It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. FINANCIAL IMPACT: Standard Pacific Corporation, a Delaware Corporation, has provided a Warranty Bond issued by Safeco Insurance Company of America in the amount of $192,500 (Bond No. 6753808), to guarantee against any defects in the Lee Thompson Street improvements for a one -year warranty period. The City will incur annualized maintenance costs for these improvements, estimated to be $9,700 for street sweeping, street lighting (monthly), slurry seal (every five years), median landscaping, tree maintenance, and asphalt concrete pavement overlay (every 20 years). The decorative pavement on Lee Thompson Street located at the crosswalks and intersections, along with the landscaped pop -outs fronting Passatempo Park, will be maintained by the Sorrento East Master Homeowner's Association. The sidewalks, planter strip and pop -out landscaping, along the remaining portions of Lee Thompson Street, will be maintained by the Homeowner's Associations of the adjacent Tracts of the Sorrento East development. The median and landscaping on Lee Thompson Street at the intersection with Central Parkway will be maintained by the City. RECOMMENDATION: Staff recommends that the City Council adopt the Resolution accepting the Improvements for Tract 7982 constructed with Tract 7652 at Lee Thompson Street and approving Regulatory Traffic Control Devices at Lee Thompson Street — Sorrento East, Tract 7652, Neighborhood 6. Page 1 of 3 ITEM NO. 4.4 Submitted By Director of Public Works DESCRIPTION: Reviewed By Assistant City Manager Standard Pacific Corporation, a Delaware Corporation, entered into a Tract Improvement Agreement with the City of Dublin on July 19, 2011 for the construction of street and other tract improvements associated with Tract 7982 and Tract 7652 (City Council Resolution No. 122 -11). These improvements included construction of Lee Thompson Street and Palermo Way. Originally, Standard Pacific Corporation provided Faithful Performance and Labor & Materials Bonds, each in the amount of $1,306,000 (Bond No. 6753808) issued by Safeco Insurance Company of America, to guarantee construction of the Lee Thompson Street and Palermo Way improvements. On October 3, 2012, the City deemed construction of the Lee Thompson Street and Palermo Way improvements to be more than 75% complete, and approved partial release of securities provided for the improvements (City Council Resolution 184 -12). The developer provided Decreased Riders for their Faithful Performance and Labor & Materials Bonds, each in the amount of $326,500.00 (Bond No. 6753808) to guarantee the construction of the remaining improvements for Lee Thompson Street and Palermo Way. With this resolution, the City Council also approved the Traffic Signal Control at the intersection of Lee Thompson Street and Central Parkway. The developer has recently completed construction of the Lee Thompson Street improvements, and has requested that Lee Thompson Street be formally accepted by the City. The $326,500.00 security for these improvements is no longer needed for that purpose. The developer has submitted a Warranty Bond in the amount of $192,500.00, issued by Safeco Insurance of America (Bond No. 6753808) to guarantee against construction defects at Lee Thompson Street for a one -year period. In addition, the developer has submitted Bond Riders for Faithful Performance and Labor & Materials in the amount of $134,000.00, issued by Safeco Insurance Company of America (Bond No. 6753808) to guarantee construction of the remaining improvements at Palermo Way. