. PURPOSE Ordinance No. 6 -82 established salaries for members of the City Council, as amended by Ordinances No. 22 -85, 8 -87, 4 -88, 3 -89, 1 -90, 6 -91, 23 -99, 7 -02, 7 -04, 3 -06 and 5 -08. The purpose of this Ordinance is to modify salaries for members of the City Council in accordance with Government Code Section 36516. The salary increase shall become effective when new Councilmembers are sworn into office following the certification of the November 2012 General Municipal Election. Section 2: AMENDMENT OF MUNICIPAL CODE Section 2.08.020, Subsection A of the Dublin Municipal Code is hereby amended to read as follows: Pursuant to Section 36516 of the Government Code which provides that a City Council may enact an ordinance providing that each member of the City Council shall receive a salary which shall be determined by a schedule of population for cities, the members of the City Council shall receive a salary of nine hundred three dollars and ninety -one cents ($903.91) per month. Section 3: EFFECTIVE DATE AND POSTING OF ORDINANCE This Ordinance shall take effect and be in force thirty (30) days from and after the date of the passage. The City Clerk of the City of Dublin shall cause this Ordinance to"be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California. A. The City Council will hold all regular meetings in the Council Chambers at the Dublin Civic Center, located at 100 Civic Plaza, in the city. B. If the regular meeting place is unable to accommodate the number of persons in attendance, the City Council may recess the meeting to another place. If the City Council anticipates that the regular meeting place will be inadequate, the City Council, or Mayor in the event of an emergency, may order that the meeting be held in another place. In addition: (A) no person who has served as a Councilmember for one (1) term shall serve more than two (2) terms as Mayor if the terms as Councilmember and Mayor are consecutive; (B) no person who has served as Councilmember for two (2) consecutive terms shall serve a consecutive term as Mayor; (C) no person who has served as Mayor for three (3) or four (4) consecutive terms shall serve a consecutive term as a Councilmember; (D) no person who has served as Mayor for two (2) consecutive terms shall serve more than one (1) succeeding consecutive term as Councilmember; (E) no person who has served consecutive terms as Mayor and Councilmember shall serve more than one (1) more consecutive term as Mayor; and (F) no person who has served consecutive terms as Mayor and Councilmember shall serve another consecutive term as Councilmember. As used herein, a person shall be considered to have served a term of office as a Councilmember if such person has served as a Councilmember for two (2) years plus one (1) day and a person shall be considered to have served a term of office as Mayor if such person has served as Mayor for one (1) year plus one (1) day.
