The undergrounding portion of the overall Dublin Boulevard Improvement project will be funded with California Public Utilities Commission Rule 20A funds. FINANCIAL IMPACT: According to Pacific Gas & Electric (PG &E), the City of Dublin has a Rule 20A allocation balance of $222,798 as of February 15, 2013. PG &E allows the City to borrow up to 5 years of its annual allocation (approximately $108,000 per year) to increase its ability to implement a project. If the City were to borrow the next five years ($540,000), the amount of Rule 20A funds the City could use for its next underground project is approximately $762,798 ($540,000 + $222,798). The estimated cost for Dublin Boulevard undergrounding is $520,000, which is within the City's expected five -year funding. RECOMMENDATION: Conduct public hearing, deliberate, and waive the reading and introduce the Ordinance. Submitted By Director of Public Works DESCRIPTION: Reviewed By Assistant City Manager On September 4, 2012, the City Council prioritized Dublin Boulevard — Civic Plaza /Sierra Court to Dublin Court to Priority #1 in the Rule 20A Utility Undergrounding Priority List and authorized staff to formally introduce an Ordinance creating an Underground Utility District for Dublin Page 1 of 2 ITEM NO. 6.3 Boulevard — Civic Plaza /Sierra Court to Dublin Court. This project is intended to coincide with the Dublin Boulevard Improvement project from Civic Plaza /Sierra Court to Dublin Court which includes the widening of travel lanes to six lanes (3 lanes each direction), installation of bike lanes, new sidewalks and enhancement of existing street landscaping. On June 18, 2013, the City Council adopted the project Mitigated Negative Declaration and approved the preliminary engineering plans for the project. As a result of the preliminary walk- through of the project site with representatives of the utilities (PG &E, AT &T and Comcast), it was determined that none of the existing businesses within the project limits have overhead services from the utility poles to be undergrounded. With the adoption of the district, Staff does not forsee any additional expenses required by the property owners as the on -site utilities have already been undergrounded. NOTICING REQUIREMENTS /PUBLIC OUTREACH: The Notice of Public Hearing was mailed to the owners of the properties included in the proposed District and a similar Notice was also published in the Valley Times on July 6, 2013 inviting interested parties to attend the public hearing scheduled on July 16th and August 20tH 2013. Submitted By Reviewed By Director of Public Works Assistant City Manager Page 1 of 3 ITEM NO. 8.2 BACKGROUND: The Pacific Gas and Electric Company (PG &E) annually replaces approximately 30 miles of existing overhead electric facilities with underground facilities within its service area. This work is done under provisions of the company's Rule 20A, an electric tariff filed with the California Public Utilities Commission (PUC). Projects performed under Rule 20A are nominated by a city, county or municipal agency and discussed with PG &E, as well as other utilities. Rule 20A projects are typically in areas of a community that are used most by the general public. According to the PUC Rule 20A guidelines, the governing body of a city or county must, among other things, determine after consultation with Pacific Gas and Electric Company, and after holding public hearings on the subject, that undergrounding is in the general public interest for one or more of the following reasons: • Undergrounding will avoid or eliminate an unusually heavy concentration of overhead electric facilities. • The street or road or right -of -way is extensively used by the general public and carries a heavy volume of pedestrian or vehicular traffic. • The street, road or right -of -way adjoins or passes through a civic area or public recreation area or an area of unusual scenic interest to the general public. • The street or road or right -of -way is considered an arterial street or major collector as defined in the Governor's Office of Planning and Research General Plan Guidelines. Once a City has adopted an Ordinance creating an Underground District, PG &E is informed of the City's intent and the project is included in the PG &E Rule 20A List. The list currently includes 200 agencies that are in the queue and at various stages of work (i.e. planning, engineering or construction). According to PG &E staff, it takes approximately 3.5 to 4.5 years to plan, design and construct an undergrounding project, dependent upon if the City elects to take the lead in design and construction instead of PG &E. DESCRIPTION: On December 3, 2003, the City Council approved a priority list of potential street segments for the undergrounding of existing overhead utilities using the City's Rule 20A allocation (see Attachment 1). With the completion of this project, the current #1 priority, based on the 2003 action, is Scarlett Court ( #1a from Scarlett Drive to east end, and #1b from Dublin Boulevard to Scarlett Drive). The #2 priority is Dublin Boulevard from Civic Plaza /Sierra Court to Dublin Court. On May 15, 2012, the City received a letter from PG &E informing Staff that the City has a Rule 20A balance of $114,082 as of April 2012. PG &E allows the City to borrow up to 5 years of its annual allocation ($103,680 per year) to increase its ability to implement a project. If the City were to borrow the next five years ($518,400), the amount of Rule 20A funds the City could use for its next underground project is approximately $632,482 ($518,400 + $114,082). Presently, staff is performing preliminary engineering of the Dublin Boulevard Widening Project from Civic Plaza /Sierra Court to Dublin Court (Attachment 2). Based on the preliminary engineering work performed by the City consultant, several prominent reasons were brought to staff's attention to consider undergrounding this section of Dublin Boulevard: • This segment of Dublin Boulevard adjoins the Civic Plaza /Dublin Sports Grounds area; • Dublin Boulevard is the City's major east -west arterial used extensively by the general public and carries a heavy volume of vehicular traffic; and • This segment of Dublin Boulevard is the last section of Dublin Boulevard between San Ramon Road and Fallon Road that is not undergrounded. Staff met with staff from PG &E, Comcast and AT &T to field review the #1 and #2 projects included in the City priority list. According to PG &E, the available Rule 20A funds, including the 5 -year borrow, would allow approximately 1,300 feet of Scarlett Court to be undergrounded (total length of Scarlett Court in the priority list is 2,800 feet). In comparison, the rough estimate for Dublin Boulevard undergrounding (priority #2) is $520,000, which is within the City's expected five -year funding. Based on information gathered by Staff and its consultant, Staff is recommending that the City Council consider prioritizing Dublin Boulevard - Civic Plaza /Sierra Court to Dublin Court to Priority #1 in the Rule 20A Utility Undergrounding Priority List (Attachment 3) and authorize Staff to formally introduce an Ordinance creating an Underground District for Dublin Boulevard - Civic Plaza /Sierra Court to Dublin Court. Rule 20A account as of Fiscal Year 2003 -2004 and will accrue additional funds at a rate of about $125,000 per year. It is possible to "borrows out " -funds three years in advance; thus, the available funding at the beginning of Fiscal Year 2005 -2006, including "borrowed" funds would be $865,000. FY 2005 -2006 is the earliest the City could undertake the next district due to design times and PG &E lead time. ITEM NO. g:\Tniscproj\Dougherty Rd Imp I580 to Houston\Agst Utility UG Priorities (Update) The first priority segment, which is Dublin Boulevard from 600' west of Clark Avenue to Sierra Court, was recently completed in conjunction with the Dublin Boulevard Widening project. Undergrounding of the utilities on Dougherty Road from Dublin Boulevard to the Southern Pacific Railroad is currently listed as the fifth priority segment. The widening of Dougherty Road from I -580 to Houston Place, including the intersection improvements at Dougherty Road and Dublin Boulevard, is tentatively scheduled for construction during Fiscal Year 2005 -2006. Preliminary design and environmental analysis for the project are currently underway. It is preferable to install the joint trench and underground the overhead utilities prior to completion of the construction of the Dougherty Road widening. In addition to the benefit of "cleaning up" an area by widening the roadway and undergrounding the utilities, PG &E allows an undergrounding funding credit equal to the cost that would have had to be borne by PG &E for moving the poles back from the roadway for the widening. Based on information provided by PG &E for the available funding balance in the Rule 20A allocation and the projected annual accumulation and allowable "borrow out" provisions, it is estimated that a total amount of $865,000 will be available at the beginning of Fiscal Year 2005 -2006 from Rule 20A funding. The estimated cost of undergrounding the facilities is $561,000. The City would need to install street lights where gaps in the street light pattern would result due to the removal of existing lights on wood poles. Rule 20A funds do not cover the installation of street lighting. For the Dougherty Road segment, eight street lights will be included in the project scope of the Capital Improvement Project, the cost of which is estimated at approximately $50,000. The cost to underground private services to commercial buildings that are -served overhead at the time undergrounding takes place is an expense that is typically required to be borne by the private property owners. However, all of the existing properties fronting the segments to be undergrounded already have underground services to the buildings. Hence, there will be no cost to the property owners due to undergrounding of the overhead service lines along the street frontages. Staff .is recommending that the priority list for the undergrounding projects be revised to remove the Dublin Boulevard segment 1 that has been completed, and move the Dublin Boulevard and Dougherty Road segments 5(a) and 5(b) from priority number 5 to priority number 1. Segment 5(c), Dougherty Road from Sierra. Lane to the SPRR, is proposed to be moved to priority number 6 as shown below in the revised recommended Priority List. Staff is also recommending that the Scarlett Court be moved from the current priority number 10 to priority number 2 due to its close proximity to the I- 58.0/Dougherty Road interchange, which serves as a major entrance to the City. Scarlett Court will be broken into two segments: 2(a) from Scarlett Drive to the east end and 2(b) from Dublin Boulevard to Scarlett Drive. The priority order of the remainder of the projects on the list would remain unchanged. Streets with pole lines on two sides of the street be considered before streets with poles on one side of street due to the greater reduction in visual pollution. Consideration be given to projects including outside participation such as private developers or assessment districts which would considerably lessen the public cost of the project. Consideration be made where a street is to be widened -and the existing overhead utilities will need to be .,relocated..