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: A. "No Parking" signs on both sides of Lee Thompson Street between Central Parkway and Giovanni Way. B. "No Parking" signs on the east side of Lee Thompson Street at intersection of Alradi Lane C. "No Parking" signs on the east side of Lee Thompson Street at intersection of Bramante Lane D. Resolution Acceptance of Improvements for Tract 7982 to be Constructed with Tract 7652 for Improvements at Lee Thompson Street, and Approval of Traffic Regulatory Control Devices at Lee Thompson Street — Sorrento East, Tract 7652, Neighborhood 6 Page 3 of 3 Lt p-' 088VHO 13 a cfvo�j 00, NOS 8D I OV08 � v8brb55b1 z VAVS a co Ln d OV08 2 GV08 ° 08VAdOH v D.. a Z C� z RESOLUTION NO. - 13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTANCE OF IMPROVEMENTS FOR TRACT 7982 CONSTRUCTED WITH TRACT 7652 AT LEE THOMPSON STREET AND APPROVAL OF REGULATORY TRAFFIC CONTROL DEVICES AT LEE THOMPSON STREET SORRENTO EAST, TRACT 7652, NEIGHBORHOOD 6 WHEREAS, Standard Pacific Corporation, a Delaware Corporation, the developer of Tract 7652, previously entered into a Tract Improvement Agreement dated July 19, 2011, Resolution No. 122 -11, with the City of Dublin, to complete improvements for Tract 7652 and construct certain improvements for Tract 7982 with Tract 7652, including improvements along Palermo Way and Lee Thompson Street required for Tract 7982, in accordance with plans and specifications on file with the City Engineer; and WHEREAS, the developer provided Faithful Performance and Labor & Materials Bonds, each in the amount of $326,500 to guarantee the improvements for Lee Thompson Street and Palermo Way, WHEREAS, the improvements at Lee Thompson Street are complete in accordance with said plans and specifications, and any modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, certain traffic regulatory devices have been installed as part of the Lee Thompson Street improvements; and WHEREAS, the Faithful Performance and Labor & Materials bonds for the improvements on Lee Thompson Street can be released, in accordance with the authority contained in Section 66499.7 of the Government Code of the State of California and replaced with a Warranty Bond to guarantee the completed work for a one -year period following acceptance; and WHEREAS, Standard Pacific Corporation has provided a Warranty Bond issued by Safeco Insurance Company of America, in the amount of $192,500 (Bond No. 6753808), to guarantee the improvements at Lee Thompson Street against defects for a one year period; and WHEREAS, Standard Pacific Corporation has provided Bond Riders for Faithful Performance and Labor & Materials in the amount of $134,000 guaranteeing the remainder of the improvements at Palermo Way; 1 NOW, THEREFORE, BE IT RESOLVED that: 1. The said improvements at Lee Thompson Street for "Tract 7982 Improvements to be Constructed with Tract 7652 at Palermo Way and Lee Thompson Street' are hereby approved and accepted subject to a one -year guarantee period; and 2. The submitted Warranty Bond issued by Safeco Insurance Company of America, in the amount of $192,500 (Bond No. 6753808), for the portion of improvements at Lee Thompson Street included in "Tract 7982 Improvements to be Constructed with Tract 7652 at Palermo Way and Lee Thompson Street', be accepted as security for the aforesaid one -year warranty period, said period to commence on this date and terminate on the 16th day of July, 2014; and 3. The submitted Bond Riders for Faithful Performance and Labor & Materials issued by Safeco Insurance Company of America, in the reduced amount of $134,000 (Bond No. 6753808), be accepted as security to guarantee construction of the remaining improvements at Palermo Way for "Tract 7982 Improvements to be constructed with Tract 7652 at Palermo Way only "; and 4. The original Faithful Performance and Labor & Materials Bonds issued by Safeco Insurance Company of America, dated October 3, 2012, in the reduced amount of $326,500 (Bond No. 6753808), be released; and 5. The traffic regulatory devices installed by the developer within the City's right -of- way at Lee Thompson Street are hereby included in the City of Dublin Traffic Code, and said regulatory devices to include the following: • "No Parking" signs on both sides of Lee Thompson Street between Central Parkway and Giovanni Way. • "No Parking" signs on the east side of Lee Thompson Street at intersection of Alradi Lane • "No Parking" signs on the east side of Lee Thompson Street at intersection of Bramante Lane • "STOP" signs and markings installed at the following intersections: o Lee Thompson Street at Palermo Way • Lee Thompson Street at Capoterra Way 3 PASSED, APPROVED AND ADOPTED this 16th day of July, 2013, by the following vote AYES: NOES: ABSENT: ABSTAIN: ATTEST: City Clerk Mayor
